刑事和解:人本主义的对话型和解

缘起于上世纪70年代的西方刑事和解实践,以恢复性正义为理论基础,对话、商谈而非纠纷解决模式是刑事和解区别于传统和解制度的重要程序特征;实体上,强调以责任、恢复与回归作为其基本内容,关注对被害人心理损害的修复。近年来我国一些司法机关对恢复性司法进行的探索严格说来还称不上是真正的恢复性正义实践,因此,准确领会刑事和解的理论基础、程序特征和实体内容,对我国当下急速推进的刑事和解实践进行冷思考,对避免将刑事和解庸俗化,甚至变为一种功利的手段具有重要意义。

Victim-Offender Mediation: Humanistic Mediation

Origins in the 1970s, the west victim-offender mediation is different from the traditional mediations which are largely"settle-driven". It is based on the theory of restorative justice,a primarily"dialogue-driven", with emphasis upon offender accountability,restoration and returning to the community. Now some justice agency has do some profitable research about restorative justice which is not the real restorative justice,Nowadays we are propelling the practice of victim-offender mediation in our country,in case of taking victim-offender mediation worldly and taking it as a utilitarian method,it is important for us to understand what the theory ,the process and the substantive contents of restorative justice are.
