| 摘 要： | 本文从主体、客体、内容及形式四个方面,详细地分析了作为民事法律关系之一的房地产抵押担保关系成立的要件,并从当今有关法律规定入手,阐明了房地产抵押权实现的方式是拍卖.对部分有争议的相关问题谈了自己粗浅的认识.

| Abstract: | From four aspects as subject object, content and form, the dissertation analysis the necessary terms of the establishment of the mortgage guarantee relation of real estate, which is one kind of civil legal relation; clarifies that the realizing means of the mortgage on real estate is auction according to the relevant legal rules; and gives author's understanding in some relevant problems which still in dispute. |
