| 摘 要： | 中国在对外开放中提出要与国际接轨 ,法律制度是其中一部分。但在认识上人们还有不清晰的地方 ,本文澄清了经常提及的国际惯例的含义 ,论述它的法律性质与作用 ,以及与国际惯例接轨的标准和如何处理好国际惯例与国内法的关系。

| Abstract: | Legal system is one part of system which is linking up with the world in the course of China's being open to the world. There is still some misunderstanding about international usage. In this article,the author clarifies the meaning of internationalusage, discourses upon its legal character and function, sets forth the criterion of linking up with international usage, and discusses how to deal with the relationship between the international usage and the domestic law. |
