人身伤害医学鉴定的根本出路

有关人身伤害医学鉴定中存在的问题已经引起了广泛的关注和讨论。虽然刑事诉讼法规定,对人身伤害的医学鉴定有争议需要重新鉴定的由省人民政府指定的医院进行,但没有解决存在的问题。深层的也是最根本的原因是司法机关审判人员对于医学鉴定缺乏应有的认识,对于鉴定报告的审查也缺乏应有的知识和能力,无法独立判断鉴定结论的是否正确。从医学鉴定的本质、法医鉴定人的职能、鉴定报告应包括的内容以及如何审查鉴定结论等方面来看,人身伤害医学鉴定规范化、科学化的根本出路在于司法机关审判人员素质的提高、审判人员组织结构的调整。

The foundmental way of medical authenticator of bodily harm

The problems of the medical authentication of bodily harm have already caused much concen and discussion.The author thinks that the deepest and also the most foundmental cause is that the judicial officers do not attach much importance to the medical authentication,and they have no necessary knowledge and ability to examine the authenticator's report.They cannot judge whether the evidential effect of the authenticator's condition is right or not independly.In this article,the author analyses the essences of the medical authentication,the function of the authenticator,the essential nature of the authenficator's report,and that how to examine the authenficator's conclusion.The author argues that the foundmental way of the medical authenfication of bodily harm is to standardize and scientify it ,and this depends much on the improvement of the the judicial officers' quality and the adjustment of the framework of organization of the judicial organs.
