权力与权利 ,警察权力与公民权利 ,是警察法学中非常重要的问题。权力是指在政治、管理等多方面起控制、支配作用的强制性力量 ,权利是要求他人作为或不作为的一种资格 ,权力与权利相互依存、相互渗透 ,又相互对立、相互制衡 ;警察权力是警察机关及其人民警察在国家法律规定的职权范围内依法可以行使的权威性行为 ,是一种特殊的国家权力 ,包括许多若干具体权力 ,行使警察权力必须做到合法、准确、及时、适度 ;公民权利是国家宪法和法律确定、赋予并加以保护、支持和鼓励的各种法律关系主体所享有的一种安全、自由和物质好处的权能和利益。公民权利的保护程度体现着一个国家的文明程度和法治水平 ,公民应享有充分的权利。

On Police's Power and Citzen's Rights

Power and right,police power and citzen right are very important issues in the law science of police.The power means the compulsory force which has control and governing function in politics,management and other fields.The power is a qualification which asks others to do sth.or not to sth.The power and right exist each other,infiltrate each other,oppose each other and balance each other;The police power is an authorized action and also a special state power which can be implemented by police stations and the people's policeman within the responsibility and power regulated by state laws,which includes many concrete powers:police power must be carried out lawfully,correctly,timely and properly;The citzen right is a safe,free and material function and benefit which all kinds of lawful main-body should enjoy,stipulated,protected,supported and encouraged by state constitution and laws.The protection degree of citzen right reflects the civilization and legal system's level.All citzens should fully enjoy their rights.
