摘    要:劳动合同正义是劳动合同自由的核心,一部劳动合同自由的发展史,同样也是劳动合同正义的演进史。劳动合同消极自由与劳动合同形式正义、劳动合同积极自由与劳动合同实质正义的理论与实践表明:劳动合同积极自由与劳动合同消极自由相互包容,以此来达到劳雇双方利益的均衡,进而达到社会和国家利益的均衡时,劳动合同的形式正义与实质正义也就得到统一,劳动合同正义也就得以实现,劳动合同自由与劳动合同正义的动态的协调统一也就得以完成。

Abstract:Justice of the labor contract is the core of freedom of labor contract, the history of the development of freedom of labor contract is also the history of the evolution of labor contract justice. Labor contracts negative freedom and form of justice. Labor contracts active freedom and substance of justice of the theory and practice shows that: mutual tolerance of positive and negative freedom of the labor contract will achieve the interests balance of employers and employees, which social and national interests achieve the balance, the form and substance of justice of the labor contract will be unity, the labor contract will achieve justice, justice and freedom of contract labor will be able to complete the Dynamic harmonization.
