From Inalienability to Inalienability Rule: From the Perspective of Law and Economics

There exist various linkages in the market between the transaction objects and the subjects,"people".Thus some of the transaction objects may have endogenous inalienability.The inalienability is affecting the law through ethics,religion and customs,and gradually forms the inalienability rule for property rights and remedies.This paper analyzes the contents of inalienability,inalienability rules and the relationship between the two.The author presents the role of the underlying economic factors in the two concepts as well.
