论对行政相对人不产生实际影响的行政行为

对行政相对人不产生实际影响的行政行为是指在行政法治实践中由行政主体依法定要件实施的具有行政行为外型但与行政相对人权益没有直接关联的内部行政行为或外部行政行为。其包括貌似外部行政行为的内部行政行为、貌似给行政相对人作出的以第三人为对象的行为、貌似具有特定对象的对象不特定性行为、貌似实体性的程序性行为、貌似执行性的决策性行为、貌似设定义务的赋权性行为、貌似法律行为的事实行为等类型。对行政相对人不产生影响的行政行为并非完全没有诉讼地位,它是具有部分诉讼地位的行政行为,即当事人有将其作为诉讼标的的权利,人民法院有裁定不予受理的权力,原告资格转移后有再诉的可能,人民法院应作出适当的司法处置。

The administrative acts having no pracctical effect on administrative counterparts mean internal or external administrative acts,having no direct relations with administrative counterparts’ rights but having external forms of administrative acts,which administrative subjects make according to legal requirements in practice of rule of administrative law.The said acts include internal administrative acts seeming like external administrative acts,acts taking third parties as objects seeming like acts taking administrative counterparts as objects,acts of non-specific objects seeming like acts of specific objects,procedural acts seeming like physical acts,decisive acts seeming like executive acts,empowering acts seeming like acts of imposing obligations,factual acts seeming like legal acts.The said acts have part of litigation status,that is to say,parties have rights to regard them as litigation objects,the courts have power to rule to reject them,the parties which plaintiffs’qualification transfer have possibilities of bringing lawsuits,the courts should take proper judicial measurement.
