| 摘 要： | 在当前中国社会，公共利益无论是在理论上还是在实践中，都是一个被误传误用最多的概念之一。欲消除乱象，就需要从法哲学的角度重新审视和界定什么是公共利益。关于公共利益，有不存在说和存在说两种对立的主张。在存在说中，又有私人利益总和说、国家利益说、社会利益说、目的价值说等多种学说。鉴于公共利益表现形态的千变万化，与其去界定一个抽象的概念，不如归纳出公共利益的若干特质更加重要。
