| 摘 要： | 欧洲人权机构通过处理大量教育权的申诉从实践层面上揭示了教育权和强制性教育的内涵和外延,并确立了欧洲各国在建立教育制度和保障私立学校、家长和外国受教育者权利方面的义务范围。尽管欧洲人权机构在维护欧洲教育权方面发挥了积极作用,其经验值得其它区域借鉴,但从其过去和现有的理论和实践来看,它对教育权的保护是不完整的。

| Abstract: | By disposing of a g reat number of appeals over education right,European human rights organization h as on a practical ba-sis unveiled the substance and extension of education righ t as well as compulsory education.Range of obligation is defined for mem-ber st ates to set up education system and protect rights concerning private schools,pa rents and foreign educates.Although the Euro-pean institution of human rights t akes a positive role in protecting the right to education,which provides other c ontinents with some reference,the right to education protected by it is still no t integrated. |
