摘    要:现行物权法为农村土地交易理清了所有权及其相关权利的关系。但是农村土地交易仅仅依靠物权法是无法解决的。农村土地交易权利配置与利益分享机制是解决农村土地问题的关键。构建以农地发展权为基础的农地制度,再进行具体的制度安排是构建我国土地交易利益分享机制的有效途径。

Abstract:The existing property law has made the property right and its relating rights clear for land trade in the rural areas.However,the problems in rural land trade can not be solved only by property law.Instead,the mechanism to dispose right and share benefit is the key to solve these problems.Based on the right of rural land development,it is an effective way in our country to construct a benefit-sharing mechanism of land trade by implementing rural land system and then arranging accordingly.
