| 摘 要： | 未成年人犯罪已经成为日益突出的社会问题,在对待未成年人犯罪刑罚的问题上,司法机关考虑未成年人在心理和生理上的自身特点,片面追求保护的力度,轻视刑法的惩罚教育作用,在未成年人犯罪的定罪量刑上过多使用缓刑或单独处以罚金等刑罚,导致部分案件罪责刑不相适应,量刑畸轻,对未成年人达不到应有的威慑和惩罚作用．致使教育感化未成年人的目的达不到,反而纵容未成年人再次犯罪。因此,我国应引入英国等国家的“社会服务令”刑罚制度,以我国的国情为基础,建立具有我国特色的“社会服务令”制度,以便在惩罚和保护未成年罪犯两方面达到一个平衡,既矫正和帮助未成年人成长,又在最大程度上保护未成年罪犯的权益,并最终实现社会利益与未成年罪犯个人利益双赢。

| Abstract: | Juvenile delinquents are an increasingly serious social problem. On the problem of the punishment of juvenile delinquents, judicial authority only take consideration of the force of protection according to the youth''s own characters both on mind and body without the consideration of the education, and overuse the suspended sentence or penalty on the punishment of juvenile deliquents, which lead to the dis-correspondence of the crime and the punishment in some cases; therefore, the light punishmentdo not achieve the function to the juvenile delinquents, which lead to the crime again. Hence, applying the system of "community service order", basing on the nation''s condition and building up the system of own "community service order" with china characters can achieve the balance on the punishment and protection, which can help the growing-up to the juvenile and protect the rights of the juvenile and finally lead to the win-win situation of social interests and the right of juvenile. |
