In this paper some of the evidence relating to the incidence of racial discrimination in the criminal justice system will be critically examined. It will be argued that equal opportunities policies have been adopted in the British case with the stated aim of tackling the exclusionary effects of racial discrimination. The notion of equal opportunities has been contested not least by those who have advocated anti-racist approaches towards discrimination. Anti-racism has been represented by some of its advocates as reflecting a critique of the authentic source of racism which is loosely defined in terms of social structure and capitalist social relations. The case for reconstituting anti-racism in such a way as to make it relevant to the lives of black offenders will be made. Finally, a framework for developing policies based upon the implementation of specific and clearly stated rights will be made.  相似文献

The policy issues involved in the social problem of elder victimization could fill volumes. Even the policy issues involved in the new concept of elder justice are multi-faceted. Through the lens of a policy analysis perspective, the history, ideologies, politics, social movements, and economics of policies that promote the collaboration between adult protective services and law enforcement are examined. The analysis of state and local policies as well as a promising federal legislative initiative will, hopefully, help policy advocates understand from where the movement toward collaboration between adult protective services and law enforcement has come as well as where it may be headed.  相似文献

This article examines the dilemmas faced by undocumented immigrants within the criminal justice system vis-à-vis the immigrant detention center and the resulting implications for social work. It explores the new realities for undocumented immigrants in the United States, including an explanation of state policies that have led to the criminalization of immigrants. The criminal justice and homeland security responses to undocumented immigrants, including the trend toward the privatization of immigration detention centers are analyzed. Finally, the implications of these trends for social work practice are discussed.  相似文献

Abstract The European Union's policy of economic concentration and de regulation en tails a creeping loss of sovereignty over social policy for the member States, which are also subject to the common monetary policy: the budgetary discipline they are expected to maintain calls for a constant reduction in social expenditure and the radical privatization of public areas of the economy. The question is whether, by harmonizing its various national fiscal, social and economic policies to a greater or lesser extent, the European Un ion can regain the freedom of action which individual States have lost. Given increasing in terregional competition, member States find them selves also competing in respect of their social systems. The idea of a European social union, dismissed in the past as a pipe dream, is increasingly be coming a necessity for the success of the integration process in the future. The European Union will remain an alien concept for its citizens until it succeeds in developing a specific base for emancipatory democracy. This will only be possible when social justice and a high level of social security benefits are guaranteed for all citizens. The European constitution is an other step in this direction but is not enough by it self; it can only set democratic processes in motion. The creation of a genuine social un ion calls for further initiatives from social security actors, among others.  相似文献

Globalization has played a major role in redefining the nature of the welfare state and the ways in which social work practice is being undertaken in a number of different countries. Moreover, its impact has been to exacerbate gendered and racialized social relations. In this article, I explore the changes that globalization has wrought on the social work profession. These have resulted in neo-liberialist policies that have contributed to the realization of a purchaser-provider split in service delivery, the commodification of inter-personal relationships embodied in caring work and the creation of a technicist cadre to deal with vulnerable people in need. I conclude by arguing that social workers need to engage in a public debate which challenges this state of affairs and form alliances with clients, professional associations, trade unions, politicians and other professional groupings in order to set a new welfare agenda which replaces profit-making with social justice to ensure that needs-led assessments and people are at the heart of their professional remit.  相似文献

Violence is embedded in Australian culture. Yet versions of Australian history and claims about what it is to be Australian deny such a record. Such denial guarantees that violence will continue: in the treatment of women, children, indigenous people and other vulnerable groups: and through policies which ignore or legitimate brutal or unfair treatment. The means of replacing violence with non-violence depends on attaining social justice through empowerment. This goal focuses on men and emphasises that the debate about an Australian republic is an opportunity to repudiate violence and to set new standards for civil relations in all walks of life.  相似文献

Bertha Reynolds, one of the foremothers of social casework, is known for her commitment to social justice and the struggles of poor and working people. Her ideas about brief strengths‐based practice, which she taught when she supervised social workers at the National Maritime Union between 1943 and 1947, are less well known. She presented these ideas with case examples in her book Social Work and Social Living, a work that includes a critique of society, social policies, and the social work profession. The author contends that Reynolds was ahead of her time in her conceptualization of brief treatment.  相似文献

Community gardens vary enormously in what they offer, according to local needs and circumstance. This article reports on research and experience from the USA. The context in which these findings are discussed is the implementation of Local Agenda 21 and sustainable development policies. In particular, emphasis is given to exploring the social dimension of sustainable development policies by linking issues of health, education, community development and food security with the use of green space in towns and cities. The article concludes that the use of urban open spaces for parks and gardens is closely associated with environmental justice and equity.  相似文献

A growing body of evidence reveals that people of color and low-income persons have borne greater environmental and health risks than the society at large in their neighborhoods, workplace, and playgrounds. Over the last decade or so, grassroots activists have attempted to change the way government implements environmental, health, and civil rights laws. Grassroots groups have organized, educated, and empowered themselves to improve the way government regulations and environmental policies are administered. A new movement emerged in opposition to environmental racism and environmenttal injustice. Over the last decades or so, grassroots activists have had some success in changing the way the federal government treats communities of color and their inhabitants. Grassroots groups have also organized, educated, and empowered themselves to improve the way health and environmental policies are administered. In particularit focuses on three aspects which are central to social workand care management: current developments in residential andnursing home care; charging for care; and the shifting boundarybetween health and social care. It argues that, in all respects,these policies and the ways in which they are being implementedare incompatible with the notion of social justice. Over thelast fifty years, the older generation has invested heavilyin the welfare state and continues to make a significant contributionto it. In response to the global financial crisis, social policies in Europe and elsewhere incorporated a logic of social investment to reduce (child) poverty and social inequality. Several critiques, however, have been raised against the narrowness of this discourse. In order to introduce another way of seeing, an interview study was conducted inspired by the interpretative paradigm of lifeworld orientation. This has allowed us to acquire a critical, in‐depth understanding of the consequences of economic downturn and unemployment for families with young children (0–3 years old), from their point of view. Findings highlight the importance of listening to parents here and now, in order to be able to take account of their concrete, lived realities within the context of the broader society and critically assess these realities according to principles of human dignity and social justice. Summary Three sets of ideas, which I am calling justice, welfare, andcommunity approaches interact in the criminal justice systemsof England and Scotland. Social workers are usually most influencedby a welfare approach but this approach is always in dangerof becoming arbitrary. The essential values of a welfare approachmight in fact be strengthened by introducing from the justiceapproach ways of structuring discretion. This idea will be examinedin relation to juvenile justice and parole where compulsorypowers back the application of welfare ideas. Models of service‐user participation have derived from citizenship or consumerist agendas, neither of which has achieved the structural reforms important for the most marginalised social work clients. This article proposes Fraser's model of ‘parity of participation’ as an appropriately multifaceted frame for capturing the social justice aspirations of service‐user participation. A qualitative case study compared the experiences and expectations of people who had used Australian mental health services with a sample who had used Australian homelessness services to examine their expectations of participation at individual and representative levels. The findings reinforce concerns from Fraser's research about the tendency for identity‐based consumerist notions of participation to reify group identity. This leads to tokenistic service‐user involvement strategies that have little impact on participation at a structural level. Fraser's parity of participation is shown to have untested potential to reshape service‐user participation to meet the social justice aspirations of social work clients. Key Practitioner Message: ● Innovative, service‐user driven strategies for collaboration will be those which challenge existing power structures;Service users want their contributions to decision making to generate identifiable change in the system of social services;The success of service‐user participation strategies might be the extent to which political, economic and cultural opportunities are enhanced.  相似文献

State policies exert a great influence over Chinese civil justice. Article 6 of the General Principles of Civil Law stipulates that state policies are a source of civil law, but the path by which they enter civil justice is not a rational one and may lead to adjudication difficulties with state policies. State policies are integrated with state law, and the laws and legal interpretations formulated by the National People’s Congress and its Standing Committee, judicial interpretations, administrative regulations, autonomous regulations and special regulations, administrative rules and other regulatory documents are forms of expression of state policies. Different rules for adjudication apply depending on the different vehicles of state policy. The Supreme People’s Court can play a role in making public policy and guiding state policy into civil adjudication through “open” and “unseen” channels.  相似文献
