Abstract

A momentous piece of legislation, the Americans With Disabilities Act (ADA) of 1990 provided for the elimination of discrimination against individuals with disabilities and more significantly is aimed toward improving their employment opportunities. There is, however, evidence that the ADA implementation has not moved fast enough in increasing employment opportunities for persons with disabilities. This article reviews the literature on disability and employment barriers, federal statutes, societal attitudes and biases, and human relations misconceptions associated with disabilities. It discusses social work roles, advocacy for social justice, implications for rehabilitation counselors, and issues related to disabilities and employment.  相似文献

In this paper, the author overviews the key components of the ADA. A discussion is offered on why and how persons with disabilities are discriminated against. The standard stereotypes often heard about persons with disabilities are offered. Critical United States Supreme Court decisions are presented; these decisions have greatly limited the power of the ADA in protecting the rights of persons with disabilities. Even though the United States Supreme Court has narrowed the impact of the ADA in American life, a number of Equal Employment Opportunity Commission (EEOC) cases are presented, suggesting this federal agency is attempting to protect persons with disabilities against discrimination. The final part of the paper deals with the topic of advocacy; advocacy may well be one of the most effective tools to help insure that the rights of people with disabilities are protected in the 21st century.  相似文献

Arkansas has a significant need for improving the availability of affordable housing with access to supportive services for its large population of elderly and persons with disabilities. Abstract

Persons with disabilities are a distinct and insular minority group within the United States. Given the fact that social workers offer critical social services to this group, it is important for social work programs to offer meaningful curriculum content on persons with disabilities. This article presents key issues that social work educators should find useful for teaching about persons with disabilities. Specifically, a discussion is offered on the disability civil rights movement, the culture of disability, models for defining disability, knowledge areas on disability issues, teaching tasks and strategies for focusing on persons with disabilities.  相似文献

Summary

Social service providers of consultation, counseling, and education can benefit from determining their social justice awareness, knowledge, and skills to ensure culturally competent practice and to challenge the multiple oppressions facing clients and staff on individual, cultural, and institutional/systemic levels. The Social Justice Advocacy Readiness Questionnaire (SJARQ) provides a means to advocate for social justice with persons of multiple cultural identities, including all sexual orientations and gender identities. The SJARQ instrument contains three areas of self-assessment for social services staff: individual social justice advocacy awareness, comfort, and values; cultural social justice advocacy knowledge; and institutional/systemic social justice advocacy skills.  相似文献

ABSTRACT

Advocacy has received less attention in social work research than other aspects of social work practice. This paper draws attention to two tensions in social work advocacy; between worker-led advocacy and person-led advocacy, and between individual advocacy and system level advocacy. We argue that human-rights-based social workers must choose a person-led approach over a worker-led approach while advocating with both systems and individuals. This argument is made by drawing on findings of an evaluation of Independent Mental Health Advocacy (IMHA) in Victoria, Australia. It is shown that social work training had not prepared social workers for rights-based, person-led advocacy and that social workers in public mental health services were struggling to maintain the rights of people in their services even with assistance from IMHA.

Abstract

Statistics consistently demonstrate that people with disabilities are the poorest, least educated, and largest minority population in America. This article examines the employment provisions of Title I of the recently enacted Americans with Disabilities Act (ADA) and its use in combating poverty for individuals with disabilities. The ADA in its entirety, and Title I in particular, is useful both as an advocacy and pedagogical tool to understand and alleviate poverty, oppression, and discrimination. Suggestions for infusing this content into the professional foundation curriculum are included.  相似文献

Abstract

Students with disabilities in graduate school have requirements additional to those of non-disabled students, and face barriers to retention and graduation. This paper addresses the issues facing students with disabilities in clinical graduate programs, and outlines a dozen specific rights for students with disabilities. The legal and social contexts for considering these rights are examined. Three legal tenets (separate is not equal; equality versus equity; assumption of innocence until proven guilty) are discussed as they apply to disability. Twelve suggestions for making the application process more accessible to persons with disabilities are offered.  相似文献

Abstract

Social workers who work with families and children are often unaware of the legal protections afforded to educational experiences for children, particularly to children with disabilities. Yet, all social workers, regardless of their practice setting, should be aware of the important educational rights to which children with disabilities and their families are entitled, as codified in the original legislation, P.L. 94–142, and its subsequent revisions. This legislation is currently entitled the “Individuals with Disabilities Education Act,” or the “I.D.E.A.” Provisions included in the I.D.E.A. are covered with which all states that receive federal educational funding are mandated to comply. Reviewed are the 13 “disabling conditions” that allow for students to qualify to receive special educational services, as long as one of the conditions is adversely impacting their educational success. It concludes with recommendations for social work advocacy regarding this legislation.  相似文献

Abstract

In the decade since initial implementation of the Americans with Disabilities Act in the United States, many questions have arisen pertaining to the rights of employers and employees in light of the employment of and services that must be provided to persons with disabilities. One of the most controversial aspects of the legislation is the issue of direct threat. This relates to the concern that workers or clients with disabilities may be a threat to others due to their condition. Integral to this fear is the employer's ability to protect persons within the work environment from such a threat, while remaining in compliance with the ADA. This paper considers the issue of direct threat and its pertinence to the social work profession, and provides recommendations for employers and supervisors in the field.  相似文献

ABSTRACT

The voices of non-elderly adults with disabilities who currently-or used to-reside in nursing homes are rarely heard. A grassroots disability advocacy organization conducts participatory action research in the form of a writing workshop in collaboration with a local community-college. Participants with disabilities describe their lives and their experiences in nursing homes with the help of volunteer scribes. The information provided in their accounts will help strengthen community-organizing efforts of the disability advocacy organization. And participants have been empowered by the realization that their life stories are helping others to leave nursing homes and join community settings.  相似文献

ABSTRACT

Characteristics of the current United States criminal justice system include mass incarceration at a rate higher than that of any other Western country, extraordinarily long sentences, rampant racial discrimination, and discrimination against all low-income persons. The impact of this system goes beyond devastation of those subject to supervision of the system to their families, communities, and society at large. This article analyzes the current criminal justice system relative to neoliberalism and ongoing reform efforts. The possible roles of radical social work in facilitating reforms and connecting criminal justice advocacy and issues to larger structural issues as well as direct practice strategies are explored.  相似文献

Abstract

This exploratory study examines the social interactional aspect of community integration among persons with psychiatric disabilities. Six focus groups were conducted with 18 mental health consumers in three publicly sponsored community residential programs and 11 staff members providing services to these consumers. Mental health consumers reported both positive and negative experiences in their interactions with community residents. Despite perceived differences between persons with psychiatric disabilities and their neighbors, consumers considered reciprocity and mutual accommodation to be critical for building social relationships in their communities. Mental health providers suggested that social integration can be facilitated by developing independent living and social skills, by overcoming self-stigma and institutional and homeless mindsets, and by having a supportive community of consumers.  相似文献

Abstract

Studies of disability movements have centred on exploring how movements have emerged and how their strategies have been devised to effectively advocate for the rights of the people with disabilities they represent. However, little attention has been focused on examining their organisational contexts and how they shape ideologies and choice of strategies, which have implications for the success of their advocacy endeavours. This article seeks to contribute to knowledge in this area by studying the case of a disabled people’s organisation in Cambodia. The resource dependency of disabled people’s organisations on international development partners results in their ideologies and strategies being driven by the latter. This has not only fragmented their resources, but also made their endeavours less relevant to the needs of people with disabilities. This may act to prevent such organisations from building a common ground for collective action, and from effectively pressing for social change.  相似文献

Abstract

This article describes how a state health authority capitalized on the increased popularity of the Internet among consumers by launching a website devoted to improving communication among persons interested in children with disabilities and their families. The health authority collaborated with a local school of social work to redesign the website using the family-centered paradigm and evaluate its effectiveness. A sample of 51 respondents participated in the web-based survey. The article describes the process and methods of evaluation as well as the results of the survey to enhance feedback for the website's further development. Lessons learned for the design, development, and marketing of future websites are also covered.  相似文献

Traditional models of identity development are inadequate when applied to lesbian, gay, and bisexual (LGB) persons and persons with disabilities. The identity development and life experiences of persons with disabilities and LGB persons are similar in many respects including being raised/socialized by persons who are not a part of that group, and being educated to conform to the standards of behavior and appearance of the dominant culture. This article describes and critiques four models of identity development as applied to LGB persons and persons with nonvisible disabilities: stage/linear, issues/milestone experiences, social constructionist, and interactional. The authors propose an interactional identity development model for persons with disabilities and LGB persons that incorporates the significance of bio-psycho-social-cultural contexts, the influence of multiple identities, the fluidity of identity formation, and the importance of language.  相似文献
