Over the last 30 years, the victims' rights movement has expanded the role of victims in the American criminal justice system. As a result of this movement, judges, prosecutors and parole boards must now hear victims' views at all stages of the criminal justice process, including plea bargains, and sentencing and parole decisions. Legislative efforts have been spearheaded by victims' families, and legislation has been named after deceased victims. Also, victims' families can now view executions in states across the country. The victims' right movement assumes that the criminal justice system should privilege victims' interests over those of society. In so doing, it denies society as a consideration, which is tantamount to a denial of society itself. This article positions victims' rights' denial of society within the current conjuncture, marked as it is by the contradiction between neoliberalism and American liberalism. Victims' rights' denial of society is an expression of the denial of society implicit in American neoliberalism, which seeks to privilege individual interests over those of society. This paper argues that victims' rights is a powerful element of the neoliberal project for three reasons. First, victims' rights imputes the authority of legal discourse to neoliberalism's denial of society. Second, important actors in the rise of neoliberalism have also worked to establish victims' rights. Finally, victims' rights comprehensively circulates throughout America and offers powerful points of identification that incorporate Americans into the victims' rights formation. I explore the denial of society in three victims' rights practices: naming criminal legislation after crime victims and passing such laws in honour of victims; allowing victims' families to view executions; and prosecutors, judges and police personnel making legal decisions according to victims' wishes. I examine the consonant denial of society in three neoliberal practices – monetarism, supply-side economics and welfare reform – and demonstrate how neoliberal advocates like Bill Clinton, Ronald Reagan and Paul Gann worked to advance victims' rights. I also describe the production, consumption and comprehensive circulation of victims' rights texts. Finally, I consider Cultural Studies' unique contribution to legal studies.  相似文献

Abstract

This study is concerned with the nature of parent-child conflict in the Korean immigrant home and how such conflict impacts on children's self-esteem, depressive symptoms, sense of marginality and subsequently their coping behavior. Acculturative stresses of immigrant families and potential cultural sources for intergenerational conflict are explored. To test the relationship between intergenerational conflict and its impact on children's psychological well-being, the study relies upon 312 cases of survey data that were collected by Shalom Christian Counseling Center in Los Angeles in 1999-2001. Using a series of bivariate relationships and multiple regression analyses, we evaluate the relative effects of intergenerational relations and perceived marginality along with several demographic factors on dependent variables: self-esteem, depressive symptoms, and coping behavior. Our findings clearly demonstrate that conflictual intergenerational relations impact negatively on the psychological adaptation process of Korean immigrant children. Korean immigrant children whose conflict is not dealt with or resolved well tend to exhibit high depressive symptoms and low self-esteem, which also are associated with their perception of marginality in larger society. Females are more associated with depressive symptoms, but less on unhealthy coping behavior. Children whose residency is relatively shorter are less likely to show depressive symptoms and subsequently to engage less in negative coping behavior than are those who have resided longer in the U.S. These children tend to experience more unhealthy coping behavior than do children having stable relations with their parents at home. The implication of this study is discussed, and possible intervention methods are suggested.  相似文献

Abstract

It is frequently assumed that the model of their parents' marriage exerts a significant influence on the next generation, but little has been done to examine the part played by personality characteristics of parents and children. This longitudinal study examines the relative contribution of parental divorce, parents' marital (dyadic) satisfaction, conflict resolution style and selected personality qualities on children's personality qualities and self-image as adolescents and adults, and their dyadic satisfaction and conflict resolution style as adults. The samples were 67 adolescents from divorcing and intact families and their parents. Parents and children were interviewed when the children were aged 13-16, and the divorcing families were at the point of divorce. The children were followed up over 10 years until aged 23-26. At Year 1 the parents completed the anxiety, depression, sensitivity and submissiveness scales of the Neuroticism Scale Questionnaire (NSQ), the Spanier Dyadic Satisfaction Scale, and a conflict resolution scale, and made an appraisal of their children's socio-emotional maturity. Adolescents also completed the NSQ and a measure of self-image (Offer Self-Image Questionnaire: OSIQ). Ten years later the children again completed the NSQ and the OSIQ, and those who were currently in a dyadic relationship completed the Spanier and the conflict resolution scales. There were no differences on any measures between the children from divorced and intact homes. Husbands and wives were in reasonable agreement about their dyadic satisfaction and conflict resolution style, but no relationship was found between these and the corresponding self-reports of their adult children. Over the ten years of the study, mother and father depression predicted child depression, mothers' sensitivity predicted childrens' (and especially daughters') sensitivity, and fathers' lack of sensitivity predicted sons' submissiveness. The parents' appraisal of their adolescents' socio-emotional maturity at Year 1 predicted their children's self-image at Years 1 and 10, and their conflict resolution at Year 10; while self-image at Year 10 predicted contemporary Spanier scores. The findings are discussed in the light of current debates on the contribution of personality qualities to divorce and its sequelae for children.  相似文献

Abstract

Parental alienation refers to a parent's attempts to distance a child from the child's other parent. We examined (1) the effects of “feeling alienation” upon college students' recollections of their childhood relationships, (2) the effects of “feeling alienation” on perceptions of adult parent-child relationships, and (3) the likelihood of alienation in intact and divorced families. A sample of undergraduates (N = 227) completed the Relationship Distancing Questionnaire and numerous other relationship questionnaires. Results suggested feeling alienation is inversely related to the quality of parent-child relationships during childhood and young adulthood and can be found in intact as well as divorced families. Findings also indicate parental conflict is a better predictor of whether alienation occurs than parents' marital status is.  相似文献

Abstract

The emotional and psychological risks to children of high conflict divorce have led to the increased involvement of mental health professionals in child custody cases. Numerous service models (Greenberg & Gould, 2001; Johnston, 2000; Johnston & Roseby, 1997) have been developed to assist divorcing families in minimizing family conflict and supporting children'S needs. This underscores the need for judges and attorneys to understand the ethical and professional standards that underlie competent mental health practice in forensic cases. The practices of mental health professionals providing court-related services may have a substantial impact on the validity of their professional opinions, the effectiveness of services provided to children and families, and children'S development and adjustment. The authors suggest core ethical and clinical issues to be considered by all psychologists who work in the context of custody disputes. It is hoped that these professional practice suggestions will also be useful to attorneys and judicial officers in assessing the quality of mental health professionals' opinions.  相似文献

Abstract

The prevalence of families experiencing divorce has lead to an increase in studies examining the consequences of parental divorce for children and also for young adults. The literature, especially focusing on young adults, is characterized with inconsistent findings. The purpose of this study was to explore these young adults' accounts, their attitudes toward cohabitation, marriage, and divorce, their dating behavior, and trust and commitment issues for them. Results based on sixty in-depth interviews indicated that parental conflict, quality of parents' new relationship(s), and parents' supportiveness during and after divorce were important factors affecting these respondents' attitudes and behavior. Age at which divorce occurred seemed to affect trust and commitment the most.  相似文献

Abstract

Reduced family conflict, consistency in roles and parenting, and limited negative life changes seem to be particularly important variables in promoting children's adjustment to divorce.

The impact of family functioning on child adjustment was investigated in a sample of 22 recently separated or divorced families with a total of 32 children. A series of multiple regression analyses using factors on the Family Assessment Device to predict Child Behavior Checklist scores indicated that family functioning is a significant predictor of children's Externalizing behavior problems. The Communication factor accounted for a significant portion of unique variance in the externalizing scores that was unaccounted for by the other factors. When separated parents can communicate with each other to co-parent their children, as well as communicate affective limit-setting messages to their children, the children exhibit less behavioral problems.  相似文献

ABSTRACT

Family members in both separated or divorcing and married families completed a range of questionnaires about the conflict in 3 relationships—couple, parent–child, and sibling—across 2 phases of the study approximately 12 months apart. In addition, the adolescents completed measures of adjustment: self esteem, depression, and anxiety. Adolescents in a subset of the divorcing families were interviewed about the conflict in their families across the 2 phases (107 at Phase 1 and 35 at Phase 2). Analyses showed that conflict was higher in the separated or divorcing families across all 3 relationships, and that the highest levels of conflict occurred for the high-conflict divorcing families. Qualitative data from interviews illustrated the nature of the conflict that was occurring.  相似文献

BackgroundFamily reunification refers to the process through which children and adolescents under a measure of temporary separation (foster care or residential) return to live with their biological families. The research has begun to reflect a paradigm change in intervention and support for these families that affects the consolidation of reunification and the prevention of new processes of separation and reentry into the protection system.ObjectivesThis article examines the needs of parents who are susceptible to an educational intervention from a positive focus that contributes to the consolidation of family reunification.MethodEighteen semi-structured interviews were conducted and 22 discussion groups were convened with 135 participants (63 protection-system professionals, 42 parents and 30 children and adolescents). The data were analyzed through content analysis and were subject to peer revision.ResultsA series of parents' specific educational needs when their children return home was recognized. These needs can be the objects of family intervention based on a positive focus directed toward highlighting parents' strengths and are related to awareness of family progress, emotional management, giving and receiving help from other families and social support. The participants' comments show that feelings of self-sufficiency and positive reinforcement are fundamental for consolidation of the process.ConclusionsSocial support through formal and informal networks may be a path to explore for providing more and better support after returning home. Empowering families so that they can be agents of support for other families can be a way to consolidate reunification, allowing families to be active agents in the reunification process. In addition, listening to children's voices can be a good strategy for family consolidation.  相似文献

ABSTRACT

The paper presents a visual methods approach from a cross national methodological project that used digital visual technologies to examine young children's perspectives in father-child interactions. The approach combines capturing the dialectic with visual reflexivity. The notion of ‘capturing the dialectic’ specifically by analysing conflict to gather the child’s intention as their perspective, is underpinned by finding the contradictions in a situation of which children are a part. Visual technologies and in particular digital film does this, because it can identify difference, as it observes and captures the dialectic process. Researchers collected between 5–10 hours of film footage and twenty-four film elicitation interviews from young children and their fathers in twelve families within England, Hong Kong, Norway and India. In the study, participants took footage of routine father-child interactions chosen by the children; and researchers sampled the footage for situations of conflict and emotionally charged moments in order to capture the dialectic. Researchers then conducted film elicitation interviews with the children and fathers, which were recorded for the purpose of visual reflexivity. This visual methods approach can support social science researchers to address differences in representation and truth, for a better understanding of a young child’s perspective in cross-national projects.  相似文献

Previous research suggests that the quality of parents' relationships can influence their children's adjustment, but most studies have focused on the negative effects of marital conflict for children in White middle‐class families. The current study focuses on the potential benefits of positive marital quality for children in working‐class first generation Mexican American families using observational and self‐report data. This study examined the links between positive marital quality and child internalizing and externalizing behaviors 1 year later when the child was in sixth grade (N = 134 families). Positive marital quality was negatively correlated with child internalizing behaviors. Parent acculturative stress was found to mediate the relationship between positive marital quality and child internalizing behaviors in sixth grade.  相似文献

Abstract

Within a child custody context, this article systematically reviewed the available qualitative research of post separation, high conflict, co-parenting relationships. Separated parents’ experiences of high conflict were reportedly embedded in pervasive mistrust and disdain, and underpinned by concerns over differing parenting styles, or the other parent’s ability to adequately care for the child. The factors that potentially maintained conflict were parental concerns regarding the child’s safety and well-being when in the care of the other parent. The factor that potentially escalated conflict was disdain directed at the other parent’s concerns. Recommendations for future research and implications for social policy for these families are discussed.  相似文献

ABSTRACT

Foster parents and children (n = 64 families) who participated in a program to reduce the digital divide among foster children were surveyed about difficulties experienced in use of online communications. Providing Internet access to foster families increased Internet use, but was not perceived by parents or children as taking away time from other family or social relationships. A minority of parents and foster youth, however, reported a variety of problems ranging from benign arguments over access to the computer or frustration over equipment failure to serious concerns about children receiving pornography or meeting a sexual predator online. Although the majority of both parents and social workers were confident in their ability to deal with Internet-related problems, approximately one-third had low confidence in their ability to deal with foster family's Internet-related difficulties. Training foster parents on using filtering software to prevent pornography from coming into the child's experience of the Internet significantly reduced problems related to pornography when compared to foster families not in the program. In this article we identify some of the challenges for gay men who desire to create more intimate relationships and more stable families in the evolving and potentially more conducive socio-political environment of the 21st century in the United States. Secondly, we delineate a multi-systemic structural model of working with male couples and families that addresses the interplay of the couple's interactional system with larger religious, civil and social systems. Abstract

Ainsworth and Maluccio (Australian Social Work, December 1998) drew attention to the increased use of kinship care for children who need care away from their parents. This paper discusses the aim of family preservation, on which kinship care is predicated, and the challenges for legal decision-makers to meet this aim when children are before the courts in need of care and protection. It draws from findings of a study of magistrates' decision-making in child protection cases (Sheehan 1999). The paper provides examples of family situations that typically confront the Children's Court in Victoria and the court's response to them as it attempts to balance the importance of family ties and the reality of risk for a child; a reality that challenges valued beliefs about families and their ability to always care for their children.  相似文献

SUMMARY

This study evaluated whether a brief screening measure of child psychosocial functioning completed by parents could assist drug and alcohol workers to identify which of their client's children needed follow-up support. As part of a broader research and intervention program for 4–13 year old children with substance dependent parents, the Strengths and Difficulties Questionnaire (SDQ) and a broader clinical assessment were completed with the families of 48 children. Validating its usefulness in this population, significant and moderate correlations were found between SDQ scores and workers' assessments of children's social, emotional, and cognitive development and schooling.  相似文献

SUMMARY

Data we collected in longitudinal and cross-sectional studies of divorcing families provide an empirical basis for understanding the dynamics of divorced fathering. Our findings focus on the difficult circumstances of divorced fathers, rather than on their defective characters. We find that fathers continue visiting and paying at high levels when they perceive that they retain some degree of paternal authority. The loss of this sense of paternal authority appears to occur, in part, because fathers perceive that the legal system and their divorce settlements were unfair to them. We also find that the custodial mother, who sometimes sees little value in the father's involvement, limits the father's role within the post-divorce family. These findings formed the theoretical foundation for an intervention we developed for recently divorced fathers called DADS FOR LIFE. This 8-week program focuses on retraining divorced fathers' attitudes and motivations by teaching them skills to manage conflict with the custodial mother, and giving them parenting tools to use during visitation. We are in the process of a randomized trial to evaluate this program.  相似文献

Abstract

This paper describes quantitative evaluation of a program designed to increase noncustodial fathers' visitation frequency and financial assistance to their children. The initial program objectives were to enhance parental skills and work opportunities for fathers. Discussion group data revealed that additional obstacles to father involvement included conflicts between parents and substance misuse and abuse. Communication skills, anger management, alternative methods of coping with stress and increased activities for families were added to the program components in response to these needs. Future plans for strengthening community connections to expand educational, training and employment opportunities as well as increased outreach to families were based on additional assessment of interventions needed for successful co-parenthood.  相似文献

ABSTRACT

Despite increasing societal acceptance of sexual-minority individuals, there are still gay, lesbian, and bisexual (GLB) adolescents who experience negative mental health outcomes. Minority stress theory posits that stigma-related stress associated with sexual-minority status drives increased risk among GLB individuals. Furthermore, recent evidence suggests that minority stress impacts emotion regulation (ER), identified as a particularly important risk factor for sexual-minority youth (SMY). Current research has identified some aspects of parenting contribute to GLB youth's mental health. We review the literature in these areas, and also integrate research from the broader developmental field on families and emotion socialization in order to identify the need for studies of parenting that go beyond existing data on parental acceptance and supportiveness of youth's sexual orientation. Limitations of the current literature and directions for future research are discussed, with specific focus on implications for interventions with SMY and their families.  相似文献

Adolescents' antisocial behavior and negative conflict management styles are each associated with adverse romantic relationship outcomes, yet little research exists on their associations. We investigated whether adolescents' antisocial behavior was associated with conflict management styles, and whether it predicted breakup 3 months later. In total, 91 adolescent couples (Mage = 16.43, SD = 0.99; 41.2% Hispanic/Latinx) participated in videotaped conflict discussions coded for negotiation, coercion, and avoidance. Actor–partner interdependence models suggest adolescents' antisocial behavior is associated with decreased use of negotiation (couple pattern) and increased use of coercion (actor pattern). No significant associations were found for avoidance. Neither antisocial behavior nor conflict management styles predicted breakup. Findings are discussed in light of the unique developmental importance of adolescents' romantic relationships.  相似文献
