Abstract

The present paper provides a framework for working with children and families where there are domestic violence and child protection concerns. A model of practice developed by the St George Domestic Violence Counselling Service and the St George Child and Adolescent Mental Health Service in the South East Sydney and Illawarra Health Service (NSW, Australia) is outlined. The present paper includes a discussion on a recently developed service agreement between the two services and a case study focusing on a ‘system of safety’ when working with children. The present paper focuses on the effects of domestic violence on women and children by male perpetrators. We do not ignore that men may be victims of domestic violence; however, the authors recognise the gendered nature of domestic violence and the significant number of women and children who experience and live with domestic violence.  相似文献

There is strong evidence for the link between domestic violence and child abuse. Agencies' policies regarding domestic violence and child protection are critical in determining the dimensions of practitioner intervention, including safety planning for women and children. This paper explores the issues identified in research around safety planning where there are domestic violence and child protection concerns which was conducted with practitioners in New South Wales (NSW), Australia, in 2001. In particular, the paper focuses on three of the factors that influence practitioner intervention with women and children. These are: definitional understandings of domestic violence and child abuse; child protection legislative changes, including mandatory reporting and domestic violence as a child‐at‐risk category; and the NSW child protection statutory authority's response to domestic violence. The interplay between these factors results in complexities of practice for practitioners as they attempt to maximize women's strengths and minimize risks to children's safety. The resultant inconsistent response to domestic violence and child protection by government and non‐ government agencies suggests the need for domestic violence interagency guidelines. In Ireland, little is known about mothers and infants where child welfare and protection concerns arise during the perinatal period. This study explores, for the first time, perinatal child protection. A retrospective audit was carried out of a large maternity hospital's medical social work, neonatal and psychiatric files for a five-year period from 2016 to 2020. The study identified 99 children, born to 86 mothers, who were either subject to a child protection conference; placed for adoption; discharged to someone other than the mother; or discharged home under supervision. The study found that two-thirds of the children were discharged to their mother's care. When compared to national data, the health indicators for this cohort of mothers and children painted a grim picture. The maternal profiles identified high prevalence of mental health and addiction difficulties and domestic violence. The study found evidence of supports provided to the mothers to enable them to care for their infants while they remained in the hospital and during an initial discharge from hospital. However, a significant number of the mothers were not caring for their children when viewed across a longer time frame. Dedicated multi-disciplinary clinics and improved data systems were identified as of importance.  相似文献

Over the last several years there has been increasing awareness of the connection between domestic violence and child abuse, yet only minimal attention has been paid to the implications of this for child protection practice. This article begins to address this gap. Drawing on research undertaken in New South Wales (NSW), Australia, it examines child protection practice in relation to children and young people who have been exposed to domestic violence. The research involved analysis of the responses of the statutory child protection authority in NSW (the Department of Community Services or DoCS) to abuse allegations involving domestic violence. The data are drawn from observation and analysis of the initial responses to referrals to DoCS and the ‘tracking’ of a sample of these referrals over an 18 month period. From the data obtained, it is evident that domestic violence referrals are treated less seriously than other referrals, with more being confirmed as abuse but fewer resulting in follow up or intervention. Abstract

The interface between the child protection and domestic violence sectors is often problematic, in that the two sectors operate relatively independently, with little integration. However, it is widely recognised that these sectors need to work more closely to enhance both women's and children's safety. This paper explores the processes needed for the child protection and domestic violence sectors to develop collaborative partnerships that lead to the provision of higher-quality responses to both women and children. Drawing on collaboration theory, a number of barriers to the development of successful partnerships are described, and applied to initiatives that seek to develop integrated approaches between child protection and domestic violence services. It is concluded that there is much scope for the two sectors to work closely together, but that the development of integrated responses involving both child protection and domestic violence services will take a significant commitment, level of determination, and stamina from both parties.  相似文献

Although the primary aim of child protection services (CPS) is to ensure the well-being and safety of children, policy decision-makers and service providers are increasingly concerned about the potential harm children encounter when they witness the abuse of their caregivers. Researchers who have conducted reviews of child protection files in both Canada and the United States report that few cases in which intimate partner violence (IPV) is substantiated are referred for additional services. In this article, we question whether this response is appropriate. Through examining the results of a qualitative study with sixty-four women who experienced IPV and were thus involved in the child protection system, we have been able to analyze the impact of CPS practices on those women who received services and those who did not. Our findings suggest that CPS can be an important resource for women who experience IPV, but changes to current practices are necessary to ensure that services offered are beneficial.  相似文献

Using case review at a shelter for battered women and their children, this exploratory study investigated the association between physical abuse, exposure to domestic violence and intergenerational occurrence of child sexual abuse. The charts of 570 children were reviewed in an attempt to explore the relationship between the children's experiences with sexual abuse and their nonoffending parent's own history of having been sexually abused. Results indicated that a significant percentage of nonoffending parents who reported a history of child sexual abuse also had children who were sexually abused. Additionally, we found that most (93%) of the children studied had been exposed to domestic violence, and while the base rate of sexual abuse was relatively low (11%), the rate of physical abuse of the children was substantial (41%). Logistic regression results indicated that children of sexually abused nonoffending parents may be at heightened risk for sexual abuse. Implications for treatment and intervention are discussed.  相似文献

Abstract

This paper reports on a study funded by the Criminology Research Council, Australia, which set out to investigate the intersection between the child protection and criminal justice systems and the extent to which children before the Melbourne Children's Court on child protection matters had a parent currently in prison, awaiting sentencing, or previously in prison. Magistrates identified 156 children as meeting these criteria during the study period June to December, 2006. Analysis of court records gathered quantitative and qualitative data about parents' offending, why the children had been brought to the attention of the court, and the health, welfare, and behavioural concerns the child protection service expressed about the children. There was no coordinated response by the child protection and justice systems to managing these children's situations. Early intervention and the development of child protection service protocols with the corrections system for children whose parents enter prison is essential, to better address the instability and disruption in care these children experience.  相似文献

This paper reports the findings of an exploratory and qualitative study of child welfare workers' practice in cases involving domestic violence. The research aimed to focus on child welfare workers' interventions with families experiencing domestic violence, elements influencing the child welfare workers' decisions, and the factors facilitating and creating obstacles for intervention. An analysis of the qualitative data showed that child welfare workers have different ways of intervening in cases involving domestic violence. Also, the interventions were especially centred on women victims of violence and they were held responsible for protecting their children. This article presents the findings of a small pilot study which examined the needs of 13 mothers with severe mental health problems whose children were involved in the child protection system. The use of the diagnosis of ‘personality disorder’ in relation to this group of women is discussed and the finding that all these women had experience of domestic violence is considered in the context of other research findings. The extent to which child protection social workers and mental health professionals worked together on these cases was explored and only limited evidence of good communication and collaboration was found. The need for effective inter‐professional and inter‐agency coordination is argued, but differing conceptions of maternal mental health problems and their relationship to children's needs may make for difficulties in professional communication and decision‐making. The article seeks to identify the differing approaches to maternal mental health problems which appear to be developing out of different groups of research studies and argues that practitioners need to be explicit in identifying their perspectives on the associated issues of maternal mental health problems and child protection. The literature indicates that witnessing domestic violence is harmful to children, that them is a high overlap between domestic violence and child abuse, and that safety is an important issue for separating women because separation from abusive partners is a particularly dangerous time for victims of domestic violence. Further, child custody is often a contentious issue in domestic violence cases. Child custody evaluations are typically used to assist courts in deciding custody when custody is disputed and when the best interests of the child are unclear. The concept of "best interests of the child" does not specify evaluation techniques or approaches, however, and while custody evaluation standards generally address the best interests of the child, they offer little guidance in high-risk situations such as parental domestic violence. In addition, there has been limited research focused on understanding the custody evaluation process or the degree to which practitioners differ in their procedures and reporting for cases with and without parental domestic violence. This study is one of the first to examine characteristics of disputed custody cases and their custody evaluation reports differences between domestic violence and non-domestic violence cases. This study selected a 60% random sample of cases with custody evaluations in Fiscal Year 1998 and 1999 (n = 82 cases). Out of the 82 cases, 56% (n = 46) met criteria for classification into the domestic violence group and 44% (n = 36) did not. In general, results indicated that although there were some important differences in court records between cases with and without domestic violence, there were only minor differences between custody evaluation reported process and recommendations for the two groups. Safety planning is a widespread intervention used with clients who have experienced domestic violence victimization. Although children are impacted by domestic violence, attention to the unique needs of children as they relate to domestic violence safety planning has received little attention to date. The authors conducted nine focus groups with domestic violence service providers about their perceptions of child safety planning. This article reports on the findings and implications of this focus group study that can inform the safety planning needs of children impacted by domestic violence. The themes discussed include Child Protective Services, the needs of older boys, school-related issues, custody-related issues, the extent to which children should be involved in safety planning, parenting issues, tools and tips for safety planning with children, and resources and services to promote children's safety.  相似文献

The challenges that arise in respect of child abuse reports made in the context of domestic violence and/or acrimonious separation have been the subject of recent academic discussion. This paper adds a service user perspective to the debate and reports on the findings from a study conducted in the Republic of Ireland. In addition to the previously established evidence about such cases, it demonstrates the level of powerlessness and frustration experienced by families who found it difficult to have their needs heard or met. It also illustrates the very detrimental emotional impact on children and parents who frequently encountered indifference as well as insensitive and gendered responses from child protection staff. The findings indicate that mainstream statutory child protection services do not have the capacity to deal with these complex cases, and advocates the adoption of alternative approaches. Importantly, the study demonstrates the necessity to pay attention to the views of service users in developing an appropriate response.  相似文献

Historically, women in India have been experiencing domestic violence in various forms throughout their lives, irrespective of caste, class, religion, and region. The objective of this study is to gain a deep and thorough understanding of the causes and concerns relating to domestic violence in rural Indian sociocultural context. It also tries to understand the type of support the female partners get while coping with intimate partner violence through phenomenological principles. The purposive sample consisted of 15 rural Indian women. The results showed four main themes: (1) causes of domestic violence, (2) impact on health, (3) support received, and (4) dilemma of abused women. During the study the women came up with various causes leading to domestic violence that affected their physical and mental health. They also narrated the limited support they received in terms of protection from their family and/or neighbors, highlighting their dilemma and helplessness in the rural Indian cultural context. This study also attempts to show some insights on what Hindu religion says about women.  相似文献

This article explores the role of a case-reading tool, developed by the Safe and Together Institute, deployed across five Australian states, and which engaged workers from child protection (CP) and specialist domestic and family violence (DFV) services. It aimed to assess the extent to which DFV is identified in CP case files and to assess the quality of case practice from a DFV-informed perspective, as documented in the case file. The Safe and Together approach to child welfare provides a robust foundation upon which practitioners from statutory and nonstatutory backgrounds can work collaboratively and reach consensus about how best to ensure the safety and wellbeing of children living with DFV. The case reading is both a process of transformative working for practitioners and an analytical tool through which their agencies can affect systemic change.

IMPLICATIONS

  • A national audit of 20 child protection case files using the Safe and Together case-reading process indicated that documented child protection practice sits at the lower end of a domestic and family violence-informed Continuum of Practice.

  • Analysis indicates a need to improve: child protection engagement with fathers who use DFV, assessments of their parenting role and its impact on children and family functioning; identification of adult survivors’ protective capacities and their impact on children.

  • Research in this area may have broader implications for other professions and government policy both nationally and internationally.

Safety First     
Abstract

A substantial percentage of contested child custody cases involve allegations of domestic violence. The impact on the psychological health and physical safety of the child exposed to domestic violence has only recently become a focus of the courts' and child custody evalu-ators' attention. Currently, the majority of state statutes include consideration of domestic violence in “best interests” child custody criteria. However, many of the statues do not provide the child custody evaluator the specific criteria to consider, especially if the domestic violence allegations have not been previously reported to authorities prior to the commencement of separation and divorce proceedings. This article presents the first three steps of the six-step Safety First Model, designed to assist the legal and psychological professions to focus on the priorities on the safety of children exposed to domestic violence.  相似文献

The primary purpose of this study is to determine whether child protective services investigators apply a recognizable set of criteria to substantiate batterers and victims of battering for exposing their children to domestic violence. Although domestic violence occurred in 35% of the 1,248 substantiated incidents of child maltreatment, only 31 (7.1%) couples were investigated for exposing a child to domestic violence or failing to protect a child from domestic violence. All of the batterers investigated and in the caregiver role when their children were exposed to domestic violence were substantiated. The unsubstantiated victims of battering tended to use more protective behaviors (M=3.82) than the substantiated victims (M=2.00); yet, at the case level, using more than one protective behavior did not seem to be a criterion used to substantiate the victims. Instead, it appears that investigators were discriminating between those protective behaviors by the victims that ended contact between the batterers and the children--for a substantial amount of time--and those that did not in both the substantiation and removal decision. Key issues related to applying criteria in incidents involving domestic violence are discussed along with recommendations to further refine and document them.  相似文献

There is emerging evidence to suggest that children who come to the attention of child protective authorities are more likely to experience out-of-home placement if their families are affected by domestic violence than other reasons for investigation. To develop a better understanding of child welfare-involved families that are exposed to domestic violence, this article provides a comprehensive review of research examining the effects of domestic violence on the likelihood of out-of-home placement and family reunification. A search of the literature resulted in 16 articles that met the study's criteria. Data suggested that domestic violence may be negatively related to out-of-home placement depending on the sample type, and marginally related to family reunification. Recommendations and implications related to future research are presented.  相似文献

The authors examined threatened and attempted suicide among partner-violent male respondents in a family court domestic violence intervention court based on the reports of 101 women petitioning the court for orders of protection. Suicidal behavior was prevalent; 45.5% of respondents had a history of threatened suicide and 12.9% had a history of suicide attempts. Most recent threats were clustered in the previous 6 months (70.5%) with one-fourth occurring within a week of the petition, potentially indicating a desperate response to a deteriorating relationship. Attempts were not clustered in recent months. Men with a history of threatened or attempted suicide were shown to have been more violent at the index offense and greater domestic violence severity overall, potentially indicating a subsample of more severely partner-violent men also at particularly heightened risk for suicide. The study of suicidal behavior in partner-violent men may inform the prevention of suicide and severe domestic violence.  相似文献

Abstract

Over the past 20 years there has been increasing understanding of the gendered nature of homelessness in Australia. Most significantly, this gendering has occurred through the acknowledgement of the links between domestic violence and homelessness and this has played out in Australian social policy through the funding of specialist domestic violence services. However, not all women are assisted by these specialist services—either because they are not homeless due to domestic violence, or because they fall through the gaps in the service system. Homelessness exposes these women to heightened vulnerability to violence. This article considers homeless women's experiences of violence and their implications for homelessness policy. Framed by Australian and Victorian social policy and drawing on a qualitative study of 29 women, all of whom had experienced violence during homelessness, the article argues that greater policy attention needs to be paid to ensuring homeless women's safety.  相似文献
