The best-interest-of-the-child standard for child custody policy and decisions has benefits and hazards, the latter related to the exercise of judicial discretion in custody disputes. This article examines alternatives to the status quo, including the primary parent presumption, the approximation rule, shared parenting, an exact even split of custodial time, sole custody for couples labeled as in high conflict or those with young children, the friendly parent presumption, and decisions that defer to children’s stated preferences. Each alternative promises simpler paths to securing children’s welfare, but some have more support than others in the social science literature.  相似文献

One of the most complex and compelling issues confronting policymakers, parents, and professionals involved in making custody decisions is this: What type of parenting plan is most beneficial for the children after their parents separate? More specifically, are the outcomes any better or worse for children who live with each parent at least 35% of the time compared to children who live primarily with their mother and spend less than 35% of the time living with their father? This article addresses this question by summarizing the 40 studies that have compared children in these two types of families during the past 25 years. Overall the children in shared parenting families had better outcomes on measures of emotional, behavioral, and psychological well-being, as well as better physical health and better relationships with their fathers and their mothers, benefits that remained even when there were high levels of conflict between their parents.  相似文献

ABSTRACT

The current study presents the findings of an evaluation of Arizona’s 2013 revisions to the child custody statutes that directed courts to “maximize” the child’s parenting time with both parents. A state-wide survey of the four family law professions (i.e., conciliation court staff, judges, mental health providers, and attorneys) assessed their perceptions of the law 4 years after implementation. We averaged the ratings across the four professions to obtain a comprehensive perspective that gave equal weight to each profession. Results revealed that the law functions as a rebuttable presumption of equal parenting time; that it is evaluated positively overall and in terms of children’s best interests; that it is has a neutral impact on legal and interparental conflict; and that it has led to small increases in allegations of domestic violence, child abuse, and substance abuse.  相似文献

Excluding very severe child abuse cases, biological parents are usually encouraged to maintain contact with their children in care. Parent‐child contact is often considered important because it can maintain the child's psychological identity and well‐being. It can also maintain parent‐child attachment and in some cases facilitate reunification. Improving parenting skills is viewed as an important method by which contact between children and their biological parents can be enhanced. However, mainstream parenting groups are often unsuitable for parents whose children are in care for a number of reasons. There is stigma involved with having children in care, such parents have very complex lives and there are reduced opportunities to practise skills learnt with their children. Groups designed specifically for parents whose children are in care appear to be a promising approach to improving the quality of contact between these parents and their children. This paper will review group‐based approaches to working with biological parents whose pre‐school‐aged children have been placed in care. The paper will also report the findings of a research project designed to identify key facilitators and barriers to parental involvement in a group‐based programme which includes contact between parents and their children who have been placed in care. Parents of deaf children with a cochlear implant (CI) report feeling pressure to adhere to a very prescribed conceptualisation of ‘good parenting’, and in some cases report feeling judged or blamed, for example, if the child's progress post-CI is slower than expected. Previous investigations of the discourses of parenting science suggest that, while parent blame is rarely expressed explicitly, that normative, moral assumptions about how ‘good parents of a disabled child’ should feel, think and act are embedded within prevalent concepts and terminology. A disproportionate focus on evaluating individual parents' personal characteristics at the expense of more external, socially located issues has also been noted. Existing critiques, together with the author's lived experience provide the impetus for this study; in which corpus linguistics methods have been used to document the types of parents and parenting attributes constructed in a 420,982 corpus of research articles. The results indicate the prevalence of many highly evaluative parenting noun-collocates within the field; successful adaptation, a positive appraisal of the situation, realistic expectations, rational decisions, high involvement and full-time use of the CI are conflated with good parenting, whilst parents who present in alternate ways are construed as problematic. Drawing on research conducted in Australia and the United Kingdom, this paper explores how parenting and care provision is entangled with, and thus produced through, consumption in hospitality venues. We examine how the socio‐material practices of hospitality provision shape the enactment of parenting, alongside the way child‐parent/consumer‐provider interactions impact upon experiences of hospitality spaces. We argue that venues provide contexts for care provision, acting as spaces of sociality, informing children's socialization and offering temporary relief from the work of parenting. However, the data also highlight various practices of exclusion and multiple forms of emotional and physical labour required from care‐providers. The data illustrate children's ability to exercise power and the ways in which parents’/carers’ experiences of hospitality spaces are shaped by their enactment of discourses of ‘good parenting’. Finally, we consider parents’/carers’ coping behaviours as they manage social and psychological risks associated with consumption in such public spaces of leisure.  相似文献

This research contributes to the literature on work-related factors for parents raising a child with a disability. Specifically, we used questionnaire methodology to compare two parent families raising a child with Autism Spectrum (AS) with similar families raising ‘typical’ children. Our findings suggested that parents raising a child with AS self-report higher parenting stress and more mental health symptomatology, as well as lower overall job satisfaction, less satisfaction with supervisors and less workplace contentment. In addition, our findings suggested that parents raising a child with a disability self-report similarly to parents raising ‘typical’ children with respect to work interest, commitment and quality, as well as time missed. In conclusion, our results appear to suggested that despite increased parental stress related to parenting a child with AS, with respect to several work-related factors, there are more similarities than differences among these parenting groups.  相似文献

Abstract

Within a child custody context, this article systematically reviewed the available qualitative research of post separation, high conflict, co-parenting relationships. Separated parents’ experiences of high conflict were reportedly embedded in pervasive mistrust and disdain, and underpinned by concerns over differing parenting styles, or the other parent’s ability to adequately care for the child. The factors that potentially maintained conflict were parental concerns regarding the child’s safety and well-being when in the care of the other parent. The factor that potentially escalated conflict was disdain directed at the other parent’s concerns. Recommendations for future research and implications for social policy for these families are discussed.  相似文献

Almost half of first marriages end in divorce, which in turn may produce joint physical custody arrangements. Seen by many states to be in the best interest of the child, joint physical custody is increasingly common. Yet much is unknown about its consequences for children. This article considers how joint physical custody arrangements affect children’s neighborhood friendships, an important component of child well-being because of their contributions to social and cognitive development. Thirteen parents and 17 children (aged 5–11) in 10 families, selected via convenience and snowball sampling, participated in semistructured interviews. The findings suggest that joint physical custody arrangements do not imperil children’s neighborhood friendships; indeed, most children and parents interviewed voiced contentment in this area.  相似文献

ABSTRACT

The introduction of the “best interests of the child” standard as a legal presumption in family law in the 1970s signaled an important transition away from a maternal preference standard in child custody disputes, toward a recognition of the centrality and importance of both parents in the lives of children after parental separation. Paradoxically, this reform resulted in an increase rather than decrease in court-determined maternal sole custody. Despite robust empirical evidence in support of shared parenting, a gender convergence in child care roles, and increasing public support for shared parenting, the idea of shared parenting as a legal presumption has been met with skepticism and resistance among some legal and mental health professionals. This article traces the evolution of arguments against shared parenting since the concept was first introduced, from the early 1970s until the present day.  相似文献

Abstract

In this process-oriented article, the authors weave short personal narratives with theoretical reflections to examine the relationship between Disability Studies scholarship and parenting children with disabilities. The authors present three findings: first, their position as parent-teacher-scholars informs their work in Disability Studies. Second, the work of Disability Studies scholars has the potential to positively influence parents’ understandings of disability; consequently, Disability Studies-informed parenting can influence parent advocacy for their children. Third, parent-scholars have the potential to create research that can positively impact parents, practitioners, and the field of Disability Studies. The authors conclude by arguing that there is a need for Disability Studies scholarship for and by parents. This work is significant because it challenges divisions between theory and practice, and articulates a need and responsibility for parents to grapple with alternative understandings of disability and alternative (collective) ways to create better social conditions for their children.  相似文献

Nonmarital children account for two fifths of births in the US, and close to two thirds of these children do not live with their fathers by age five. Although nonmarital children primarily live with their mothers, joint legal custody has emerged as an option for their parents. Parents with joint legal custody are expected to make major decisions for their child together, regardless of their prior marital status. This study investigates whether joint legal custody increases child support payments in the first year of a child support order among fathers of nonmarital children who live with their mothers, using a unique sample of court records in 2000–2009 in Wisconsin. It finds consistent and statistically significant positive associations across different methods; joint legal custody is associated with higher child support payments by about $170 a year and a higher compliance ratio by 5 percentage points. Paying child support is only one way nonresident parents can contribute to their children. Therefore, more studies are needed to understand whether and how joint legal custody affects other aspects of parenting and conditions under which it should be encouraged.  相似文献

Understanding social aspects of parental well-being is vital because parents' welfare has implications not only for the parents themselves but also for child development, fertility, and the overall health of a society. This article provides a critical review of scholarship on parenthood and well-being in advanced economies published from 2010 to 2019. It focuses on the role of social, economic, cultural, and institutional contexts of parenting in influencing adult well-being. The authors identify major themes, achievements, and challenges and organize the review around the demands-rewards perspective and two other theoretical frameworks: the stress process model and the life course perspective. The analysis shows that rising economic insecurities and inequalities and a diffusion of intensive parenting ideology were major social contexts of parenting in the 2010s. Scholarship linking parenting contexts and parental well-being illuminated how stressors related to providing and caring for children could unjustly burden some parents, especially mothers, those with fewer socioeconomic resources, and those with marginalized statuses. In that vein, researchers continued to emphasize how stressors diverged by parents' socioeconomic status, gender, and partnership status, with new attention to strains experienced by racial/ethnic minority, immigrant, and sexual minority parents. Scholars' comparisons of parents' positions in various countries expanded, enhancing knowledge regarding specific policy supports that allow parents to thrive. Articulating future research within a stress process model framework, the authors show vibrant theoretical pathways, including conceptualizing potential parental social supports at multiple levels, attending to the intersection of multiple social locations of parents, and renewing attention to local contextual factors and parenting life stages.  相似文献

The decade of the 1990s will probably contain more challenges to the role of the mental health practitioner in child custody cases than ever before in history. Because of increasing social stress and family disintegration, custody disputes are destined to become more frequent, bitter, and traumatic for all parties. Mental health professionals, in particular, need to develop a coherent structure regarding their own participation in this process. Issues of moral changes among our leadership and our citizenry are examined and guidelines for the behavior of the mental health practitioner in the courtroom are formulated and illustrated as they pertain to custody decisions. Parlicular attention is paid to custody decisions as an a11 rather than a science, the role of empirical research, the need to anticipate certain unintended circumstances, the need for the application of mental health principles on an individual case-by-case basis, the nature of the mental health professional’s expertise, and the problems with the concepts of “parental unfitness” and the use of psychiatric diagnosis as a way of defining such alleged unfitness.  相似文献

ABSTRACT

This article summarizes panel discussions that took place at an international conference on shared parenting (SP) held in May 2017. The panelists were internationally recognized experts on the legal and psychological implications of custody arrangements and parenting plans. Seven broad themes dominated the discussions: whether or not there was persuasive evidence that SP provides real benefits to children whose parents separate; what specific factors make SP beneficial; what symbolic value SP might have; whether there should be a legal presumption in favor of SP, and if so, what factors should make for exceptions; whether high parental conflict, parents’ failure to agree on the parenting plan, or dynamics of parental alienation should preclude SP; and what should happen when a parent wants to relocate away from the other parent.  相似文献

Noncustodial fathers are men whose parental rights and obligations have been altered through judicial action, usually accompanying marital separation and divorce. In the majority of divorces, physical and legal custody of children is taken from fathers and reassigned to mothers only. Despite the curtailment of their decision-making authority and despite the limitations imposed on their day-to-day presence in their children’s lives, in the majority of divorces fathers retain the duty to provide economic support for their minor children. The bulk of quantitative research on the post-divorce involvement of men as noncustodial fathers is structured by explora- tion of the interrelationships among these parameters: child custody awards, visitation privileges and performance, child support awards and compliance, and child well-being. The documentation of important linkages between child support compliance and child outcome have focused both social science and legislative attention on means to foster greater paternal acceptance of responsibility for children. Research using open-ended interviews and smaller surveys of limited samples have been of great importance in providing a richer understanding of the noncustodial father-child relationship. To retain(or for some, to build for the first time) a meaningful paternal relationship, men are challenged to find new ways to confront issues of autonomy, connectedness and power. However, societal supports for moving beyond the traditional polarization of genders and roles through which families have been organized are sorely lacking. The ways in which men respond to the changes precipitated by divorce are influenced by a number of factors related to their own self-definition as well as to the broader social context in which they operate. In order to design psychoeducational or therapeutic interventions that allow noncustodial fathers to adapt in ways that are beneficial to themselves and ultimately to their children, an awareness of these factors is imperative.  相似文献

One of the most complex and compelling issues confronting policymakers, parents, and the family court system is what type of parenting plan is most beneficial for children after their parents' divorce. How much time should children live with each parent? An increasing number of children are living with each parent at least 35% of the time in shared residential parenting families: How are these children and their parents faring? In what ways, if any, do divorced parents who share the residential parenting differ from parents whose children live almost exclusively with their mother? Families affected by substance abuse are at an increased risk of child welfare involvement and poor child welfare outcomes. One strategy to improve outcomes among these families is evidence-based parenting interventions. While these interventions show the potential for advancing the child welfare field, they have not been widely and rigorously evaluated with birth parents, especially those affected by substance abuse, who face marked vulnerability and marginalization. We sought to draw on parents’ expertise and to understand their first and changing impressions throughout involvement in a parenting intervention, as well as overall impressions at program completion. Semi-structured interviews were conducted with a purposive sample of 10 parents who were involved in child welfare and a family drug treatment court. All parents were affected by parental substance use and had recently completed the Strengthening Families Program. Interviews were transcribed verbatim and analyzed for prominent themes. The study’s findings showed that parents described four key themes that influenced their perspectives of the parenting intervention: program reputation as communicated by peers, relevance and applicability of the program, children’s involvement and enjoyment of the program, and program structure issues that pointed to the need for high-quality group facilitation. SUMMARY

While myths exist that call into question the parenting ability of gay and lesbian parents as well as the impact of such parenting on children in their care, there is an ever increasing body of literature that clearly demonstrates the capabilities of these parents with their birth children. However, there continues to be a dearth of research on gay and lesbian adoptive parents and their children. To address this deficiency in the literature, this article explores the parenting styles of gay and lesbian adoptive parents and strengths of their children between the ages of 5–9 years (N = 94), using scores from the Parent-as-a-Teacher Inventory and the Behavioral and Emotional Rating Scale. Results illustrate that the gay and lesbian adoptive parents in this sample fell into the desirable range of the parenting scale and their children have strength levels equal to or exceeding the scale norms. Finally, various aspects of parenting style significantly predicted the adoptive parents' view of their child's level of care difficulty which subsequently predicted the type and level of strengths assessed within their adopted child. Recommendations for practice, policy and future research are highlighted.  相似文献

Abstract

Research has shown that the congruence of parenting styles with cultural values, rather than parenting styles alone, impacts child adjustment. This study examined if parents’ cultural values moderate the relationships between parenting styles and child outcomes across both an individualist culture (Australia) and a collectivist culture (Indonesia). Three hundred and eighty-seven parents of 2–10-year-old children from both countries reported their parenting styles, the importance of the collectivistic values (security, conformity, and tradition), and their child's emotion regulation and behavioral problems. In both countries, authoritative parenting was associated with higher child emotion regulation and lower levels of behavioral problems, and authoritarian parenting was associated with lower child emotion regulation and higher levels of behavioral problems. Although cultural values did not moderate the relationship between authoritarian parenting and child adjustment, in both countries greater importance placed on tradition attenuated the positive effect of authoritative parenting on child outcomes.  相似文献
