Ben-David (this issue) introduced us to the complexity of the factors that courts consider in termination of parental rights (TPR). It is an opening to understanding which factors are taken into consideration and how courts make these challenging determinations. Yet there are other questions that must be asked before we truly understand the TPR decisions made by courts across a variety of legal jurisdictions. This commentary argues that we must take the inquiry deeper, asking questions that will unpack the complexity assisting researchers and clinicians. Thus, we will want to know how courts weigh such important issues as the credibility of the evidence. What is it about such factors as parental competence, failure of remediation, and other issues identified by Ben-David that cause courts to determine TPR is the best choice? Consideration is given to how Ben-David’s work might be extended using a Canadian perspective.  相似文献

A court decision to terminate parental rights and declare a child eligible for adoption (TPR) has far-reaching consequences. However, little is known about the legal decision-making process involved. This study aims to fill this gap and identify the main considerations taken into account by the courts in TPR cases. After analyzing the contents of 261 court decisions, the study found differences between decisions in favor or against TPR based on the characteristics of the child–parent relationship, the parents and the child. Predictors of TPR decisions were also identified. The study discusses the findings and their implications for social work and legal practices and suggests directions for future research.  相似文献

Termination of parental rights (TPR) is one of the most important decisions made by the legal system. Due to the importance of the TPR legal process, it is essential to understand the risk and protective factors that influence TPR decisions and under which conditions these factors are most influential. This commentary begins with a brief review of the literature regarding TPR. Subsequently, the Ben-David article is reviewed, highlighting the strengths and challenges that emerge from the study. Future directions are then discussed, with a focus on several recent articles that should guide researchers in the TPR field. Finally, clinical implications for social service providers and agencies are explored, with particular attention to how the TPR literature can guide best practices in clinical work.  相似文献

There has been much research on the influence of parental divorce on children, but less is known about whether and how a later-life parental divorce influences the lives of adult children. Through qualitative interviews with 40 adult children of divorce—those whose parents divorced after they were 18 years of age—adult sibling relationships were explored to determine if a mid- to late-life parental divorce affects the adult sibling relationship. The majority of participants reported that their sibling relationships were not negatively affected by the parental divorce; however, a minority of participants noted that their adult sibling relationships were negatively affected, especially if they “took sides” during the parental divorce.  相似文献

There is a dearth of research on whether and how a later-life parental divorce influences the lives of adult children. Through qualitative interviews with 40 adult children of divorce (ACD)—those whose parents divorced after they were 18 years of age—ACD were asked to discuss their experience of the parental divorce. There were commonalities experienced by the ACD. However, only half of the ACD were initially affected negatively by their parents’ divorce, whereas the other half did not have a tough time initially. Factors including being “put in the middle,” along with strained parent–child relationships, were found to have the potential to affect one’s experience.  相似文献

Two hundred and fifty-seven undergraduate psychology students in Chieti, Italy completed an anonymous and confidential survey regarding their childhood exposure to parental alienation, psychological maltreatment, and measures of current functioning. Results revealed high levels of reported exposure to parental alienation behaviors by those whose parents divorced or separated and by those who reported that—regardless of marital status—their parents’ relationship was “very bad.” Those with any exposure to parental alienation reported higher rates of parental psychological maltreatment, lower rates of parental caring, as well as poor functioning with respect to self-esteem, depression, adult attachment styles, alcohol abuse, self-direction, and cooperation. These findings support the theory that parental alienation represents a risk factor for compromised outcomes across the life span.  相似文献

Parental substance abuse significantly increases the risk of child maltreatment and loss of custody. If parental capacity due to substance abuse cannot be rehabilitated within a limited time period and if the child cannot be safely returned to his/her home, the state, in various jurisdictions, is empowered to initiate termination of parental rights proceedings. Despite the connection between substance abuse and termination of parental rights, the research literature in this area is limited. Based on a sample of 212 rulings in favor of termination of parental rights by Israeli courts, the present study examines factors that differentiate substance-abusing from non-substance-abusing parents. The findings indicate that substance-abusing parents constitute a unique high-risk group among parents whose parental rights were terminated. This group is characterized by a higher cumulative risk that includes mental health issues with an emphasis on personality disorders and emotional problems, criminal records, child neglect and maternal single parenthood. All these factors, as well as the overall number of risk factors in a particular case, were found to predict substance-abusing parenthood. A discussion of the findings and their implications for social work practice with families involved in the child welfare system follows.  相似文献

In the United States, the divorce rate is 40% to 50%, according to National Marriage and Divorce Rate Trends (Centers for Disease Control and Prevention, 2015). Gaining an understanding of the lived experience of parental estrangement for a child during the parental divorce was the goal of this study. For the 9 adult participants who experienced parental estrangement as children, each reported themes including anger, disappointment, isolation, control, and impact. In this study, the predominantly alienating parent was the custodial parent. The results indicated that it did not matter if the noncustodial parent lived down the street or several states away; the estrangement that developed was the same for each of them.  相似文献

Online discourse about parenting has grown with the expansion of social media technologies. With a community of “dad bloggers” developing in North America, further investigation into how men write about fatherhood on the Internet is needed. In this article, I present a qualitative analysis of 201 blog posts written by 40 dad bloggers. Adopting a social psychological perspective, I examine how fatherhood is constructed across lines of identity, experience, and ideology. My findings illustrate how dad bloggers reinforce and reshape family discourses in their writing about parental role models, becoming a father, work–family balance, generativity, and “good” and “bad” dads. Social media use is discussed as a part of fathering in everyday life and as a tool to display, promote, and normalize involved fatherhood.  相似文献

The emergence of parental leave schemes has been the most important area of expansion for the Norwegian welfare state in the 1990s. Schemes have been extended, and special rights have been granted to fathers. The main underpinning of this strategy is the intention to bolster the fathers’ contact with and care for their children. Another objective is to share the benefits and burdens of working life and family life between men and women. In this article we analyse how fathers construct different fatherhood practices through negotiations in relation to the leave schemes and different working conditions.  相似文献

ABSTRACT

This article presents the results of an analysis of 7 young women's life story accounts of the experience of parental separation during adolescence. The young women took part in the Life Stories and Family Transitions Study conducted in New Zealand. The qualitative methodology used in this study allowed for an investigation of the ways that participants made sense of their experiences of parental separation within the life story. The narratives of parental separation were extracted from the interviews and analyzed for form and content. The analysis of form found that the stories progressed through a number of stages, titled “The Early Years,” “The Deteriorating Parental Relationship,” “The Climax,” and “The Aftermath.” A number of themes emerged from a process of interpretive thematic analysis. These themes were often associated with different stages of the story of separation, and were titled “Putting Together the Pieces,” “The Struggling Self,” and “Self-Determination and Competency.” As participants put together the stories of separation, they considered their parents' perspectives and integrated these with their own experiences of family events, developing their own personal theories. The stories of struggle, and of personal strength and self-determination, emerge from the analysis.  相似文献

Abstract

Romantic relational aggression is related to numerous mental health consequences but risk and protective factors of perpetrating this type of aggression, historically, have been unclear. This study fills in the research gap by evaluating the impact of parental control, parental care, and peer social support on later perpetration in romantic relational aggression among 84 predominately Chinese college students. Results revealed the positive association between parental control and perpetration in romantic relational aggression, however, this association diminished in the presence of high peer social support (HSS). Despite insignificance in the main effect, parental care was negatively correlated with later perpetration in romantic relationship in the HSS group while a positive association was found in the low peer social support (LSS) group. These highlights provided evidences how parental control and parental care during childhood could be risk factors for later romantic relational aggression as well as how current social support from peer could serve as a protective factor on the negative influence from parent–child relationships.  相似文献

ABSTRACT

Historically, federal and state legislation placed different conditions on same- and opposite-sex couples' ability to marry, adopt, or exercise their parental rights. Given the historical intertwining of marriage and parenting, legal issues remain hinged on differing conceptions of marriage and what constitutes a legal family in the United States, especially for same-sex partners compared to their different-sexed couple counterparts. This article provides a historical review of decisions that serve as the foundation for queer parenting rights in the United States. A key focus is on the impact of the U.S. Supreme Court Obergefell v. Hodges (2015) marriage decision on queer parenting and its relevance to researchers and practitioners whose work involves queer families. State discrepancies continue to exist for the treatment of parental rights in spite of the legalization of same-sex marriage. Finally, suggestions are provided for future directions for the field.  相似文献

ABSTRACT

This study investigated the relationship between parental involvement and their children being picked on or bullied and being discriminated against based on their race during their elementary and secondary school years. The influence of parental involvement on academic achievement during that period was also examined. Specific aspects of parental involvement and an overall parental involvement variable were examined. Two different samples were examined. The first sample was made up of 139 college students, and the second sample consisted of 102 seventh to 12th grade students. Analysis of variance and logistic regression analysis were used. The results indicated that higher levels of parental involvement were associated with higher academic achievement among their children. However, the remainder of the analyses showed mixed results with the effects of parental involvement emerging as more robust with the college sample than for the 7th to 12th grade sample. Overall, it does appear that parental involvement is somewhat related to a lower incidence of children being picked on and discriminated against. The significance of these results is discussed.  相似文献

Abstract

Using an academic letter format, I use a blended-method-ological approach of personal ethnography and qualitative case study to assess the three-partner, gay male relationship and the role of parental support. In working to understand better the relational “We 3,” I first provide an account of my relational experience with two other men. I discuss the process of our coming together and then make a methodological turn to provide insights from both e-mail and face-to-face interviews with one set of parents who have supported their gay son in his three-partner relationship. As I, personally, have not had an in-depth conversation with my own parents regarding this issue, I use the parental case study to bridge an academic conversation regarding the negotiation of what might be termed a second or relational coming out process with parents. Finally, I discuss how insights from the first, personal coming out process provided the parents with tools to keep the conversation going and to support their son's relational coming out as a “We 3.”  相似文献

This 2‐part study uses national longitudinal interview data from parents and their adult children to examine the way in which predivorce marital conflict influences the impact of divorce on children. In the 1st study, we find that the dissolution of low‐conflict marriages appears to have negative effects on offspring's lives, whereas the dissolution of high‐conflict marriages appears to have beneficial effects. The dissolution of low‐conflict marriages is associated with the quality of children's intimate relationships, social support from friends and relatives, and general psychological well‐being. The 2nd study considers how parents in low‐conflict marriages that end in divorce differ from other parents before divorce. We find that low‐conflict parents who divorce are less integrated into the community, have fewer impediments to divorce, have more favorable attitudes toward divorce, are more predisposed to engage in risky behavior, and are less likely to have experienced a parental divorce.  相似文献

Teen Dating Violence (TDV) is a public health issue that has long lasting implications into adulthood. Making matters more precarious is the scant evidenced-based information available to parents to help them respond to teens' reports of TDV exposure. This study examined parental and youth perceptions of the helpfulness and likelihood of use of suggested parental responses to dating violence. Results indicated that parents' potential supportive comments about “rights” and “whose fault” were viewed as the most helpful and likely to be used. The least approved statements were connected to parents' threatening punishment. The most endorsed comments provide information without undermining the teens' self-esteem and offer insight about how parents can promote more helpful dialogs about teens' experiences with dating violence.  相似文献

This study investigates the effect of childbearing on parental involvement in stepfamilies and intact families, based on the reports of 1,905 stepparents and biological parents from the National Survey of Families and Households. Regression analysis indicates that involvement with children declines over time, especially among respondents with only stepchildren in the household. Respondents who have had a child between waves of the survey reduce parental involvement at a slower rate than respondents who did not have a child. These effects are explained by the children's age. The birth of a child has a similar effect on parental involvement in stepfamilies and intact families. These findings suggest that the addition of a half‐sibling is not particularly beneficial to stepchildren and provides further evidence that couples with children from prior relationships should not make the decision to reproduce to “cement” stepfamily bonds.  相似文献

This study focused on the internal dynamics of family members who experience divorce and interparental conflict. Interparental conflict and triangulating children increase the likelihood of alienating children from a parent. Narrative interviews with members of three families were used to explore meaning structures. Results showed how parents and children thought, felt, and created meaning about their experiences; how family members responded to conflict and behaviors associated with parental alienation; and how they viewed family relationships. Metalevel findings suggested each family member held dichotomous views and used cognitive and behavioral control response strategies. Thus, parental alienation stems from a relational dynamic and needs to be addressed from a family systems perspective.  相似文献

This grounded theory study explored parents' experiences of responding to their children's need for understanding parental mental health concerns. Fifteen parents with severe and enduring mental health difficulties participated in the study. The findings suggest four main social processes that influence parents' talk with their children about parental mental health issues, namely “Protecting and being protected,” “Responding to children's search for understanding,” “Prioritizing family life,” and “Relating to others.” Implications of the findings for clinical practice and future research are considered. In particular, the need for more family‐orientated services where parents experience parental mental health problems is highlighted.  相似文献
