Policies restricting the employment opportunities of women have a long history in the U.S. The most recent manifestation has been so-called "fetal protection" policies, which exclude women of childbearing age from jobs involving exposure to toxins considered dangerous to a developing fetus. Traditional arguments that women's biology is justification to keep them from jobs have resurfaced in a new form. In the present debate the issue is framed as one of competing rights, those of fetus versus those of the woman. An analysis of public policy on this issue from a feminist legal standpoint reveals how the law's implicit male standard hinders the attainment of equal employment opportunity for women, as they must now compete with hypothetical fetuses sa well sa with men. 相似文献

This article argues that the novel Disgrace points toward a politics of illegiblity and opacity that aligns more readily with anti-identitarian queer theory instead of rights- and recognition-based human rights discourses. Through an extended consideration of the relation between national allegory, history, and legibility, I argue that the novel sustains two interpretations of the category of lesbian—first, the national allegorical reading that erases her rights of lesbian desire in the transmission of racialized and sexual historical debts and second, Lucy's refusal of legibility as a lesbian in the national narrative and legal structures. 相似文献

This paper divides the move for women's rights in the U.S. into three historical phases: (1) the early women's rights movement (1848-1875); (2) the suffrage movement (1890-1920); and, (3) the two branches of contemporary women's rights movements. The authors then set out a hypothesis for the formation of the above women's rights movements. The causes of the three respective phases then are examined and the hypothesis tested. We conclude that the following elements are necessary to the initiation of a U.S. women's protest movement: (1) a sense of collective oppresion; (2) an extant organizational base; (3) a communications network; and, (4) a critical mobilizing event. The success of these movements, however, may be tempered by the simultaneous development of opposition organizations. 相似文献

An analysis of ideology in the United States reveals a major barrier to political and economic equality, where previously excluded groups are found to be characteristically different from historical and current participants in the area of political or economic access. This analysis is used to describe why sociobiological research threatens U.S. women's rights advocates (reform feminists) pursuing equality with men. It is argued, however, that by providing a contrast to the dominant ideological assumptions about human nature, and by providing supporting arguments for some reform feminist proposals, sociobiology merits the attention of reform feminists. 相似文献

In this essay, I provide some complementary perspectives on certain themes that emerge in Judith Blau's (2016) timely and insightful article, “Human Rights: What the United States Might Learn from the Rest of the World and, Yes, from American Sociology.” In response, I offer some very brief reflections structured through two prisms by which we might think further about the United States and human rights. These perspectives pick up on the core issue of Blau's article, the U.S. rejection of socioeconomic rights, and how this issue in turn relates first to the “social identity” of the United States as a whole, and second to the role of the political economy in states' recognition of human rights. 相似文献

Cet article propose un cadre théorique pour développer une sociologie des droits humains en s'intéressant aux mouvements sociaux dans le but de comprendre les cultures de droits locales. Si le droit humain est une idée qui se développe historiquement principalement à travers l'État, on remarque qu'au Canada, les avancées des droits de l'homme sont le fait de militants travaillant sur le terrain. Dans cet article, on explore aussi les écrits en sociologie au Canada. Les auteurs argumentent qu'on observe un sérieux manque d'engagement de la part des sociologues anglophones et francophones au Canada et que trop peu d'entres eux proposent de réelles études nationales. Évidemment, l'accès restreint à l'information législative représente un obstacle sérieux à la recherche académique au Canada. This article offers a framework for developing a sociology of human rights using social movements to understand local rights cultures. The idea of human rights has historically been highly statist, but grass‐roots activism has been at the heart of the most profound human rights advances in Canada. The article also raises questions about the current state of sociological writing about Canada. The author contends that there is a serious lack of engagement among English and French sociologists, and too few scholars provide genuine “national” studies. Moreover, restrictive access to information legislation represents a serious obstacle to academic research in Canada. 相似文献
