伴随着农村土地承包经营权流转制度的发展,边疆民族地区不同民族间的农村土地承包经营权流转纠纷也日益增多,此类纠纷因合同流转主体民族多元、流转期限过长、流转价格过低等因素在履行中引发一系列社会问题,流出方通常诉请法院解除或变更合同。审判中合同稳定性与情势变更之间的法律适用问题日益凸显,对此需要从法律、民族、社会的视角进行综合考量,在明确审判思路的基础上能动司法,提出规范和促进边疆民族地区农村土地承包经营权流转的司法建议。  相似文献

The private rented sector of the British housing market has been in decline since the beginning of the present century; that decline has continued apace since the end of the Second World War. A proposed solution for the stemming of this demise is the removal of present rent controls and the substitution of free market conditions so that rents find their own market levels. This, so it is argued, would enable landlords to obtain a proper return on their housing investments and lead therefore to an increase in supply and an ending to the present disinvestment from this housing sector. This article disputes this thesis. In the first place it is argued that “market rent” is a problematic concept and raises complex issues of distributive justice and social policy — which its advocates ignore. Secondly, it is argued that a free market solution is ahistorical in that it takes no account of the past failure in Britain of privately rented housing; and similarly it ignores the complex web of historical circumstances behind its decline — attributing the decline to the single causal factor of rent control. Thirdly, it is suggested that a market solution is sociologically misconceived because it ignores the characteristics and needs of those social groups dependent upon this sector. Finally, on grounds of practicability it is proposed that a free market in rented housing may be quite inappropriate for the rump of housing stock remaining in the private rented sector; and that, given the current social and economic constraints operating in the housing market as a whole, any revival of this sector is unlikely even with enhanced rental inducements. It is thus concluded that a free market solution is misconceived and would merely serve to impose an ideological straightjacket upon the provision of a basic human need.  相似文献

社会纠纷始终是社会学关注的重要议题。本文在现有关于社会纠纷的研究基础上,以权力为核心概念,从地位结构观和网络结构观两种理论视角出发,试图提出“权力的强制性及传导机制” 这一理论框架,分析当前中国城市中,个体自身拥有的权力和个体社会网络中的权力对居民的纠纷卷入及其应对行为所产生的影响。CGSS2006的数据结果表明,第一,无论是个体自身的权力还是个体社会网络中的权力,都有助于居民规避社会纠纷;第二,无论是个体自身的权力还是来自其社会网络中的权力,居民占有的权力资源越多,就越可能使用正式渠道来应对纠纷。  相似文献

在南海,我国与其他国家存在两种不同性质的法律争议,即我国与东盟某些国家之间的领土归属争议和中美针对专属经济区内军事活动的争议。由于它们的性质和范畴不同,所以应采用不同的方法和路径,以求达到和平解决。本文依据海洋法制度,论述了中美在专属经济区内的军事活动争议,并提出应通过双边对话协商机制解决争议,以寻求对海洋法原则的理解和认识达成一致。同时,双方应努力缔结关于海上问题的联络和应急处理机制。  相似文献

利用一个于2005年在中国28个省份进行的综合社会调查数据(CGSS2005),对中国行政纠纷的分布以及中国公民如何有针对性地进行纠纷解决的制度选择进行定量经验研究。研究发现,针对行政纠纷,现阶段中国公民的法律意识并不淡漠。但现实的制约使得一些公民采取司法程序及准司法程序之外的渠道解决此类纠纷。公民对中国行政纠纷解决存在事实上的"双轨"制度需求,即,公民对通过(准)司法渠道和党政渠道解决纠纷有同等程度的需求。此外,不同社会群体对行政纠纷解决渠道的选择偏好也呈现多元性。基于经验研究,对当前的相关研究进行理论和方法论的反思,并呼吁理论研究和制度建设做到真正了解并尊重公民的意愿。  相似文献

中国农村是当今社会矛盾和冲突最为集中和突出的地方,而农村土地纠纷则是农村社会矛盾和冲突的总根源。农村土地纠纷不仅仅是一个法律问题,也不仅仅是一个土地制度本身的问题。我们在构建解决农村土地纠纷机制时,不能仅限于对土地制度本身的改革与完善,这个机制必须能够容纳和消解土地制度以外的东西。概括地讲,就是要在宪政的框架下,在民主政治和现代法治的基础上,构建解决农村土地纠纷的长效机制。  相似文献

An ethnographic study using observation and in-depth interviewing of professionals from different organizations, intensively 'shadowed' a small number of alleged child abuse cases as they moved through the service system. A high level of inter-agency conflict was observed and common sources of conflict were: gatekeeping disputes; dispositional disputes; and domain disputes. Dynamics relating to the displacement of hostility on to other agencies in cases in which all the professionals involved felt impo-tent to protect vulnerable children, were also observed. These findings provide some fresh insights and hypotheses into the com-plexity of inter-agency interaction in the field of child protection.  相似文献

Based on a conceptualisation of de‐commodification as the right to decent and affordable housing, we assessed to what extent this right is realised for low‐to‐moderate‐income owners and renters across Western European housing regimes in 1995 and 2012. If differences in the social production of housing do matter (regardless of type of welfare state and the country's economic affluence), then distinct configurations of housing outcomes should exist. This was found to be indeed the case: More state intervention results in good housing conditions and low housing cost burdens across tenure‐age groups (but particularly for renters), although more so in social‐democratic than in conservative‐corporatist welfare states. A more important role for the family in housing provision is associated with higher subjective housing cost burdens and poor housing conditions. As housing regimes became more commodified between 1995 and 2012, it seems that configurations of housing outcomes have become less associated with the features of housing regimes, and more with type of welfare state and the country's economic affluence.  相似文献

Housing figures prominently in debates about crime in Britain. It has become commonplace to comment on the increasing associations between crime and council housing. This paper explores some of the issues which link housing and crime. It argues that it is important to recognize how the social base and geography of housing have changed and to understand processes which lead to an increasing concentration in council housing of those with least choice in the housing market and fewest resources elsewhere. At the same time there is a danger in overstating the associations between crime and council housing and neglecting other associations with housing, and homelessness. In view of the associations between crime and council housing, considerable effort has been expended on developing management and other responses designed to reduce crime. The general view is that a broad approach is required in such initiatives and the limited research evidence does not suggest that housing management action alone is effective in reducing crime. The association which exists between council housing and crime requires a policy response which relates to why the most deprived sections of the community are increasingly concentrated in parts of the housing market and exposed to increased risks, and one which relates to the pattern of opportunities and choices in the housing system and not just to housing management.  相似文献
