This study examined the impact of hate crimes upon gay and lesbian victims, reviewing 1538 hate crimes committed in Los Angeles County. Differences between sexual orientation and other hate crime categories were considered for offense severity, reportage to law enforcement, and victim impact. The type of offense varied between crimes classified for sexual orientation (n=551) and other bias-motivated crimes (n=987). Assault, sexual assault, sexual harassment, and stalking were predictive of sexual orientation hate crimes. Sexual orientation bias crimes evidenced greater severity of violence to the person and impact upon victim level of functioning. More violent forms of aggression were predictive of gay and lesbian victim's underreportage to law enforcement. For sexual orientation offenses, victim gender and race/ethnicity differences were predictive of the base rates of crime reportage as well. These findings are considered in terms of a group-risk hypothesis, encountered by multiple outgroup persons, that influences help-seeking behavior and ingroup identity.  相似文献

We examine the effects of mass transit strikes on criminal behavior in Los Angeles County utilizing a unique dataset of reported crimes between 2000 and 2007. Geocoded location and time information pertaining to each offense accommodates a fine grained difference‐in‐differences panel data analysis. We find that in locations affected by the strike, aggravated assaults rose by 18.7% while aggregate property crimes increased by 5.7%, relative to their mean. This increase in crime was disproportionately larger in lower income neighborhoods, which report higher usage of mass transit, suggesting local isolation of both criminals and victims as a mechanism. The aim of this study is to examine the relationship between impairment, disabling barriers and risk factors relating to hate crime incidents. The study analyses quantitative data collected in 2011–2012 where there were 81 incidents of disability hate crime reported in the Tyne and Wear area of England. The research discovered that in the Tyne and Wear region people with learning difficulties have a greater likelihood of experiencing hate crime than do people with other impairments. Although there was no significant difference between impairment and types of hate crime incidents recorded (i.e. verbal abuse/harassment, violence and criminal damage), there were distinct differences between police and victim support responses to victims which correlated to impairment categories (p ≤ 0.05). The study concludes by suggesting that owing to specific disabling barriers experienced by people with learning difficulties, this group is at increased risk of being victimised and is less likely to receive support from criminal justice agencies.  相似文献

Following the passage of the Hate Crimes Statistics Act of 1990, hate crime research grew with the ability to use data collected by the Federal Bureau of Investigation. Nevertheless, limitations in the data collection led to a dramatic decline in research by the end of the 20th century. This review provides an overview on the development of the hate crime legislation and data collection in order to address and understand the prevalence of hate crimes in the United States. Despite the limitations found in the national hate crime data collected by federal, state, and local law enforcement agencies, a rise in the level of hate crimes against immigrants has renewed scholarly interest in identifying the causes and effects of hate crimes. Recent studies have taken a different approach to explain the rise in the level of hate crimes against immigrants given the passage of anti‐immigrant legislation and inflammatory rhetoric against immigrants. By examining the link between hate crimes against immigrant groups and the demographic, economic, and political changes within the local context, researchers can begin to explain the variation in hate crimes and inform future research as well as local policies and practices to prevent these crimes from occurring.  相似文献

Abstract

The enactment of hate crimes legislation raised awareness of the severity of crimes motivated by animus toward individuals and communities. This national telephone survey found that states which mandate local law enforcement agencies to report hate crimes generally have high compliance rates; states without mandatory reporting requirements have few law enforcement agencies that report these crimes. Law enforcement training on hate crime varies from state to state, with few states including information specifically addressing hate crimes motivated by sexual orientation.  相似文献

Economic intuition suggests that enforcement errors incentivize crimes, therefore officers must be penalized for committing such errors. Legal scholars argue that if penalties for errors are severe, officers may become timid while policing (thereby encouraging crime). We evaluate these arguments in a model where officers invest in competence. Competence increases the officer's ability to identify criminals. Low sanctions for errors encourages bold policing by officers but may still raise the equilibrium level of crime because it also discourages investments in competence. Granting immunity to only competent officers (“qualified immunity”) reduces both errors and crimes when competence is observable. (JEL K4, K42, L5)  相似文献

Draft lottery number assignment during the Vietnam Era provides a natural experiment to examine the effects of military service on crime. Using exact dates of birth for inmates in state and federal prisons in 1979, 1986, and 1991, we find that draft eligibility increases incarceration for violent crimes but decreases incarceration for nonviolent crimes among whites. This is particularly evident in 1979, where two‐sample instrumental variable estimates indicate that military service increases the probability of incarceration for a violent crime by 0.34 percentage points and decreases the probability of incarceration for a nonviolent crime by 0.30 percentage points. We conduct two falsification tests, one that applies each of the three binding lotteries to unaffected cohorts and another that considers the effects of lotteries that were not used to draft servicemen. During recent years ‘disability hate crime’ has become a major political and criminal justice concern due to a number of high-profile murders in the United Kingdom. The aim of this article is to compare disability-motivated hate crimes with other hate crimes motivated by homophobic or racist bias. This study employs a quantitative methodology utilising data collected by the ARCH hate crime recording system over a 10-year period (2005–2015). The data findings illustrate a number of variations concerning incidents reported by disabled people regarding violence and threatening behaviour, when compared with incidents motivated by race/faith or homophobic bias.  相似文献

A community structure analysis compared community characteristics and nationwide coverage of immigration reform in newspapers in 21 major U.S. cities, sampling all 250+ word articles April 23, 2010 to November 12, 2013. The resulting 262 articles were coded for “prominence” and “direction” (“favorable,” “unfavorable,” or “balanced/neutral” coverage), then combined into each newspaper's composite “Media Vector” (range = .632 to ?.4800). Nineteen of 21 newspapers showed favorable coverage of immigration reform. Pearson correlations yielded 4 significant results, the most powerful of which supported immigration reform. The “vulnerability” hypothesis (media “mirror” the interests of marginal/disadvantaged groups) was essentially confirmed. Higher percentages below the poverty line (r = .607, p = .003) and higher crime rates (r = .490, p = .017) correlated with more favorable coverage of immigration reform. By contrast, higher percentages of women in the workforce (r = ?.543, p = .008) and higher proportions of hate crimes (r = ?.403, p = .048) were linked with less favorable coverage. Regression analysis yielded the percentage living below the poverty line accounting for 37.2% of the variance, and proportion of hate crimes yielded an additional 19.1% of the variance. The Midwest had by far the most favorable coverage of immigration reform, more than any other region.  相似文献

Summary

This article develops competencies for social workers to enable them to counter harassment and hate crimes by examining the intersection of “self” and “other” when the “other” is either a gay man or a lesbian or when the “other” is the perpetrator of hate crimes. The authors contend that there is a cultural foundation to hate crimes and that it involves oppression like that experienced by other minority groups, that this oppression is supported by the dominant culture, and that oppressive behaviors can be changed. A typology of five competency areas is presented to develop culturally relevant knowledge, attitudes, and skills that strengthen understanding and tolerance for gay men and lesbians and to work with those who oppress them.  相似文献

The process to create hate crime laws in the United States has wrestled with the core issues of freedom of speech and greater harm. This article looks at the evolution of bias crime laws, culminating with President Obama’s signing of the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act in 2009. The constitutionality of the laws is ‘discussed and suggestions for sociological research are made. Four elements of hate crime laws are discussed; criminality, intent, perception, and protected statuses. The logic of hate crime laws is based on the argument that hate crimes are a form of terrorism, designed to intimidate large groups of people. Readers should be familiar with the basic case for the existence of such laws.  相似文献

In this research we explore the interaction between gender and perceived risk of victimization on levels of fear of crime. Much of the previous research on the effects of gender on fear of crime assumes that crimes are not gendered and that the effects of gender would operate the same regardless of type of crime. Challenging this assumption, we examine crimes that disproportionately victimize women or men. We find that there is greater nuance in both fear of crime and perception of risk when explored in this way. In fact, men's fear of crime actually surpasses women's fear at high levels of perceived risk for those crimes in which men are more likely to be victimized. We offer explanations for this finding, concluding that gendered perceptions of crime and victimization may drive these differences. In sum, our study indicates that future research on fear of crime must be even further attuned to the gender gap in fear.  相似文献

A common narrative about crime in the contemporary United States is that offenders are primarily young black men living in poor urban neighborhoods committing violent and drug‐related crimes. There is also a local context to community, crime, and fear that influences this narrative. In this article, I address how narratives of crime and criminals play out differently within particular places. The article is based on participant observation and interviews conducted in two high‐crime Boston‐area communities. Although both communities are concerned with stereotypical offenders, there are differential community constructions of crime, formed through interactions between crime narratives and place identities. In one, crime is a community problem, in which both offenders and victims are community members. In the other, outsiders commit crime against community members. Media portrayals of crime and community, community race and class identities, and concerns over neighborhood change all contribute to place‐specific framing of “the crime problem.” These frames, in turn, shape both intergroup dynamics and support for criminal justice policy.  相似文献

This article performs a cost‐benefit analysis to determine socially optimal bail levels for felony defendants. We consider jailing costs, the cost of lost freedom to incarcerated defendants, and the social costs of flight and new crimes committed by released defendants. We estimate the effects of changing bail using data from a randomized experiment. We find that the typical defendant in our sample would be willing to pay roughly $1,000 for 90 d of freedom. The greater prevalence of intraracial crime to interracial crime is a common finding in criminology. This issue is best understood when specific crimes are studied from a proper theoretical basis. We argue that variation in rates of cross‐racial crime is explained by homophily bias, reflected in residential segregation, in conjunction with the motivational mindset of an offender, specifically whether a crime is instrumental or expressive in nature. We hypothesize that homophily bias is stronger in expressive crimes than it is in instrumental crimes. Using the National Incident‐Based Reporting System (NIBRS) for 2009 and 2010, we analyze robbery and aggravated assault as instrumental and expressive crimes, respectively. The analyses show that racial residential segregation increases, as expected, the relative frequency of black intraracial assault to black interracial assault, whereas it does not affect the relative frequency in robbery. Contrary to our hypothesis, however, the same variable shows little effect on the relative frequency of white intraracial to interracial assault. We give possible explanations as to why white crimes are insensitive to residential segregation.  相似文献

First I show that for wealth-constrained agents who may commit an act twice the optimal sanctions are the offender's entire wealth for the first and zero for the second crime. Then I ask the question whether this decreasing sanction scheme is subgame perfect (time consistent), that is, does a rent-seeking government stick to this sanction scheme after the first crime has occurred. If the benefit and/or the harm from the crime are not too large, this is indeed the case; otherwise, equal sanctions for both crimes are optimal.  相似文献

The 1984 federal Comprehensive Crime Control Act (CCCA) included a provision that permitted local law enforcement agencies to acquire up to 80% of the proceeds derived from civil asset forfeitures obtained in joint operations with federal authorities. We investigate how this rule governing forfeited assets influenced crime and police incentives by taking advantage of pre‐existing differences in state‐level civil asset forfeiture law and the timing of the CCCA. We find that after the CCCA was enacted crime fell about 17% in places where the federal law allowed police to retain more of their seized assets than state law previously allowed. The purpose of this paper is to explore two alternative measures of “crime”: official incidence reports, compiled and published as the Uniform Crime Reports (UCR), and citizen-defined victimizations, compiled and published as the National Crime Surveys (NCS). Six categories of crime are examined (auto theft, burglary, larceny, robbery, rape, and assault) for thirty-nine cities, and two categories (auto theft and robbery) are analyzed for ten other cities. Previous studies have approached the problem of comparing UCR and NCS measurements of crime with a “validity and convergence” perspective. The regression model approach we adopt, which expands on those studies, assesses the extent to which these alternative measurements of crime are equivalent, comparable or divergent. We regress victimizations on incidents and then check the goodness-of-fit of our model with three tests: (1) an examination of victimization/incidence ratios for all cities; (2) a determination if confidence intervals placed about victimization estimates included incidents; and (3) a forecast of victimizations using incidents. Results indicated that, in general, the two measurements of property crimes are comparable; however, only those of auto thefts approached equivalence. On the other hand, the measurements of personal crimes are clearly divergent. We conclude that future research must explain why some crimes are easier to assess than others, and why some cities do so much better at assessing crime than other cities.  相似文献

This article presents findings from a survey on hate speech reported by disabled people in Norway. Previous British and American research shows that disabled people are more likely than their non-disabled peers to be the victims of hate speech and hate crime. In our study, 38% reported at least one experience of hate speech during the previous 12 months. The respondents reported a wide range of consequences of hate speech related to psychological, social and societal issues. The findings reveal that people place restrictions on their own lives as a result of being exposed to hate speech, including raising their opinion in public debates. Drawing on the work of Nancy Fraser, we discuss the mechanisms that prevent disabled people from participating in society on equal terms. We conclude that to combat hate speech, transformative strategies need to be applied.  相似文献
