‘To favor the side of freedom’: judicial opinions and the law of slavery

This essay uses the appellate judicial opinions in more than 800 suits for freedom from across the United States to analyze the additional commentary antebellum judges included when issuing their decisions. Judges used arguments that mirrored broader debates between abolitionists and pro-slavery advocates, while also upholding the central importance of the rule of law. In doing so, they sought to defend the judicial system from the many challenges brought by African Americans and other anti-slavery activists. Regardless of their own individual beliefs about slavery, judges often chose to frame their written opinions around appeals to morality. The use of moral arguments allowed judges to anticipate the positions of African Americans and their supporters and then render these ideas irrelevant in the face of positive laws supporting slavery. The decisions they made had real consequences for future legal pathways to freedom, and the ways judges chose to structure their decisions reveal both awareness and anxiety over the power of judicial challenges to the institution of slavery.

To be Karen in the Thai–Burma borderlands: identity formation through the prism of a human rights discourse

Current debates on Karen identity have tended to focus on the development of a nationalist construct of a pan-Karen community. This article moves beyond this notion to explore a Karen identity that is being recast in the form of a human rights discourse where the Karen construct, adapt, and reify the social aspects of their political identity in order to establish a claim to a political self, where they protest the persecution and discrimination waged against them as well as larger claims around governance and political representation. This human rights discourse is framed by increased emphasis in the Thai–Burma borderlands on a human rights framework to address Burma’s ongoing conflict. Such an argument has the potential to move current debates beyond the more militant ethno-nationalist discourses of the Karen identity and develop an adequate framework for the practices of identity, which occur among displaced Karen in the Thai–Burma borderlands.     

To click or not to click? A study of the innovation resistance of political emails

As a novel technology in the age of information, the Internet has become a fancy vehicle through which campaign messages can be delivered to prospective voters via multiple paths such as websites and emails. However, despite the effort put into making campaign messages as appealing as possible, studies show that the click-through rate of campaign emails remains relatively low. In the past, many studies concerning technology adaptation have focused on the aspect of “innovation diffusion” rather than “innovation resistance”. The aim of this study is to integrate ideas derived from the Technology Acceptance Model, the concepts of innovation resistance and the theory of ad avoidance to find the factors that influence voters' resistance of reading political emails. An online survey was conducted, in which a sample of 1012 voters in the 2009 local election in Taiwan was studied. The results showed that negative impression and perceived interruption were the factors behind people's resistance of politically-related emails. In addition, both of the above factors affected people's attitudes toward opening future political emails.     

To invest in the invisible: A case study of Manti Te’o's image repair strategies during the Katie Couric interview

The purpose of this study was to examine Manti Te’o's image repair strategies during an interview with Katie Couric. This interview followed reports that Te’o had been involved in an elaborate hoax featuring a fake girlfriend. The interview was a worthy avenue of investigation as it was Te’o's first opportunity to publicly defend himself on camera following a week of ridicule and speculation by media outlets and the public. A deductive thematic analysis was conducted on Te’o's responses utilizing Benoit's image repair typology and other recently identified image repair strategies as a guide. Results revealed that Te’o did not deviate from previously established strategies by employing defeasibility, victimization, good intentions, stonewalling, retrospective regret, bolstering, shifting blame, and simple denial. Collectively, the employment of these tactics illustrated a timid, naïve, and remorseful approach to image repair. While some of Te’o's choices were appropriate, the heavy use of stonewalling and victimization may have been ineffective in changing audience perception.     

To Aid the Fatherland. German-Americans,Transatlantic Relief Work and American Neutrality, 1914–17

Abstract

This article explores German-American war relief for Germany during First World War, concentrating on the period of American neutrality, 1914–17. Based on financial ledgers, meeting protocols and the publications of ethnic organisations, it shows how German-American charity served as a force of mobilisation on behalf of the old fatherland after August 1914 even as American public sentiments turned increasingly hostile towards Germany. The article nuances common notions of American humanitarianism during the period of neutrality and broadens our understanding of how German-Americans (and by extension, ethnic groups more generally) tried to balance political loyalty to their ‘hostland’ with emotional attachment to their ‘homeland’.     

What To Wear,What To Wear?: Western Women and Imperialism in Gilgit,Pakistan

In this paper I inaugurate a feminist sociology of imperialism that extends the work of postcolonial scholars interested in explaining how Western women are located in global projects of imperialism. As part of an ethnographic study of the lives of contemporary development workers in Gilgit, northern Pakistan, this analysis describes and theorizes the significance of clothing choices to the formation of Western women's subjectivities and to transcultural power relations in this postcolonial setting. I demonstrate that decisions Western women make about what to wear in Gilgit develop into arenas of socio-cultural inclusion and exclusion through processes of identification and differentiation, as clothing styles are used to naturalize power hierarchies between Western and local Muslim women.
