合同的义务可以分为给付义务和附随义务,二者在产生原因、内容、法律效果等方面有着差异.然而,附随义务和给付义务同样是服务于合同目的,基于此,德国新债法统一了二者的请求权基础、归责原则,并且以“违反义务”统领随附义务和给付义务.这种规定有利于从合同法的角度给予当事人更多的保护,同时也是对传统合同义务理论的突破.文中分析附随义务制度的产生过程并阐述德国新债法中附随义务突破传统理论的论证思路,以期对我国法学理论建设有所启示. 相似文献
