Domestic violence imposes a large cost on society. The authors exploit state variation in timing to examine the impact of three types of law on intimate partner homicides. These laws restrict access to firearms by individuals who are subject to a restraining order or have been convicted of a domestic violence misdemeanor or allow law enforcement officers to confiscate firearms at a domestic violence scene. The authors find that female intimate partner homicide rates decline 7% after a state passes a restraining order law. They find no effect from the domestic violence misdemeanor or confiscation laws.  相似文献

Firearms play an important role in lethal domestic violence incidents. The authors review state laws regarding two policies to separate batterers from firearms: laws authorizing police to remove firearms when responding to a domestic violence complaint ("police gun removal laws") and laws authorizing courts to order guns removed from batterers through a protective order ("court-ordered removal laws"). As of April 2004, 18 states had police gun removal laws; 16 states had court-ordered removal laws. The authors examine relevant characteristics of the laws and recommend that these laws be mandatory, apply to all guns and ammunition possessed by an abuser, and include clear procedures to enhance implementation.  相似文献

Though gun violence is a global issue, the risk of firearm death is substantially higher in the United States than in other high‐income nations. Guns are deeply rooted within American culture; however, different subcultures exist along the urban‐rural divide. Such differences between urban and rural communities related to gun culture have been dubbed “firearm localism.” We investigated firearm localism in a state that has the highest proportion of firearm‐related domestic violence homicide and a large rural area representing a subgroup of rural culture: Appalachia. Specifically, key professionals reported issues related to domestic violence gun control in their communities. We conducted phone and in‐person surveys with a sample of community professionals (N = 133) working in victim services and the justice system in urban and Appalachian communities. Despite evidence of a strong gun culture in the rural communities, both urban and rural professionals estimated that about two‐thirds of their community would support restricting abusers' firearm access. Additionally, rural professionals were more likely to show concern for abusers' Second Amendment rights when discussing unintended negative consequences of gun confiscation; urban professionals were more likely to point out that gun confiscation can provide a false sense of security for victims. Policy implications are discussed.  相似文献

Batterers with access to firearms present a serious lethal threat to their partners. The purpose of this exploratory study is to estimate the prevalence of and risk markers for gun possession among Massachusetts men enrolled in batterer intervention programs. The authors found that 1.8% of the men reported having a gun in or around their home. Those most likely to report having a gun were White, earned 25,000 US dollars or more per year, had served in the military, engaged in problem gambling, and had attempted homicide or threatened their partner with a firearm. Recommendations for strengthening relevant gun laws both within and outside of Massachusetts are discussed.  相似文献

Abstract

Context: Firearms are used in the majority of college aged suicides and homicides. With recent efforts by various gun lobbying groups to have firearms more accessible to college students on campuses, there is the potential for more firearm-related morbidity and mortality. Objective: This study assessed university police chiefs’ perceptions and practices concerning selected issues of firearm violence and its reduction on college campuses. Participants: The Directory of the International Association for College Law Enforcement Administrators was used to identify a national random sample of campus police chiefs (n = 600). The respondents were predominantly males (89%), 40 to 59 years of age (71%), Caucasian (85%), and worked for 21or more years in law enforcement (75%). Methods: In the fall of 2008, a 2-wave mailing procedure was used to ensure an adequate response rate to a valid and reliable questionnaire. Results: A total of 417 (70%) questionnaires were returned. A firearm incident had occurred in the past year on 25% of campuses and on 35% of campuses within the past 5 years. The majority of campuses (57%) had a plan in place for longer than a year to deal with an “active shooter” on campus. Virtually all (97%) of the campuses had a policy in place that prohibited firearms on campus. The primary barrier (46%) to a highly visible campus plan for preventing firearms violence was the perception that firearms violence was not a problem on their campus. Conclusions: A greater awareness of the importance of a highly visible campus firearm policy and its potential for reducing firearm trauma on college campuses is needed.  相似文献

A random sample of more than 10,000 undergraduate students, selected from 119 4-year colleges, answered a mailed questionnaire about gun possession and gun threats. Approximately 4.3% of the students reported that they had a working firearm at college, and 1.6% of them have been threatened with a gun while at school. Students are more likely to have a firearm at college and to be threatened with a gun while at college if they are male, live off campus, binge drink, engage in risky and aggressive behavior after drinking, and attend institutions in regions of the United States where household firearm prevalence is high. Having a firearm for protection is also strongly associated with being threatened with a gun while at college. Students who reported having firearms at college disproportionately reported that they engaged in behaviors that put themselves and others at risk for injury.  相似文献

Utilising an account of the development of gun control legislation in Britain and the work of Norbert Elias, this paper argues that there are a number of processes that influence the development of such legislation, both in Britain and elsewhere. It argues that while processes such as the state's predisposition to consolidate its monopoly on the use of violence and advances in people's threshold of repugnance at violence influence the development of legislation, they can also lead to a blurring of the distinction between legally held sporting guns and illegal firearms in the hands of criminals. The paper concludes by considering other factors such as the efficacy of the prohibitionist lobby on the one hand and the gun lobby on the other, together with historical factors that may, in part, account for international variation in regimes of gun control.  相似文献

Laws that prohibit persons under a domestic violence restraining order from purchasing or possessing a firearm are a primary way to keep guns out of the hands of batterers. In July 2005, the California Attorney General's Task Force on the Local Criminal Justice Response to Domestic Violence issued a report called Keeping the Promise: Victim Safety and Batterer Accountability. The report focused, in part, on the extent to which California's domestic violence restraining order system succeeds in disarming batterers. Restraining orders are the principal means by which the criminal justice system can accomplish this objective. The Task Force found that criminal justice agencies and the courts performed poorly in this area. The report strongly recommended that a more strategic, collaborative use of laws already on the books could significantly improve performance, without much additional expense. What follows is a summary of those finding and recommendations.  相似文献

This article explores the relationship between and effects of domestic violence, rates of gun ownership, and parental educational attainment on the aggressive beliefs and behaviors of elementary and middle school children in the state of South Carolina. The results of the current study’s statistical analyses are interpreted using a multi-theoretical framework. Recommendations to decrease rates of domestic violence and firearm accessibility, as well as methods to increase educational attainment in this state’s unique environment and the nation as a whole, are presented.  相似文献

This study examines the experiences and perceptions of domestic violence among older Chinese immigrants, using data from a larger sample of Chinese Americans who reside in a major metropolitan area in the West Coast (Yick, 2000). A subset of respondents 50 years and older who are foreign-born (n = 77) were selected to (1) examine older Chinese immigrants' experiences with physical abuse by a spouse, (2) explore the definitions and perceptions of intimate partner violence among older Chinese, and (3) examine the relationship between acculturation, victimization experiences, and perceptions of domestic violence among this population. Findings indicate that close to 7% of the women and 6% of the men have experienced minor physical violence by their spouses during the past 12 months. Gender and acculturation were associated with perceptions and attitudes towards domestic violence.  相似文献

This study compared rural youth exposed to gun violence and rural youth not exposed to gun violence on a number of variables: anger, anxiety, dissociation, depression, posttraumatic stress, total trauma, violent behavior, parental monitoring, and levels of violence in the home, school, and community. One-fourth (25%) of the rural youth in this study reported having been exposed to gun violence at least once. Youth exposed to gun violence reported significantly more anger, dissociation, posttraumatic stress, and total trauma. In addition, youth exposed to the violence of guns reported significantly higher levels of violent behaviors and exposure to violence in other settings and also reported lower levels of parental monitoring. The present study contributes to the growing body of literature addressing the stereotype that rural communities are not immune to the violence of firearms. This stereotype acts as a barrier to mental health practice, research, and policy issues in rural communities.  相似文献

This study examines the prevalence and extent of domestic violence and the consequences of domestic violence for mental health outcomes in a birth cohort of New Zealand young adults studied at age 25 years. A total of 828 young people (437 women and 391 men) were interviewed about the domestic violence victimization and violence perpetration in their current or most recent partner relationship. Key findings of the study were (a) domestic conflict was present in 70% of relationships, with this conflict ranging from minor psychological abuse to severe assault; (b) men and women reported similar experiences of victimization and perpetration of domestic violence; and (c) exposure to domestic violence was significantly related to increased risks of major depression (p < .05) and suicidal ideation (p < .005) even after extensive control for covariates.  相似文献

Firearms injuries are a leading cause of injury and death in North Carolina, including suicide, homicide, intentional assault, and unintentional injuries. Research has demonstrated that the presence of a firearm in a household increases the risk for homicide and suicide. This study examined two firearms-related risk factors, the presence of a firearm in the household and risky storage practices (loaded and unlocked), using the 2011 North Carolina Behavioral Risk Factor Surveillance System (BRFSS). We hypothesized that among household firearm owners, those who keep unlocked loaded firearms would be varied by demographic variables and also by tendencies for more risk-taking behaviors such as smoking and drinking. Results showed that those who were more likely to keep firearms in or around the home were male, older age, White race, married, with some post high school education, and with higher income. There were no differences by region, age, race, education, or income among those who kept firearms loaded and unlocked. Risky storage practices were related to social conditions such as marital status and number of adults and children in the household. The presence of firearms was lower among those who lived alone; however, among those with a firearm in the household, 42% of single adult households keep a loaded and/or unlocked firearm in the house, and up to 30% of households with children do as well. Behavioral risk factors such as smoking, binge drinking, and not using a seatbelt when driving a car were also related to firearms possession and storage conditions.  相似文献

In contrast to tobacco, alcohol, and other consumer products associated with health risks, we know very little about how firearm manufacturers advertise their products. The authors examined advertisements for firearms in all 27 ad-accepting magazines listed in Bacon's Magazine Directory "guns and shooting" category. Sixty-three manufacturers spent an estimated $1,195,680 on firearm advertising during the month studied. Annual advertising costs ranged widely; manufacturers spent an estimated $28.16 in advertising per firearm produced. Firearms generally were presented as a part of a lifestyle. Self-protection was noted infrequently in the advertisements. By contrast, attributes of the gun, typically technological characteristics, were noted in almost every advertisement.  相似文献

This article discusses key studies linking intervention for co-occurring substance abuse and partner abuse. Findings are grouped into three areas: (a) the effect of addictions treatment on partner violence; (b) application of transtheoretical, motivational, and culturally focused approaches to improve engagement and prevent attrition; and (c) assessment-based matching of services. Finally, the relative value of serial, coordinated, and integrated substance abuse programs and partner abuse intervention programs are considered. We reached three primary conclusions: (a) Addiction treatment alone reduces the risk for future domestic violence in a subset of men who batter, (b) screening and assessment for substance abuse by all men in partner abuse intervention programs is a standard of practice but needs to extend beyond "intake" and occur periodically, and (c) coordinated and integrated substance abuse and domestic violence programs probably offer more safety than traditional serial substance abuse treatment followed by partner abuse intervention.  相似文献

Many states have recently passed new legislation to deal with spouse abuse, including several which have created a new criminal offense: domestic violence. This study examines all 1980 charges under Ohio's new domestic violence law in a large misdemeanor court and concludes that the creation of a new offense category does not cause major changes in measurable court outcomes. For example, 73% of victims who filed charges dropped them before a verdict was reached. This figure is extremely high. Combined with the large number of victims who never file, it suggests that most abusers do not go through a complete trial. Moreover, even when victims persevere and the batterer is found guilty, very little happens to him. Sixty-four percent did not spend even one day in jail, less that 10% were sentenced to alternative programs, and 27% were neither jailed nor placed on probabtion. Even when found guilty, most abusers are neither punished nor offered help. This study makes two recommendations. The first suggests a dual system whereby victims of domestic violence are provided with both criminal and social service alternatives. The second recommendation encourages the courts to experiment with counseling programs for batterers both as a condition for dismissal of charges and as a condition for probation when convicted.  相似文献

This paper reports the results of the application of intervention analysis, an interrupted times series methodology, to test the deterrent response of criminal offenders faced with changes in the penalty structure for the crime of robbery with a firearm. The results are consistent with the hypothesis of general deterrence as set out by Becker and extended theoretically and tested empirically by others. Offenders in Arizona metropolitan areas rapidly reduced the number of robberies with a firearm supplied as penalties for firearm use became more severe. This finding suggests legislation which punishes those who choose to use such weapons in illegal activities may be effective while leaving intact the rights of private citizens to own firearms. One disturbing finding was that a Portion of the deterrent effect of harsher mandatory sentencing for firearm use in robbery may have been offset by substitution of other types of robbery not covered by the new legislation.  相似文献

Since the passage of the Pennsylvania Protection from Abuse Act in 1976, many states have enacted legislation to provide civil restraining orders for battered women. These orders, which offer a civil court alternative to criminal sanctions, are court-issued temporary or permanent orders which direct an assailant to refrain from further abusive conduct. Interviews with recipients of restraining orders suggest that the orders are generally ineffective in reducing the rate of abuse of violence. However, they were effective in reducing abuse for women with less serious histories of family violence or where the assailant was less violent in general. They were ineffective in stopping physical violence. Measures to improve restraining order mechanisms should: more clearly codify abuse and violence, improve access for those not married or cohabitating, streamline procedures and shorten waiting periods, address a full range of child-related concerns, strengthen sanctions, and mandate official responses to violations. Additionally, comprehensive legislation is needed to coordinate civil and criminal remedies.  相似文献

This study evaluated whether a history of sexual abuse could differentiate negative health consequences among men who have sex with men (MSM; N = 148) enrolled in a risk counseling program. More than half (51.4%) reported an experience of sexual abuse. A history of sexual abuse was associated with increased psychological distress, increased rates of alcohol (AOR = 2.91; p <.01) and/or drug abuse (AOR = 2; p <.01) treatment, increased risk of housing instability (AOR = 2.13; p <.05), and increased risk for suicidality (AOR = 4.3; p <.001). Findings demonstrate that screening for sexual abuse may be useful in determining the service needs of high-risk MSM.  相似文献
