罪刑关系的反思与重构——兼谈罚金刑在我国现阶段之适用(英文)

制度转型时期日益复杂的生活态势,必然导致不断有新的犯罪进入刑法规制范围,但我国97刑法立法上犯罪的增设却未能收到预期效果。犯罪的多样化似应带来刑罚的多样化,但这种"以罪定刑"的思路并未从根源上揭示罪刑关系,故无法解决我国现实问题。深层次分析:犯罪的应受刑罚处罚性的本质特征内含着"以刑定罪"规律,该规律的客观存在使得无论立法层面还是司法层面,刑罚的具体形态都决定着犯罪的内涵和外延。对该规律的认识和自觉运用,必将引起对罪刑关系的重新调整——在当前国情下刑罚应该限制于以自由刑为主的刑罚体系而不应扩大到罚金刑;凡以财产方式能够有效承担的法律责任,则应统统划归行政或民事责任范畴。

I take it an honor to be invited as the editorial advisor for this special issue on economic transition in China, the first special issue on this topic in SSIC. We can only select five out of an extremely rich reservoir of studies. The selected papers deal with general theories on transition and China's experience, and also include empirical studies on some important aspects in China's economic transition (e.g., the financial sector, the reform of enterprises and regional growth).

中国农民工的总体性状况分析(英文)

本文通过对相关实证研究文献的疏理,从农民工总量规模、结构分布、对输出地贡献和对输入地影响四个方面对中国农民工的总体性状况进行了描述与分析。在总量规模的分析中,我们需要注意各调查的统计口径,值得注意的是,根据最新发布的农普调查数据,农村外出从业劳动力已达1.3亿,此处数据不含随外出从业劳动力外出的非劳动力人口。外出务工经商者以初中文化的青壮年为主,行业分布以制造业、建筑业和服务业为主,长距离迁移占很高比例。农民工跨区域转移这种就业结构变动对我国经济增长贡献巨大,已有研究估计对GDP增量贡献在20%左右。从输出地来看,总的影响是积极的,特别是收入状况的改善,但也留下了数量庞大的留守族。     

受贿罪的罪刑架构分析

随着经济社会的发展,贿赂犯罪呈现出多样化、新型化特征,原来的刑事立法日渐滞后。刑法修正案(九)对相关条文的修改,使得受贿罪的罪刑架构出现了较大的变化。对于这些改变,理论界与实务界褒贬不一。本文以《刑法修正案九》修订为背景,对受贿罪复杂的罪刑架构及法律适用中分歧意见进行梳理及分析,力求达到对受贿犯罪的全新认识。
