Past efforts at law reform have taken years of consciousness raising. The resulting legislation has been ineffective in reducing men's sexual violence against women and children, in large part because most women are understandably reluctant to go to court. This reluctance comes from recognition of the fundamental failures of the legal doctrine. The judicial response to men's sexual violence can be reformed through the use of existing procedures (e.g., prosecution objections and appeals). This paper describes 3 local actions to start a fast and effective reform of the legal doctrine: Documenting the Outrageous, Challenging the Legal System, and Supporting Victims.  相似文献

The miscommunication hypothesis is the assumption that many incidents of acquaintance rape and coercive sex follow from miscommunication between men and women. This hypothesis is entrenched in popular, academic, and judicial understandings of sexual relationships. Recently some evidence has suggested that there is little miscommunication between sexual partners and that the hypothesis does not explain acquaintance rape or other forms of sexual violence. The present study used qualitative methodology in which men and women were asked to imagine themselves in a particular heterosexual dating situation and write what they think happened between the beginning (when sex was refused by one partner) and the end (when sex happened). Thematic analysis of the data found no evidence for miscommunication between partners under conditions of differences in desire. Instead, ambivalence about sexual activity was commonly described by women and men and was most often resolved to both parties’ satisfaction. Coercion by men was present in a minority of narratives under conditions of clear understanding of women's refusals. The study thus provides a rich, experience-based representation of heterosexual sexual activity, with considerable potential for the development of effective education campaigns.  相似文献

The way an issue is ‘framed’ (viewed and understood) has a profound effect on whether it is viewed as a priority for action by international organisations, states, and civil society. Wartime sexual violence used to be framed as a ‘women's issue’, but since the issue gained widespread notoriety in the mid-1990s, it has shifted to being understood as a ‘security issue’. Activists and campaigners have used this as an opportunity to press for more attention at international and national levels, and policymakers have given higher priority to the issue of ending wartime sexual violence. Yet framing wartime sexual violence in terms of security – and in particular, a focus on ‘rape as a weapon’ – comes at a cost. First, it isolates this violence conceptually from the wider context of gender-based violence before, during, and after active armed conflict, and other types of violence may receive little attention. In addition, the specific emphasis on ‘rape as a weapon’ affects the types of wartime sexual violence recognised and condemned by the international community, the kinds of ‘victims’ granted assistance, and the extent to which women and men are perceived as victims, empowered agents, or perpetrators.  相似文献

This study aims to give voice to the experiences of Nigerian women seeking asylum in the UK on the grounds of sexual violence. It draws upon in-depth narrative interviews with 10 Nigerian women, aged between 27 and 46, seeking asylum on the grounds of sexual violence. Women's accounts were analysed thematically, and the contextual factors that influenced the outcome of their asylum claims were explored. Findings show that women's asylum applications were affected by factors relating to lack of evidence, use of words and/or phrases that do not align with the English language meaning of sexual violence, Home Office's lack of understanding of cultural issues specific to women and peculiarity of women's narrative construction and the decommissioning of legal assistance. Findings also suggest that asylum organisations play a key role in providing holistic support to women. Recommendations are made for the Home Office's policies following these findings.  相似文献

This paper presents findings of an anthropological study among pregnant adolescents in Cape Town, South Africa. The inquiry focuses on the sexual dynamics within adolescent relationships. The study reveals widespread male coercion and violence within sexual relationships. Informants describe assault as a regular feature of their relationships. In South Africa, power relations between men and women are commonly manifested as and imposed through sexual violence and assault. Men use physical assault to force sexual contact, beating their female partners if they refuse to have sex, are suspected of sexual infidelity, or are found to be using contraceptives. Moreover, women experience abuse such as gang rape. Yet, health promotion interventions fail to acknowledge sexual encounters as instances in which unequal power relations between men and women are expressed. It is these power relations which determine women's ability or inability to protect themselves against sexually transmitted disease, pregnancy, and unwelcome sexual acts. This study underlines the need to consider gender power issues in the design and impact assessment of HIV/AIDS and reproductive health interventions and in challenging male violence.  相似文献

ABSTRACT

The #MeToo Movement both within academia and popular culture has largely been seen as an issue for white women (and men). While the phrase Me Too was originally coined by Tarana Burke in 2006 to raise public awareness of sexual harassment, violence and assault experienced by women of color, the Movement has largely been whitewashed by primarily depicting victims and survivors as white women. Black women academics, like myself, also experience sexual harassment. By highlighting the ways that race-based sexual harassment further marginalizes already underrepresented groups in political science, I use my personal story to elucidate how a gender-only lens misses the complexities of Black women’s experiences with power inequities in academia. Throughout this narrative I underscore the importance of mentorship, professional networks, and the ability to harness scholarship as a vehicle to combat the pervasiveness of sexual harassment, violence, and assault for Black women in political science.  相似文献

This study examined gender attitudes and sexual violence‐supportive beliefs (rape myths) in a sample of South African men and women at risk for HIV transmission. Over 40% of women and 16% of men had been sexually assaulted, and more than one in five men openly admitted to having perpetrated sexual assault. Traditional attitudes toward women's social and gender roles, as well as rape myths, were endorsed by a significant minority of both men and women. Multivariate analyses showed that for men, sexual assault history and rape myth acceptance, along with alcohol and other drug use history, were significantly related to cumulative risks for HIV infection. In contrast, although we found that women were at substantial risk for sexually transmitted infection (STI), including HIV, women's risks were only related to lower levels of education and alcohol use history. We speculate that women's risks for STI/HIV are the product of partner characteristics and male‐dominated relationships, suggesting the critical importance of intervening with men to reduce women's risks for sexual assault and STI/HIV.  相似文献

The main purpose of the current study was to evaluate the relationship between early abusive experiences (sexual abuse, parental violence, and witnessing parental violence) and subsequent couple adjustment with a theoretical model that incorporates attachment and psychological distress as mediator variables. We specifically examined the variability in long-term psychosocial characteristics of child abuse survivors across women and men. A representative sample of French-Canadian couples composed of 632 men and women completed measures of child abuse, attachment, psychological distress, and dyadic adjustment. Structural equation analyses showed that, for both women and men, sexual abuse was related to dyadic adjustment through anxiety about abandonment and psychological distress. For men, experiencing physical or psychological violence was associated with dyadic adjustment through psychological distress. For women, there was an indirect relationship between witnessing physical violence and dyadic adjustment through abandonment anxiety. Differences between men and women in the long-term adjustment to childhood sexual abuse were small and not consistent with a gender-specific model of psychosocial repercussions.  相似文献

The field of sexual assault prevention is shifting attention to educational interventions that address the role of men in ending violence against women. Recent studies document the often-misperceived norms men hold about other men's endorsement of rape-supportive attitudes and behaviors. The authors provide further evidence supporting the design of population-based social norms interventions to prevent sexual assault. Data from this study suggest that men underestimate the importance that most men and women place on consent and willingness of most men to intervene against sexual violence. In addition, men's personal adherence to only consensual activity and their willingness to act as women's allies are strongly influenced by their perceptions of other men's and women's norms. These findings support the proposition that accurate normative data, which counters the misperception of rape-supportive environments, can be a critical part of comprehensive campus efforts to catalyze and support men's development as women's social justice allies in preventing sexual violence against women.  相似文献

This article uses the lens of intersectionality to analyze secondary data gathered by international human rights organizations investigating women’s experiences of sexual violence near Barrick Gold’s mine in the Porgera valley of Papua New Guinea. This case study provides an example of how an intersectional framework can be useful to feminist researchers exploring North–South power relationships in the context of resource extraction, by helping us ask nuanced questions about the benefits and costs of resource extraction in the Global South. In this article, intersectionality helps to trace the transnational relationships of power that shape women’s experiences of violence in Porgera, and Barrick Gold’s remediation policy for survivors. Intersectionality serves as a useful tool to map the systems of power at work in Porgera and to make visible the structural violence implicit in the relationship between Canada and Papua New Guinea created by Barrick Gold’s operation.  相似文献

While men’s sexual violence against women is unarguably a social and public health issue, both nationally representative data and smaller studies tell us that rates for lesbian, gay, bisexual, transgender, and queer+ (LGBTQ+) individuals are equally or significantly higher. Despite this, there remains little structural support for LGBTQ?+?survivors. This article highlights the voices of 38 queer and trans people of color (QTPOC)-identified U.S. Southerners who have experienced sexual violence and came together across three focus groups to detail their interactions with advocates and other professionals and explore posttraumatic needs. Nearly all survivors reported that the level of awareness regarding sexual violence in their communities was limited, with most reporting that they did not successfully access mainstream services, due to concerns about homophobia, transphobia, and racism. To address sexual violence in LGBTQ?+?communities, survivors pointed to the importance of friendship and community networks “outside the system,” knowledge sharing about LGBTQ+-specific violence tactics (e.g., threats of outing a partner), and holding batterers accountable for their behavior within LGBTQ?+?circles. Findings highlight the need to move beyond “culturally competent” health care by proactively engaging LGBTQ?+?communities in education, networking, resource sharing, and anti-violence outreach.  相似文献

Intimate partner violence (IPV) victimization is linked to sexual risk exposure among women. However, less is known about the intersection of IPV perpetration and sexual risk behavior among men. This study used data from a diverse, community sample of 334 heterosexually active young men, aged 18 to 25, across the United States to examine whether and how men with distinct IPV-related behavior patterns differed in sexual risk–related behavior and attitudes. Participants were recruited and surveyed online, and grouped conceptually based on the types of IPV perpetration behavior(s) used in a current or recent romantic relationship. Groups were then compared on relevant sexual risk variables. Men reporting both physical abuse and sexual coercion against intimate partners reported significantly higher numbers of lifetime partners, higher rates of nonmonogamy, greater endorsement of nonmonogamy, and less frequent condom use relative to nonabusive men or those reporting controlling behavior only. This group also had higher sexually transmitted infection (STI) exposure compared to men who used controlling behavior only and men who used sexual coercion only. Findings suggest that interventions with men who use physical and sexual violence need to account for not only the physical and psychological harm of this behavior but also the sexual risk to which men may expose their partners.  相似文献

This article provides a review of research literature on women who use violence with intimate partners. The central purpose is to inform service providers in the military and civilian communities who work with domestically violent women. The major points of this review are as follows: (a) women's violence usually occurs in the context of violence against them by their male partners; (b) in general, women and men perpetrate equivalent levels of physical and psychological aggression, but evidence suggests that men perpetrate sexual abuse, coercive control, and stalking more frequently than women and that women also are much more frequently injured during domestic violence incidents; (c) women and men are equally likely to initiate physical violence in relationships involving less serious "situational couple violence," and in relationships in which serious and very violent "intimate terrorism" occurs, men are much more likely to be perpetrators and women victims; (d) women's physical violence is more likely than men's violence to be motivated by self-defense and fear, whereas men's physical violence is more likely than women's to be driven by control motives; (e) studies of couples in mutually violent relationships find more negative effects for women than for men; and (f) because of the many differences in behaviors and motivations between women's and men's violence, interventions based on male models of partner violence are likely not effective for many women.  相似文献

The ongoing conflict in Darfur has once again served to highlight the threat of sexual violence that women face during times of war. Yet, although sexual violence in wartime has existed probably for as long as war itself, it is only in more recent times that its recognition as a crime under international humanitarian law has taken place. Moreover, although it is recognized that women may conceive as a result of such wartime rape, largely missing from the international rights framework, and from the discourse that surrounds it, is a consideration of the children – or ‘war babies’ – who are born as a result. This article places the focus upon ‘war babies’ by considering the reasons for their current marginalization as a category in international discourse. In addition to examining such marginalization within existing theoretical analyses, this article also analyses the potential for their incorporation within the wider rights framework: first, in terms of international legal practice and; second, in terms of the actions of civil society. This article examines the multi-layered continuities of violence experienced, navigated and narrated by those in the Great Lakes region from the perspective of one life. Drawing on the unfolding life stories of Alex, a sexual minority refugee in Uganda, it focuses upon the complex predicament of persecution and marginalisation of the region’s sexual minorities, as they navigate protracted political conflict, displacement and wider intersecting forms and sources of violence. This article aims to draw attention back to the lived realities of violence as they are interpreted and articulated through time and space in situated acts of speaking. An ethnographic life stories approach compels us to consider the agency of those who navigate complex constellations of intersecting and multiple forms of violence woven through the fabric of everyday life, the social topographies within which people navigate and the wider sociocultural, political and legal dimensions within which they live.  相似文献

Findings from previous studies examining the relation between women’s employment and the risk of intimate partner violence have been mixed. Some studies find greater violence toward women who are employed, whereas others find the opposite relation or no relation at all. I propose a new framework in which a woman’s employment status and her risk of violent victimization are both influenced by the level of control exercised by her partner. Controlling men will actively prevent women from working and are also more likely to physically harm their partners. Using a statistical model in which the effect of omitted characteristics on women’s employment and their risk of violence are allowed to be correlated reverses the estimated association between employment and violence. The final results show that employment reduces women’s risk of violence. Data for the study are drawn from a sample of over 30,000 Mexican women in intimate relationships. The findings have broad implications given the increase in female labor force participation in many parts of the world.  相似文献

In the mid-1990s Mexican states began adopting reforms that for the first time criminalized domestic violence. Two separate policies were also adopted which allowed domestic violence to be grounds for divorce and established prevention and assistance programs for victims of domestic violence. I exploit the variation in time and geography to estimate the impact of these three policies on female suicide rates using a difference-in-difference methodology. The results indicate that states that criminalized domestic violence exhibited a 22–34% decrease in suicide rates compared to non-adopting states, but there is no robust evidence that the other two policies had any impact. A battery of tests provides support for the robustness of these findings and indicates that most of the effects are concentrated among married women. Analysis of a cross-sectional, nationally representative survey covering violence against women in Mexico suggests reduction in sexual and physical violence as a possible mechanism behind the reduction in female suicide rates. These findings are consistent with an intra-household bargaining model with asymmetric information and costly conflict which predicts that policies that reduce conflict within the household can reduce female suicides. The results highlight the importance of developing and implementing policies that facilitate reporting and providing access to legal institutions for victims of domestic violence, which can in turn improve a victim’s wellbeing.

Research on sexual violence and rape during slavery often focuses on the dynamic between white men and black women. However, white women played an important intermediate role in the sexual violence of enslaved black women. Analyzing divorce petitions submitted during slavery, the unique role of white women and their responses to sexual violence carried out by their husbands offer additional depth to the discussion of rape of enslaved black women. Furthermore, this analysis adds to intersectionality theory with the concept of a web of intersectional incentives, tactics, and consequences that encourage the maintenance of oppression.  相似文献

A young girl was brought to the emergency unit after suffering sexual abuse by an older male. Additional abuses against women and girls include physical beating, forced marriage, female genital mutilation, breast ironing, widow’s rites, psychological abuse, and discrimination in education, finance, employment, and legal access. Cameroon has adopted strategies aimed at eliminating violence against women, including ratification of international policies, penal codes, and support of local and international efforts that promote women; however, many of the laws remain in name only and are rarely enforced, given women’s lack of financial access to quality lawyers and an unsympathetic male-dominated police force. Underreporting and culturally accepted abuses remain a challenge, too, as the country seeks to understand the extent of abuses and how to effectively fight against them. A complete paradigm shift in cultural attitude toward the female gender is required for abuses to cease.  相似文献

In this article, I explore the gendered silencing of conflict-related sexual violence against men and of male survivors’ lived realities in Northern Uganda using the frame of masculinities. Utilizing Stauffer’s conceptual framework of “ethical loneliness,” I elucidate how male survivors’ experiences of sexual violence are characterized by various layers of externally imposed silences by different actors and institutions often over decades. I demonstrate that the harms experienced by survivors in Northern Uganda are characterized by silence, isolation and abandonment, “compounded by the cruelty of wrongs not being heard” and constituted through multiple rounds of neglect. Exemplified through the narrative of a male survivor, I argue that in particular, the externally imposed silencing by institutions designed to listen entrenches further harms. I unpack how these layered silences are gendered and conditioned by socially constructed incompatibilities between masculinities and vulnerabilities, which disallow men to openly speak about their sexual violations and to seek services and support. Working with the concept of “ethical loneliness,” I propose a novel theoretical framework for analyzing the effects of externally imposed and gender-specific silencing with wider utility beyond male sexual violence, applicable to survivors of political and wartime gendered violence more broadly.  相似文献
