Objective. Although research suggests that national forces can play a role in local and state elections, most of this work has only recently begun to examine the potential role of national forces in state or local ballot initiative or referenda elections. Methods. Our research addresses this gap in the literature by exploring the influence of national forces, such as the timing of elections, Supreme Court rulings, the activities of interest groups, and public opinion, on state direct legislation elections. We incorporate national forces into the morality politics framework and derive specific hypotheses. We then test these hypotheses by conducting a multivariate analysis of county–level voting patterns across 16 abortion–related direct legislation elections. Results. Our results confirm most of the hypotheses derived from the morality politics framework, including those concerning the role of national forces. Conclusions. Voting patterns on abortion tend to be influenced by the presence of presidential elections, Supreme Court rulings, interest–group activity, public opinion, partisanship, college education, and conservative religious forces. We discuss the implications of our findings for research on elections, abortion policy, and morality politics.  相似文献

Objectives . We develop hypotheses to explain the opinion writing by justices on the U.S. Supreme Court from 1946–1997. Methods . We use data from the U.S. Supreme Court Database, Phases I and II, to examine the proportion of cases in which a justice writes an opinion each term as well as the differences between writing majority, dissenting, and concurring opinions. OLS regression with robust standard errors is the estimation procedure. Results . We find that a justice's position as Chief Justice, professional and education background, reputation ranking, and tenure on the Court can explain a justice's opinion writing. At the same time, we discover that particular variables have different affects on writing majority, dissenting, or concurring opinions. Conclusions . This study demonstrates the importance of both structural and personal background variables in explaining judicial behavior. It also shows the importance of analyzing different kinds of judicial opinions when explaining the justices' opinion writing.  相似文献

Objective. In this article, we investigate the decision of media in the U.S. states to give high‐profile coverage to state supreme court decisions. While research on the U.S. Supreme Court has forged an association between media coverage and the political salience of court decisions, scholars have been unable to examine such coverage in the increasingly important state courts of last resort. Methods. Utilizing new data of high‐profile coverage over time in these courts, we examine the extent to which case characteristics, judicial behavior, and institutional variation influence media attention. Our empirical model covers 28,045 state supreme court cases over all 50 states, between the years 1995–1998. Results. Our findings indicate that the likelihood of high‐profile coverage increases when certain case characteristics, particularly declarations of unconstitutionality, are present, in addition to dissent within a court. Despite the importance of institutional differences among state supreme courts, front‐page coverage is not affected by this variation. Conclusions. In our conclusions, we evaluate those scenarios in which high‐profile media coverage is more likely for state supreme court cases, and the possible implications this may have for judicial politics.  相似文献

Objectives. This study examines the factors that shape public acceptance of homosexuality and support for same-sex marriage across age cohorts.Methods. We analyzed data from two national surveys. We constructed hierarchical logistic and hierarchical ordinary least squares regressions for relevant age cohorts in order to test our hypotheses and explore our research questions.Results. Our models suggest that personal contact has a greater impact on the attitudes of younger respondents, positively influencing public acceptance of homosexuality. Alternatively, religious and ideological predispositions have a greater impact on the attitudes of older individuals. When examining public support for gay marriage, we find that younger individuals have higher levels of deliberative engagement with the issue debate, while older individuals rely more heavily on their predispositions when determining issue stance. Interestingly, measures of media exposure are not significantly related to either public acceptance of homosexuality or support for same-sex marriage, suggesting that other factors may have a greater impact on public attitudes at this point in time.Conclusion. The implications of these findings are discussed in light of the emergence of a new political generation and the continuing struggle for gay civil rights.  相似文献

Prior inconsistencies in studies regarding specific and diffuse support for the U.S. Supreme Court have largely resulted from confusing two related yet distinct concepts: the level of diffuse support at a given moment, and change in the level of diffuse support over time. The results of a panel study show that specific support is related to both concepts but in different ways. Overall approval of the Supreme Court positively influences the level of diffuse support at a given moment. However, an individual's reaction to a particular Court decision is mediated by pre-existing ideological tension between the individual and the Court, and can cause a sudden change in that individual's diffuse support level. Post-stimulus diffuse support regeneration within an individual is related to support for democratic norms, awareness of the Court, and satisfaction with other governmental institutions.  相似文献

Objectives. Our purpose was to develop and test several hypotheses concerning the impact of poll‐question wording on aggregate public support for war. We drew on general insights from framing theory and specific insights from various theories of public support for war. Methods. Our database consisted of two collections of aggregate poll results drawn from the prewar and major combat phases of the Gulf War (1990–1991) and the Second War with Iraq (2002–2003). For each data set, we used multivariate OLS regression to gauge the impact of specific question‐wording variations on the percentage of respondents expressing support for war, controlling for systematic time and pollster effects. Results. Most of the hypothesized wording effects were significant in the expected direction. Mentioning WMDs, terrorism, Saddam, hostages, and international support for war boosted aggregate war support in one or both wars; mentioning the president, oil or gasoline, international opposition to war, and U.S. or Iraqi casualties depressed support. Conclusions. Various theories emphasizing different “rational” aspects of public attitudes toward war are supported. However, the significance of mentioning Saddam by name in the Second War with Iraq, and mentioning the president in both wars, would seem to imply framing effects based more on emotion and/or symbolism.  相似文献

Objective. Few public law theories developed to understand the decision making of U.S. courts have been examined in different cultural settings. This study examines the applicability of the “freshman effects” theory in the context of the Canadian Supreme Court. Methods. The article uses analysis of variance tests to examine changes in the voting and authorship patterns of 15 Canadian Supreme Court Justices during the Laskin, Dickson, and Lamer Court periods (1973–1999). Results. We find very little evidence of acclimation effects on the Canadian Supreme Court. However, through the Chief Justice's power to compose decision panels, Canadian justices in their first full year of service are assigned significantly fewer cases than in subsequent years of their career. Thus, Canadian justices are given time to acclimate to the high court through a lower workload, a luxury not afforded to U.S. justices. Conclusions. Theories of public law adopted to understand U.S. courts may be limited in their generalizability beyond the U.S. setting because of the institutional and political forces that shape judicial decision making in other courts.  相似文献

Objective . A growing body of literature on issue framing has demonstrated the conditional influence of issue frames on self–reported opinion. The effects of frames are conditioned by message content, the medium of communication, and the predispositions of respondents. However, the literature has yet to explore the influence of issue frames on respondents' perceptions of public opinion. We draw from the psychological literatures on cognitive accessibility biases and impersonal impact and construct competing hypotheses concerning the likelihood of issue frames affecting perceptions of opinion. Methods . We test hypotheses using data from an experimental field study that exposed respondents to opposing issue frames on two important issues—reforming Social Security and physician–assisted suicide. Results . Our results largely support the impersonal impact hypothesis. Conclusions . We find that available information from issue frames influences personal–level opinion but in general does not affect perceptions of public opinion. We discuss the implications of these findings and suggest avenues for future research.  相似文献

In an attempt to understand the extent to which racism and sexism influenced affect toward Barack Obama and Sarah Palin, we analyze data from a national survey conducted in October 2008. Situating our investigation in previous examinations of modern racism and modern sexism, we test competing hypotheses about the role of these attitudes in the 2008 presidential election. Our results suggest that racism had a significant impact on candidate evaluations while sexism did not. We find that respondents who hold racist attitudes expressed negative attitudes toward Obama and positive attitudes toward Palin. When interacted with party identification, racism continued to exert a strong effect, indicating findings that are robust across partisan affiliations. Sexism, on the other hand, did not significantly influence evaluations of either Palin or Obama .  相似文献

Using data from a survey, this study investigates how local government employees use the Internet to carry out their day-by-day work. Our survey reports that most employees use the Internet to download information, communicate, and perform routine tasks. Many of them use the Internet for personal purposes at work. We also test seven hypotheses to explore different variables that may explain the Internet use of government employees. The results show that individual acceptance of the Internet, perceived Internet importance to the work group's mission, and employer-provided training and technical support have a significant impact on their Internet usage at work. This note reports our preliminary findings from a large project to study the role and impacts of information technology in public organizations.  相似文献

At present, health policy in the European Union (EU) is being developed in an extremely disconnected fashion. EU member States independently develop their own health systems, based on the goals they wish to pursue, without really considering consistency with European Community (EC) law. The impact of European integration is, in turn, mainly indirect and has emerged from European Court of Justice (ECJ) rulings. These rulings have arisen either from considerations in other sectors or through the process of addressing particular issues within single cases, leaving major issues of applicability unresolved. The evolving issue of free movement of patients is instructive. While not completely outlawing the use of a prior authorization system, recent ECJ rulings have radically restricted member States' discretion to determine their own policies by requiring that their decisions be necessary, proportional and based on objective and non-discriminatory criteria. By linking EEC Regulation 1408/71, on which cover for healthcare abroad has been traditionally based, with the free provision of services, the ECJ seems to have created difficulties and important uncertainties for the system of coordination of social security schemes.  相似文献

Objective. Though there is an extensive literature focused on the participation and efficacy of interest group amici curiae in the U.S. Supreme Court, there is little rigorous analysis of amici curiae in the U.S. Courts of Appeals. Here, we systematically analyze the influence of amicus curiae briefs on U.S. Court of Appeals decision making to provide insights regarding both judicial decision making and the efficacy of interest groups. Methods. We use a probit model to capture influences on appellant success in the courts of appeals from 1997–2002. Results. We find that amicus briefs filed in support of the appellant enhance the likelihood of that litigant's probability of success, but that amicus briefs filed in support of the appellee have no effect on litigation outcomes. Conclusion. Amici can help level the playing field between appellants and appellees by serving to counter the propensity to affirm in the U.S. Courts of Appeals.  相似文献

I have received substantial monetary compensation and a formal apology from my first doctoral school, and a Ph.D. from another university. This essay describes my personal view on discussing the boundaries of academic judgment and research supervision with the ombudsman agency for higher education, and at the High Administrative Court of England and Wales. The Court’s judicial doctrine addresses substantial research accountability matters. It clarifies that although the Court and ombudsman agency must not interfere with academic judgment, not everything done by an academic can be considered as academic judgment. A Ph.D. supervisor can seriously fail to perform his/her duties.  相似文献

We examine the effects of SCHIP enactment by focusing on two policy concerns: take-up and crowd-out. The literature has examined how income eligibility expansions affect the type of children's insurance coverage. However, states jointly implemented various policy instruments. The results in previous works do not control for this variety. We analyze how changes in several SCHIP factors affected decisions regarding health insurance coverage. Our analysis indicates that the estimates in the literature may have combined the effects of various policy factors. In distinguishing individual policy factors, our results provide useful information for designing effective public health insurance programs.  相似文献

In a series of voting rights cases, the U.S. Supreme Court held that race-based redistricting, particularly the intentional formation of majority–minority districts (districts in which voters of color constitute a majority of eligible voters) may be unconstitutional if race was the predominant factor in the formation of the district. The Court stated that "redistricting legislation that is so bizarre on its face that it is unexplainable on grounds other than race" may violate the Constitution because of the messages such districts send to the public ( Shaw v. Reno , 1993 ). Yet neither the Court nor social scientists have examined whether the existence of race-conscious majority–minority districts sends messages to voters and what the nature of these messages may be. This research begins to address this scientific issue. In a quantitative content analysis, we examined messages about racial redistricting conveyed to citizens via the print media. Our sample consisted of 355 newspaper articles about redistricting included in the Lexis–Nexis database between 1990 and 2005. We found that newspaper coverage of racial districting contains messages to citizens about the motives involved in redistricting, the individuals and groups who are responsible for it, and its actual and expected effects. This finding is consistent with the Supreme Court's assumption that districts, particularly bizarrely shaped ones, convey distinct messages to voters. The specific messages communicated varied in important ways across the articles. Newspapers in states subject to Section 5 of the Voting Rights Act because of their history of discrimination against voters of color covered racial redistricting differently than states not subject to Section 5. We discuss the legal and theoretical implications of these findings for understanding the role of race in legislative redistricting efforts.  相似文献

Objectives. Despite the interest that social scientists have displayed in the rising rate of incarceration, little attention has been devoted to understanding its consequences for local areas. This is an important omission because prison construction has become a component of state and local economic development schemes. Indeed, there is a widespread belief that prison construction provides significant economic benefits to local areas. Methods. We analyze data on all existing and new prisons in the United States since 1960 and examine the impact of these prisons on the pace of growth (as measured by public, private, and total employment growth) in U.S. counties from 1969 to 1994. To our knowledge, our study is the first comprehensive and longitudinal assessment of the impact of prison construction on local areas. Results. We find no evidence that prison expansion has stimulated economic growth. In fact, we provide evidence that prison construction has impeded economic growth in rural counties that have been growing at a slow pace. Conclusion. Despite sharp ideological and intellectual differences, the critics and the advocates of the prison construction boom share the assumption that prisons can contribute to local growth, especially in hard‐pressed local areas. This belief flies in the face of mounting evidence that state and local initiatives rarely have a significant impact on growth; this belief is also contradicted by our analyses.  相似文献

In this paper, we examine the impact of macroeconomic, as well public and private health insurance financing (PHI) factors on out of pocket (OOP) healthcare expenditures, by using fixed/random effects and dynamic panel data methodology to a dataset of 26 EU and OECD countries for a period lasting from 1995 to 2013. The existing empirical literature has focused on testing the hypothesis that several macroeconomic and health financing determinants have an effect on OOP healthcare expenditures. Nevertheless, the related articles have not well tested the hypothesis concerning the potential impact of PHI financing on OOP spending. We find that public and PHI financing have a significant countervailing effect on OOP spending. Moreover, we show that unemployment rate has a significant positive impact on OOP expenditures. Sensitivity tests with variation of specifications and samples show that our findings are robust. We argue that policy-makers should give serious consideration to PHI institution; our results indicate that there is an inverse effect on OOP spending. We suggest that our examined countries have to provide financial risk protection to their citizens against OOP payments, rather than only attending health budgetary retrenchments in order to adjust public finances.  相似文献

In 2003, the Supreme Court handed down two landmark decisions regarding the use of affirmative action in higher education. In one case, Grutter v. Bollinger, the Court said it was constitutional to consider race in admissions decisions in order to achieve the educational benefits of a diverse student body. In stark contrast, the Court struck down in Gratz v. Bollinger the University of Michigan's undergraduate admissions policy on the grounds that too much of the decision was based on race. In this research note, we surveyed midwestern and southern institutions of higher education to see how college and university presidents in the Fifth and Sixth federal circuits have sought to implement Gratz and Grutter. We find schools in the Fifth Circuit (southern) do not consider race in admissions decisions and those in the Sixth Circuit (midwestern) utilize race to assemble a student body. We suggest that lower federal court precedent may explain why the midwestern schools consider race but the southern schools do not.  相似文献

This study explores the effects of internal and external factors that encourage plagiarism from the perspective of students. We collected student data from five public sector universities in Anhui Province, China, by randomly distributing survey questionnaires to 250 students, 176 of which were usable. We analyzed the collected quantitative data through multiple regression analysis. Our research results demonstrate that external and internal factors have a great influence on plagiarism. The control behavior and teaching factors have a significantly positive impact on plagiarism, while ICT and web does not have a considerable impact on plagiarism. Among the external factors, a significant positive correlation exists between external stress, pride, and plagiarism; however, no significant relationship exists between academic skills and plagiarism. The article concludes that grade level and enrollment status (full-time or part-time) are inversely correlated to plagiarism, which proves that the higher the academic level, the less the plagiarism behaviors occur. This concept may be due to the fact that the higher the academic level, the stronger the plagiarism constraints might be, which in turn leads to a drastic decrease in plagiarism. Moreover, a negative relationship emerges between enrollment status (full-time or part-time) and plagiarism because part-time students who are committed to employment are less likely to give their full attention to their studies.  相似文献

Objectives. This study combines theories on agenda setting, policy innovation, and policy learning to develop an improved model of state policy change. The case of fetal killing policy change in the states is used to develop a model that incorporates national media attention and the decisions of state courts, in addition to policy learning variables that account for the policy changes of neighboring states and the passage of time. Methods. I test the effect of national media attention, decisions by the courts, and the actions of neighboring states on the likelihood that states will change their fetal homicide policies. Using time‐series cross‐sectional data from 1970 to 2002, the model is tested using logistic regression analysis. In addition to testing the theories mentioned above, control variables in the model include citizen and government ideology and the percentage of state residents who are fundamentalist Protestants. Results. Three of the four research hypotheses are supported by the statistical analysis. The results demonstrate that increased media attention to fetal homicide in a given year increases the likelihood that a state will change its policy the next year. Support is also found for the hypothesis that state court decisions will affect policy change. One of the control variables, government liberalism, is also found to decrease the likelihood that states will change their fetal homicide policies. Conclusions. This study lends insight into why states change their policies by including agenda‐setting variables such as media attention and decisions made by the courts. States do react to the actions of the courts by making changes to policies affected by the decisions.  相似文献
