Litigation is the most prevalent mechanism for comprehensive child welfare system reform. Litigation has resulted in increased funding to child welfare systems. This study assesses the impact of litigation on budgets during and after litigation and the budgets correlation with child outcomes. This mixed methods study analyzes 7 years post-litigation data in 4 state case studies. Individual interviews were conducted with key stakeholders (N = 17) in the lawsuits to determine what impact the lawsuit had on budgets and outcomes. Findings indicate that litigation likely impacts outcomes at least partially through increased financial investments (decreased reunification impacting decreased reentry after reunification and rate served); however, the impact of these outcomes is mitigated because financial investment in child welfare is not sustained.  相似文献

Youth in state custody, regardless of their sexual orientation or gender identity, have federal and state constitutional and statutory rights. These rights guarantee a young person safety in their placement as well as freedom from deprivation of their liberty interest. Many lesbian, gay, bisexual, and transgender (LGBT) youth have these rights violated on a regular basis. Many cases in both the child welfare and juvenile justice contexts have resulted in extensive and time-consuming consent decrees as well as sizable damages awards. Knowledge of a youth's legal rights can help providers avoid legal liability while creating a safer and healthier environment for LGBT youth. This article provides a general overview of the successful federal legal claims that youth in the child welfare and juvenile justice systems have made, discussion of the rights generated as a result, particle application of these rights to the experiences of LGBT youth with hypothetical scenarios, a focus on specific rights that emanate from certain state laws, and a focus on specific concerns of transgender youth.  相似文献

This article argues that England is in the process of introducing a mandatory reporting system, not based on the requirement to report child abuse but on the basis of ‘a cause for concern’ for a child's welfare. It describes Section 12 of the Children Act 2004, which is fundamental to the development, and the rationale upon which it is based. The second part of the article summarizes the key criticisms that have been made of mandatory reporting systems and discusses how these are likely to apply in the English situation. Child welfare workers and agencies are vulnerable to lawsuits. Recent court rulings have more clearly defined the liability of workers. The distinguishing variable is custody. Children injured while in the custody of the state are entitled to sue for damages. Children injured by their parent, even if under the supervision of a child welfare agency, are not entitled to claim a violation of their 14th Amendment rights. These cases are reviewed and strategies designed to minimize vulnerability are offered.  相似文献

Meeting the needs of families involved with the child welfare system because of a substance abuse issue remains a challenge for child welfare practitioners. In order to improve services to these families, there has been an increasing focus on improving collaboration between child welfare, treatment providers, and the court systems. This paper presents the results from qualitative interviews with 104 representatives of these three systems that explore how the collaborative process works to benefit families, as well as the barriers and supports for building successful collaborations. Results indicate that collaboration has at least three major functions: building shared value systems, improving communication, and providing a "team" of support. Each of these leads to different kinds of benefits for families as well as providers and has different implications for building successful collaborative interventions. Despite these putative benefits, providers within each system, however, continue to struggle to build effective collaborations, and they face such issues as deeply ingrained mistrust and continued lack of understanding of other systems' values, goals, and perspectives. Challenges that remain for successful collaborations are discussed.  相似文献

The purpose of this article is to apply Bowen family systems theory to work with families involved in the child welfare system. An overview of family systems theory is provided, and then specific tenets of Bowen family systems theory are presented. The authors highlight incidents within the child welfare setting that can be conceptualized through Bowen family therapy terms and concepts. A case study is used to highlight how this theory could be applied in practice. Furthermore, recommendations for child welfare practice and policy implications are discussed, utilizing the lens of a Bowenian family systems approach.  相似文献

This article examined the application of the Transtheoretical model of behavioral change to the welfare to work transition with public housing residents. Both quantitative and qualitative data were gathered and analyzed to demonstrate that the welfare to work process may indeed be considered a change process. While professional social workers are clearly obligated to pursue social justice, controversies abound surrounding what that means in theory and practice. Perhaps nowhere are the paradoxes inherent in practice for social justice seen in sharper contrast than in the field of child welfare. Intended to protect the rights of children, child welfare systems themselves have been characterized as instruments of oppression. This article hopes to enrich that discourse through an examination of how these issues are conceptualized and acted upon by front-line child welfare social workers. Through in-depth interviews with 25 child welfare workers, and 3 focus groups, in two Canadian provinces, and employing grounded theory strategies for data collection and analysis, we have explored understandings of the social justice mandate and how it is expressed in practice. Participants in this study conceptualized social justice in terms of both wider societal goals of fairness and equality, and of the quality of interactions and relationships between social workers and those with whom they work; conceptual emphasis on one or the other of these we found to be associated with differences in practice. We reflect on the implications of each of these emphases for effectiveness in advancing social justice aims in the child welfare context, and make recommendations regarding a grounding for educators and practitioners in theoretical orientations that includes attention to the linkages between macro and micro opportunities to advance social justice.  相似文献

ABSTRACT

Although rhetoric about family-centered services and breaking the cycle of intergenerational poverty has survived many failed public welfare strategies, few meaningful collaborative efforts between school systems and the public welfare system have emerged. The following case study describes the processes in which a county DSS director successfully engaged the school system to change the educational trajectories of its children in poverty by using the university as a bridge partner. Capitalizing on the freedom associated with using block grant funds for innovative programs, the collaborating partners redefined the relationship between the two systems through a common goal. Successes, barriers, practice implications and lessons learned are identified and discussed in the case example.  相似文献

Children involved in the child welfare (i.e., foster care) system are at a greater risk for numerous negative outcomes in adolescence and adulthood (e.g., lower educational attainment, higher risk for a criminal record). For children in foster care who experience placement disruption (i.e., removed from a foster home and placed in another nonpermanent placement), the risks significantly increase. Informed by the ecological systems model, the authors propose a theoretical perspective to explain the unique aspects of a foster child’s development and discuss how this framework informs child welfare practice and intervention for foster children at risk for placement disruption. This perspective has the potential to provide a framework that has implications for foster caregivers and child welfare professionals and to inform future policies.  相似文献

In current debates about social welfare, the terms public and private are often equated with state vs. nonstate realms. This paper argues that a feminist sociological analysis would reconstitute notions of public and private as forms of social relations that occur in a wide range of activity, thus disentangling them from institutional divisions. It reviews contemporary feminist theory and practice and spells out implications for a feminist sociological theory of social welfare. It uses these implications to look at a particular kind of women’s grassroots voluntary organization that contains possibilities for rethinking societal responses to social welfare needs. Summary

Systems change in child welfare and cross-systems change involving other service sectors are needed in response to two developments: (1) New policy mandates (e.g., TANF, AS FA) and (2) Research on the co-occurring and interlocking needs of many child welfare families. A four-state initiative was structured in response to these needs. Collaborative learning and action research groups called design teams were structured to identify competencies and to develop new service delivery systems. Faculty facilitators representing social work education programs were assigned to these teams and charged with their development and evaluation. Facilitators served as linkage agents for university-communitystate agency partnerships, and they promoted curriculum change. These study reports two sets of findings related to these design teams: (1) Findings from semi-structured interviews of design team members; and (2) Findings from the participatory action research completed by two faculty facilitators. Key themes related to design team processes are presented. Drawing on these emergent themes, components that help explain effective design team processes are identified. Abstract

Government contracting out of responsibilities for the delivery of social services is an increasingly common phenomenon in these times of economic restraint. This paper argues that this practice, with its inherent technical and philosophical problems, negatively affects social service systems and social work practitioners. The resultant changes are described as having serious implications for social work educators, The argument is made that if educators are to remain relevant to the needs of service consumers, social work students, and welfare agencies, they must carefully reconsider aspects of curriculum planning and student placements as well as faculty involvement in research and advocacy.  相似文献

Past research suggests that despite the substantial strengths of Black kin networks, they are not always up to the task of supporting young mothers. This study is an analysis of potential barriers to women‐centered kin support for present‐day urban Black teen mothers and possible implications for kin support mandates specified in the 1996 federal welfare reforms. In‐depth interviews with African American midlife women, who themselves were teen mothers, shed light on their attitudes and perceptions about Black kinship systems and teen childbearing. Study results suggest that these women perceive governmental intervention, age‐condensation among urban Black families, and urban “underclass” culture to have undermined traditional Black intergenerational support.  相似文献

This study uses data on the experiences of families involved with child welfare services to examine the nature of housing problems and needs among these families and whether housing status affects case outcomes. First, the article describes the housing difficulties faced by two distinct child welfare service populations: families receiving voluntary in-home services and families with children in court-ordered out-of-home care. Second, the study demonstrates the relationship between housing problems and the likelihood of family reunification for children in out-of-home care. The findings have implications for the delivery of child welfare services and the provision of housing assistance to low-income families with children.  相似文献

This paper examines the strategies and approaches child welfare agencies used to integrate meaningful family involvement into their service delivery systems, under the Children's Bureau Improving Child Welfare Outcomes Through Systems of Care demonstration initiative. Through a series of retrospective interviews with child welfare agency staff, systems of care project staff, family members actively involved in implementing the systems of care initiative, and local program evaluators, researchers investigated the family involvement planning and capacity building activities of child welfare agencies during the initiative's implementation. Findings indicate that child welfare agencies' capacity building efforts primarily centered on human resource development, focusing on three areas: program staffing, family engagement, and agency buy-in. These findings illustrate the importance of developing the capacity of child welfare agency staff and family members before fully implementing family involvement programs and activities. Although more research is needed to document the impact of family involvement, the lessons learned from these grant communities' experiences provide critical information and can inform development of policies and practices to help child welfare and other child- and family-serving systems promote and implement meaningful and sustainable family involvement.  相似文献

Various forms of family team meetings have been increasingly employed in child welfare systems to empower families and provide effective individualized services through community partnerships. However, many family team meetings often fail to achieve their intended goals mainly due to ongoing challenges that team members face. Using data from a survey of caseworkers, this study examined dynamic processes of family team meetings to improve child welfare service outcomes, specifically focusing on caseworkers' perceived challenges. Also, responses to an open ended question were reviewed using content analysis to identify similar or different challenges encountered by diverse team members. Survey data were analyzed using path analysis and found that logistical barriers tended to decrease both family and stakeholder engagements, which in turn made child welfare services less accessible, less utilized, and less effective for children and families. Content analysis revealed that caseworkers perceived disagreement/conflict and knowledge deficits about child welfare as common challenges for all team members. This paper concludes with practice implications suggesting ways to minimize challenges identified and maximize the effectiveness of a family team meeting.  相似文献

This paper reports on an Anglo-French project comparing parental experiences of child welfare interventions in both countries; it does not aim to discuss policy implications but to raise questions about the basis on which policies are decided. We explored differences and similarities in the two countries' systems and practices by asking what it is like to be on the receiving end of professional decisions and actions in order to highlight those aspects of our own system that might otherwise be taken for granted. Considerable overlap was found in English and French parental concerns and in the type of professional assistance offered. However, differences in access to this assistance suggest that parents in England are often thrown into relations with social services that may be counterproductive to child and family welfare.  相似文献

It is argued that the question of social welfare is a key, if often overlooked, component in the construction of power relations and identities in later life that can take its place next to debates on bioethics and consumer lifestyle. Foucault's (1977) claim, that identities are kept in place through the deployment of integrated systems of power and knowledge and a routine operation of surveillance and assessment, is critically examined in this context. Trends in social welfare in the United Kingdom are used as a case example that sheds light on wider contemporary issues associated with old age. Finally, implications for the creation of particular narratives about later life are discussed and grounded through Foucault's (1988) notion of "technologies of self."  相似文献

Thirty-five caregivers of related children who were in the custody of the child welfare system were interviewed individually or in focus groups as the state child welfare system implemented new federal and state policies encouraging these caregivers to adopt or assume guardianship of the children in their care. Interviews were transcribed and analyzed using qualitative methods. Issues of concern included emergency entrance into caregiving; the simultaneous satisfaction and burden of caregiving; obstacles to caregiving, adoption, or guardianship; complex changes in family dynamics following placement of children; sources of support; and caution regarding adoption or guardianship. The caregivers also offered recommendations for the child welfare system. Policy, practice, and research implications are discussed.  相似文献
