如何划分宪法赋予公民的言论自由权利与网络时代言论型犯罪的界限,是当下司 法实务面临的重要问题。在言论型犯罪的构造中,应纳入事实与观点二分法、公事 与私事二分法、客观真实与主观真实二分法,将合理确信规则下的”主观真实”作为 踲法阻却事由;基于网络媒介的科技特点与社会属性,网络服务提供者只具备中立义 务,对之不应简单地以共犯理论或不作为犯罪理论予以入罪。在言论型犯罪的诉讼 中,原则上须根据实际或推定的被害人意愿来启动刑事诉讼程序,当言论行为严重危 害社会秩序和国家利益且被害人无法表踡其是否告诉意思时,可直接蹇用公诉程序; “严重危害社会秩序和国家利益”等入罪基准须是现实物理的秩序混乱,且行为人要 对其有故意而无任何正当目的。对跷微言论犯罪不应跷易蹇用有期徒刑的刑罚;信息 网络工具具有很大的生活用途,一般不应没收。  相似文献

在古代中国, 在夏商周时期的上古社会, 邦君与贵族领地或采邑之间的某种隶属 关系并不等于秦汉以后郡县制下中央与地方的那种具有行政级别的行政管理关系。那 种只有具有四级聚落等级形态才表示国家已形成的理论是有局限性的, 它并不能说明 国家是否产生这一问题的实质, 因而也不应作为衡量的标准。将聚落考古学与社会形 态学结合起来研究古代国家和文明的起源, 固然要对聚落的等级做出划分, 同时还必 须对史前社会组织、等级、阶层、阶级的产生、权力性质的演变等因素进行多方面的 考察。因此, 将阶层阶级的出现和凌驾于全社会之上的强制性权力的设立作为国家形 成的标志是最具特征性的, 而且在考古学上可以找到其依据和物化形式, 因而具有可 操作性。

In ancient China, in Xia, Shang and Zhou society, the relationship of subordination between the head of a state and the territories or fiefdoms of the nobles was not equivalent to the administrative relationship between the central government and the localities under the system of prefectures and counties introduced in Qin and Han times. Any theory of state formation based solely on a four-tiered settlement hierarchy is limited; it fails to explain the essential question of whether a state has come into being, and thus cannot be regarded as a criterion for judgment. It is true that in integrating settlement archaeology with social morphology in research on the origins of the ancient state and civilization, we need to classify settlement hierarchies. At the same time, however, we still need to conduct extensive research into the appearance of prehistoric social organizations, hierarchies, strata and classes, as well as the evolution of the nature of power, etc. Therefore, it is the emergence of strata and classes and the establishment of a coercive power that stands over and above society that are the most characteristic indicators of state formation. Further, we can provide archaeological grounds and materialized forms for this approach, which thus possesses operability.  相似文献

国家、市场与传统文化是构成性别话语的三个基本要素。从改革开放前30年到后30年,中国社会的性别话语发生了明显转型,由国家主导的“泛政治化”模型转变为市场导向的“泛市场化”模型。市场化一方面改变了国家话语的叙述方式和内容,另一方面也导致了市场话语和传统话语的结盟。转型后的性别话语本质上是一种素质话语,它不再表现为一种由国家建构的、在实践中打了折扣的意识形态意义上的平等神话,而是表现为一种在现代性和个体自由的诉求中利用国家、市场和传统文化的各方力量平衡做出主体选择的精打细算的应对策略。

State, market and traditional culture are the three fundamental elements constructing gender discourse. The three decades before the initiation of reform and opening up in 1978 and the three after have witnessed a clear transition in gender discourse in Chinese society, from state‐dominated pan‐politicization to a pan‐marketization orientation. Marketization has changed the content and form of state discourse and led to an alliance of market discourse with traditional discourse. The changed gender discourse is essentially a discourse of quality, one that is no longer presented as an ideological myth of equality constructed by the state and discounted in practice but as a set of deliberate response strategies which are adopted to make independent choices balancing the three forces of the state, the market and traditional culture in the midst of appeals for modernity and individual freedom.  相似文献

当代中国国际法学的话语体系, —方面, 必须准确、系统、全面表达和传递国际 法基本原则、基本制度和本质特征以及国际法研究过程中逐步确立和发展起来的核心 价值、基本概念、关键术语、主流的理论或学说、具有代表性的观点等基本要素;另 —方面, 应充分、及时体现中国对国际法、国际法学和国际法学话语体系所作出的创 造性贡献。当代中国国际法学话语体系的构建应以 “构建和谐世界”为指导理念, 应 全面顾及国际法治和中国外交政策及其实践的国内、多边、区域和双边等四个基本层 面, 应遵行、符合或顺应国际关系和国际法的基本准则, 全球化与多边主义、区域— 体化与区域主义、国际共同体义务(或权利)和中国和平发展需要等原则、规律或趋势, 应将其基本功能定位为: 推动当代国际法的不断发展和广泛适用, 促进当代国际法的教学、研究和传播, 推进中国的法治进步, 维护中国利益、尤其是国家的核心利 益并提升中国作为负责任大国的国际形象与地位。

The contemporary construction of Chinese international law discourse, on the one hand, ought to precisely, systematically and completely express and communicate fundamental principles, main regimes and substantial features of international law as well as core values, basic conceptions, key terms, mainstream theories or doctrines and representative views gradually established and developed in the study of international law; on the other hand, it should fully and in a timely way manifest China’s creative contributions to international law and its discipline and discourse. The framework of contemporary Chinese international law discourse should take “building a harmonious world” as the guiding rationale; thoroughly cover the four basic dimensions of the international rule of law and Chinese foreign policy and its practice, namely domestic, multilateral, regional and bilateral; coincide with, follow and respect those rules, natural laws and tendencies such as fundamental rules governing international relations, globalization, multilateralism, regional integration and regionalism, the international community’s obligations (or rights) and China’s needs for peaceful development. It should orient its basic functions toward promoting the continuous development and wide application of contemporary international law as well as its teaching, study and dissemination, stimulating the progress of the rule of law in China, protecting Chinese interests, especially those core national interests, and strengthening China’s international image and status as a responsible big country.  相似文献

中国当代文学阅读层面上的价值认同正在经受前所未有的挑战。特别是新世纪以 来,新的写作群体、写作方式不断涌现,使固有的理论批评体系遭到撞击、被撕裂, 从而导致理论批评不时出现失语现象。随着网络文学的迅猛发展,非主流文学在阅读 与消费环节中的影响日益增强,这就使得上述问题转化成了新的矛盾——互相不能包 容的阅读隔膜。十多年来,网络上产生了海量的小说文本,逐渐形成了二十多种类 型;本文兼顾时间跨度和创作类型,遴选了十年中不同类型的十部佳作,并针对它们 区别于纸质媒体的艺术审美和创作特点进行了述评。

At the level of the reading of contemporary literature, value identity in China is facing unprecedented challenges, particularly in the new century. New groups of writers and new writing styles are constantly springing up and existing theoretical criticism has been attacked and torn apart, with the result that it has often lost its voice. With the rapid growth of online literature, the influence of non‐mainstream literature in the domain of literary reading and consumption is increasing. Consequently, the above‐mentioned problem is evolving into a new contradiction, i.e. a lack of mutual understanding and tolerance with regard to reading. In the past decade, an enormous number of novels have come out online, falling into over twenty categories. This paper takes into account both chronology and type of writing in selecting for review ten outstanding works of different genres from the last decade, stressing the aesthetic qualities and distinctive styles that differentiate them from their print counterparts.  相似文献

迄今为止,中国现代文学研究已取得了举世瞩目的成就,但趋于“饱和”的状态 也使其陷入了举步维艰的境地。因此,寻找新的学术增长点就变得异常重要和紧迫。 “书法文化”与“中国现代作家”的关系,几近是一个研究空白,以往很少引人注 意,这是令人遗憾的。事实上,许多中国现代作家都与书法文化有着不解之缘,他们 在书法收藏、书法创作、书学探讨上都做出了重要贡献;反过来,书法文化也对现代 文学的存在方式、文本形式、情感表达、思维方式以及审美趣味等产生了深刻的影 响。另外,通过对书法文化与中国现代作家关系的考察,还可引发我们进一步深入思 考文学、书法、文化、教育等相关问题,以便有助于新世纪的中国文学和文化获得更 大的发展空间。

Research on modern Chinese literature has achieved results that have attracted wide attention. However, its state of near “saturation” has placed it in a dilemma with no clear way forward. Finding new academic growth points has become exceptionally important and urgent. The relationship between the “culture of calligraphy” and “modern Chinese writers” is virtually a research blank and has so far attracted regrettably little attention. In fact, many modern Chinese writers have had close ties with calligraphy, making important contributions to its collection, creation and scholarly exploration. Conversely, the culture of calligraphy has exerted a profound influence on such things as the mode of existence, textual forms, emotional expression, ways of thought and aesthetic tastes of modern literature. Moreover, an examination of this relationship may stimulate us to reflect more deeply on literature, calligraphy, culture, education and related issues, which may help us gain a larger space for the development of Chinese culture and literature in the new century.  相似文献

中国正处于社会转型期, 社会矛盾和利益纠纷呈高发态势, 通过厉行法治, 保证 行政权正确行使, 是预防、减少和妥善应对社会风险的良策。由于行政诉讼在制度架 构方面的缺陷, 其制度功能发挥并不充分。设置行政公诉制度, 应当成为完善行政诉 讼制度的一个重要选择。它具有监督和促进依法行政、引导市民社会生成、化解社会 矛盾等多方面的价值, 也是完善中国特色检察制度的应有之义。建立行政公诉, 应当 从理念和制度建构等不同层面予以设计。

Since China is now in a stage of social transition that displays a high occurrence of social conflict and interest disputes, strict adherence to the rule of law and ensuring the correct exercise of administrative power is the best strategy for preventing, reducing and properly managing social risks. Structural defects have meant that the institutional function of public prosecution has not been given full rein. The establishment of administrative public prosecution should thus become an important option for the improvement of administrative legal proceedings. It would have value in a multitude of ways, including monitoring and promoting the exercise of administrative functions according to law, guiding the creation of civil society, and resolving social conflicts, and it is also a necessity for the improvement of China’s procuratorial system. The establishment of administrative public prosecution should be designed at the conceptual level, the institutional level, and so on.  相似文献

Drastic economic and social transition, emerging social problems, and emphasis of the Chinese government on social harmony as a national policy have created ample opportunities for the development of social work as a profession in the Chinese mainland1 1. In this paper, China refers to the Chinese mainland. in recent years. Besides the phenomenal expansion of social work education, the Chinese government announced a series of national policy initiatives in 2006 to professionalize social work and to assess the professional standard of social welfare personnel. But these achievements would never be possible without the commitment, perseverance and active engagement of the social work community during the past two decades to foster the development of social work in China. In this paper, the authors will present the four stages of development which the social work profession has undergone in China, and will discuss the role of human agency in facilitating institutional transformation and structural change in the process. The active agency of members of the social work community, including educators, Civil Affairs officials, and front‐line practitioners to resist the domination of environmental constraints and to co‐construct a social work profession which is appropriate to the Chinese context will be presented.

快速城市化的中国处于建构城市意义、城市秩序的关键期。城市是一个空间有机 体,是人类文明要素的空间化有机聚集;城市意义是城市有机体的伦理纽带,一个没 有意义归属的城市将充满风险、冲突频发。在建构城市物质形态的同时,使城市整合 为一个有秩序的意义共同体,是实现城市可持续繁荣的内在要求。重构城市空间,从 城市物性空间、社会空间、心理空间的整合性与互动性出发,建构合理的“空间—伦 理生态”,是建构城市秩序的重要现实路径;以社区、社会组织等为载体,合理推进 以意义为纽带的集体行动,是建构城市秩序的重要伦理选择。

Rapidly urbanizing China is at a critical period in the construction of urban meaning and order. The city as an organic compound of space represents the organic integration in space of the elements of civilization, while its meaning provides the ethical ties that link these elements to form an organic whole. A city without a locus of meaning will be buffeted by risks and confrontations. The realization of sustainable urban prosperity requires the integration of the city as an ordered community of meaning at the same time as its physical forms take shape. An important practical path to achieving this aim is restructuring city space in a rational “spatial‐ethical ecology” based on integrity and interaction of physical, social and psychological urban space, by means of collective action knitted together by meaning and carried out by communities and organizations.  相似文献

1949年后在妇女就业知识上存在着三种主流话语。一是计划经济时代,妇女就业知识以“革命话语”来叙述,实现了对妇女参加公共领域劳动的动员;二是从计划经济向市场经济转型的过程,妇女就业知识是以“素质话语”被叙述的,其在力图将妇女推回家庭领域的过程中压低了女性劳动力的价格;三是市场化时代,妇女就业知识以“男性强势话语”被表述,显示了市场经济与父权制的有机结合。与此同时,有关妇女就业知识的女性主体性也在形成,它显示出女性自主意识及其对人权话语的使用。

There have been three types of mainstream discourse relating to public understanding of women's employment since the founding of the People's Republic of China in 1949. The first was the “revolutionary discourse” that dominated the era of the planned economy. During this period, knowledge about women's employment was heavily influenced by revolutionary discourse, and women were mobilized to take up positions in virtually all areas of social life. The second occurred in the transition from a planned to a market economy. During this process, knowledge of women's employment was constructed by a so‐called “quality discourse,” which depressed women's wages in the course of driving them back into the home. The third important mode of discourse took place in the era of marketization, and saw knowledge about women's employment constructed by male‐centered hegemonic discourse in an organic union between the market economy and the patriarchal system. Meanwhile, female subjectivity in regard to knowledge about women's employment is taking shape. At the same time, women's sense of autonomy in relation to understanding of employment has started to grow and exhibits self‐awareness and use of the discourse of human rights.  相似文献

过去数十年来, 多元性的文化、社会和政治图景演变甚巨; 然而我们却仍未找到 一种话语来描述、界定、理解、解释和研究当代世界的超级多元性。关于多元性的社 会思想和政治行动大多受制于民族主义方法论和多元文化主义框架; 然而, 对此应该 提出质疑。和民族主义方法论相对的世界主义方法论, 是观察多元性问题富有前景的 视角。另外, 对规范的、哲学意义上的“世界主义”和作为一种结构现象及社会科学 研究项目的“世界化”进行区分是非常必要的。我们可以把哲学及规范意义上的世界 主义与世界性社会科学结合起来, 构建一种世界性的现实主义。

Over the last decades the cultural, social and political landscapes of diversity are changing radically, but we do not even have the language through which contemporary superdiversity in the world can be described, conceptualized, understood, explained and researched. Many of the social thoughts and political actions on issues of diversity are now dominated by methodological nationalism and multiculturalism which, however, have to be called into question. As opposed to methodological nationalism, methodological cosmopolitanism is a promising lens through which to look at questions of diversity. And it is essential to draw an essential distinction between “cosmopolitanism” in a normative philosophical sense and “cosmopolitanization” as a structural phenomenon and as a social scientific research programme. Philosophical and normative cosmopolitanism can be combined with cosmopolitan social science to create a cosmopolitan realism.  相似文献

本研究采用符号学分析法,分析了《中国妇女》、《家庭》、《女友》、《时尚·Cosmopolitan》四本中国女性杂志刊载的五个当代中国女性人物故事,得出铁姑娘、贤内助、时尚女三种女性形象类型。检视这三类女性形象的深层意义,可以发现它们事实上蕴含了传统父权社会对女性片面价值观的社会迷思;同时,它们也在鼓励女性参与父权体制建构的消费主义意识形态。

This study conducts a semiotic analysis of five stories about contemporary Chinese women presented in four women's magazines, namely Women of China, Family, Girlfriend and Trends Cosmopolitan, and identifies three images of women: iron girl, understanding wife and stylish woman. A closer examination of these three images will reveal that they actually contain prejudicial social myths of women held by traditional patriarchal society and that they play an important role in encouraging women to practice the consumerist ideology constructed by the patriarchal system.  相似文献

“Chinese values” is a concept defined in relation to “American values,” “Asian values” and the “Washington Consensus.” It is a product of the long-term development and evol ut ion of Chi nese soci et y’s val ue syst em and const it ute s the c onc ept ua l representation and theoretical enhancement of the complexity of current Chinese values. We analyze the historical formation, evolutionary logic, pluralistic framework, underlying reasons, and inner grounds of present day China’s complex values in a multi- dimensional context that involves history and the present as well as China and the world, looking at the synchronous coexistence in modern China of diachronic conflicts that unfolded over several hundred years in the course of Western modernization. Our contention is that present day China’s complex value reality and value concepts should be approached by using complex ideas and techniques. In the dynamic process of integrating manifold clues and multiple changes, we will vigorously safeguard “Chinese interests,” reasonably fulfill “China’s responsibilities,” consciously seek a “Chinese path,” soberly respond to “expectations of China,” consciously break down “China’s problems” and appropriately demonstrate “China’s confidence,” in order to better perform the positive function of philosophy and social sciences in interpreting and guiding the development of society.  相似文献

在社会公正问题的大讨论中﹐ 罗尔斯、诺齐克、哈耶克、麦金泰尔等当代西方思 想家的论述被反复引用和申说﹐ 而将马克思恩格斯等经典作家的观点置于一种被忽视 甚至被忘却的状态。形成这种状态的原因是多方面的。对历史背景和语境不作具体的 分析﹐就难以把握马克思恩格斯对于社会公正问题的真实态度和精神实质﹐ 甚至会 得出他们不仅没有关于社会公正的理论﹐ 而且反对和拒斥从社会公正角度讨论问题 的结论。马克思主义作为无产阶级认识和改造世界、求得自身解放和人类解放的世 界观和方法论﹐ 是真理与价值相统一的理论﹐ 也只有从科学向度与价值向度辩证统 一的角度﹐ 才可能对作为价值之一种表现的公正问题作出合理的理解。公正既是一 种价值观念﹐ 具有评价标准的功能﹐ 也是实际的价值(包括利益、机会、权利等)分 配的一种状态﹐ 其中会涉及自由与平等的矛盾、形式公正与实质公正的矛盾、一般 与特殊的差别、平等与效率的抵牾、公正与不公正的对立﹐ 等等﹐ 只有运用辩证思 维的方法﹐ 才能对其复杂性获得正确的认识。

In the wide ranging discussion of social equity issues, the theories of contemporary Western thinkers such as Rawls, Nozick, Hayek and MacIntyre are repeatedly cited and expounded. By contrast, for various reasons, classical writers like Marx and Engels have been overlooked or even forgotten. Without a concrete analysis of their historical background and context, it is hard to grasp the true attitude and spiritual essence of the views of Marx and Engels on social equity. We might even conclude not only that they had no theory of social equity but that they opposed and rejected approaching questions from this angle. As a world view and methodology enabling the proletariat to know and transform the world and liberate themselves and mankind, Marxism is a theory that unites truth and value. A rational understanding of the issue of equity as an expression of value is only possible when the dimensions of science and value are dialectically combined. On the one hand, equity is a value concept that functions as a standard for evaluation; on the other, it refers to an actual state of values distribution (including interests, opportunities and rights) that inevitably involves the contradiction between freedom and equality and between formal and substantive equity, the difference between the general and the specific, the conflict between equality and efficiency, the opposition between equity and inequity and so on. Only a dialectical mode of thinking can ensure a correct understanding of the complexity of social equity issues.  相似文献
