与古代希腊、罗马及日耳曼不同, 中国古代国家起源走的是一条构建和谐的道 路, 即没有打碎氏族制度, 而是在普遍存在的氏族组织的基础上滥觞国家的萌芽, 国 家与氏族长期并存而使早期国家完善与发展。氏族制度的长期存在和发展, 这一古代 中国独具特色的社会结构是和谐构建之路的深厚社会基础。古代中国早期国家构建过 程中, 十分关注各个氏族、部落的情、义、利、患等问题。这种关注与社会实践成为 构建和谐的基石, 也是那个时代的领导者成功的标识。直到古代中国早期国家成熟 时, 还能够看到构建和谐理念的痕迹。

Unlike the ancient Greek, Roman and German states, ancient Chinese states took a path of harmonious construction which did not involve abolition of the clan system. It was on the basis of the existing clan organization that the first shoots of the state sprouted, and the state and the clans underwent a long coexistence which allowed the early state to develop and be perfected. The unique social structure of ancient China—the long existence and development of the clan system—was the underlying social foundation for harmonious construction. The early Chinese states were much concerned with the feelings, opinions about right and wrong, advantages and calamities of the clans and tribes. This concern and social practice was the foundation stone for harmonious construction, as well as the benchmark for success for the leaders of the time. Traces of the idea of harmonious construction are apparent up to the full development of the early state in ancient China.  相似文献

观察国际和外交问题的视角与观念变化,是中华人民共和国外交史研究中尚需探讨和梳理的课题。在新中国成立后的前30年,中国外交深受在革命过程中形成的外交观念的影响。其基本诉求是建立新型外交关系,核心观念是独立自主与和平,外交政策的基石是和平共处五项原则;此外,国际统一战线策略,对现实世界的战略划分,以及对战争、和平与革命的思考亦对这一时期的外交政策具有重大影响。自20世纪70年代末实行改革开放以来,中国外交转以发展为视角,配合国家经济建设这一中心任务,做出一系列战略和政策调整。中国对国际形势作出和平与发展的新判断,对独立自主的和平外交政策作了新诠释,致力于建立均衡的对外关系,主张以渐进方式推动国际秩序的改进,决心走和平发展道路。中国由此成为现存国际秩序的参与者和建设者。进入21世纪,中国成为令世界瞩目的新兴大国,外交观念也在继承以往的基础上与时俱进。中国强调当代世界是命运共同体,谋求与各国的合作、共赢  相似文献

如何划分宪法赋予公民的言论自由权利与网络时代言论型犯罪的界限,是当下司 法实务面临的重要问题。在言论型犯罪的构造中,应纳入事实与观点二分法、公事 与私事二分法、客观真实与主观真实二分法,将合理确信规则下的”主观真实”作为 踲法阻却事由;基于网络媒介的科技特点与社会属性,网络服务提供者只具备中立义 务,对之不应简单地以共犯理论或不作为犯罪理论予以入罪。在言论型犯罪的诉讼 中,原则上须根据实际或推定的被害人意愿来启动刑事诉讼程序,当言论行为严重危 害社会秩序和国家利益且被害人无法表踡其是否告诉意思时,可直接蹇用公诉程序; “严重危害社会秩序和国家利益”等入罪基准须是现实物理的秩序混乱,且行为人要 对其有故意而无任何正当目的。对跷微言论犯罪不应跷易蹇用有期徒刑的刑罚;信息 网络工具具有很大的生活用途,一般不应没收。  相似文献

中国社会心理学在面对急速的社会变迁中,需要以变迁与文化的视角来选择研究 问题,而中国社会文化中群己关系的社会心理机制,即“我们”概念的形成机制及其 转换的可能与条件,正是一个体现着双重视角的基本问题。对这一问题的探讨不仅有 助于解释社会凝聚力、群体行动的逻辑,讨论国家与个人、社会与个人、类别与个人 的关系;也有助于培植社会转型时期的社会心理资源和社会支持系统,从而促进社会 合作。与以往单一机制的分析框架不同,通过对两个个案的讨论,研究提出了一个 新的分析框架,即:中国人“我们”概念是在社会情境的启动和价值取向等因素影响之 下,经由相互交织的“关系化”与“类别化”双重过程形成的。

Faced with rapid social transformation, the discipline of social psychology in China needs to choose its research topics from the perspective of both change and culture. A basic issue reflecting precisely these two perspectives is that of the formation of the social psychology mechanism of individual‐group relations, namely the formation of the concept of “us” in Chinese society and culture, as well as the possibility and conditions for the transformation of this mechanism. Exploring this issue will not only help us to understand social cohesion and the logic of group behavior and to discuss the relationship between the state and the individual, society and the individual, and the category and the individual; it will also help cultivate social psychology resources and support systems at a time of social transition, and thus promote social cooperation.. Unlike previous analytical studies that focused on a unitary mechanism, this study uses the discussion of two cases to put forward a new framework for analysis: that is, the Chinese concept of “us” comes into being through the mingling of “guanxilization” and “categorization” under the influence of social context priming, value orientation and other factors.  相似文献

The new project-centered system of governance has encouraged the formation of hierarchical central-local governance mechanisms, leading to a number of unforeseen outcomes for grassroots society. 作为“权利”的学术话语权,主要有创造更新权、意义赋予权、学术自主权等类 型;作为“权力”的学术话语权,主要有指引导向权、鉴定评判权、行动支配权等类 型。这些也体现在中国社会学百余年的发展历程中。在中国社会学初创阶段,严复等 人在社会学本土化和学术话语创新方面进行了尝试。费孝通经历了中国社会学前期发 展阶段近20年及后期56年全过程,其学术历程对于中国社会学发展史具有典型意义。 在理论自觉基础上努力达致学术话语权的制高点,是中国社会学从世界学术格局边陲 走向中心的一条必由之路。

As a kind of right (quanli 权利), academic discourse rights include the right to create and innovate, to endow with meaning and to academic autonomy. As a kind of power (quanli 权力), it refers to the power to guide, judge, control and so on. These rights and powers have been pursued as Chinese sociology developed for over a century. At the inception of sociology in China, Yan Fu and other scholars experimented with localizing sociology and innovating academic discourse. Fei Xiaotong’s life covered nearly 20 years of Chinese sociology’s early development and another 56 years of its later development; his academic journey epitomizes the historical development of Chinese sociology. The only way for Chinese sociology to move from the periphery of world academia into the center is to endeavor, on the basis of theoretical self-consciousness, to seize the commanding heights of academic discourse rights.  相似文献

应用经济学方法研究儒家孝道思想对古代社会经济增长的影响机制, 可以发现, 在信贷市场极不完备的古代, 孝道作为一个独特的代际契约履约机制, 能在一定程度 上克服代际契约中的证实和承诺问题, 从而以一种增加储蓄的方式有效促进古代社会 的经济增长。然而, 实施和维持孝道却不完全是自发的, 需要来自统治者的干预。而 对于统治者来说, 他需要将资源在配置给生产和配置给战争之间权衡。这一权衡决定 了一个社会均衡的孝道水平。通过比较中原文明、匈奴游牧文明和罗马文明的历史, 证明了上述观点, 从而在一定程度上解释了东西方文明的差异。

This paper employs an economic approach to analyze the influence of Confucian filial piety on economic growth in ancient China. In the highly imperfect credit market of the time, filial piety, as a unique mechanism for fulfilling intergenerational contracts, could to some extent solve problems of verifiability and commitment and thus effectively promote economic growth by increasing savings. However, the implementation and maintenance of filial piety were not spontaneous; it required external intervention by the rulers. Rulers faced a tradeoff when allocating resources between production and war. It was this tradeoff that determined the level of filial piety in society. A comparison between the civilizations of the Central Plains, nomadic Xiongnu society and ancient Rome verifies our proposition and thus explains in some degree the difference between Eastern and Western civilizations.  相似文献

国家、市场与传统文化是构成性别话语的三个基本要素。从改革开放前30年到后30年,中国社会的性别话语发生了明显转型,由国家主导的“泛政治化”模型转变为市场导向的“泛市场化”模型。市场化一方面改变了国家话语的叙述方式和内容,另一方面也导致了市场话语和传统话语的结盟。转型后的性别话语本质上是一种素质话语,它不再表现为一种由国家建构的、在实践中打了折扣的意识形态意义上的平等神话,而是表现为一种在现代性和个体自由的诉求中利用国家、市场和传统文化的各方力量平衡做出主体选择的精打细算的应对策略。

State, market and traditional culture are the three fundamental elements constructing gender discourse. The three decades before the initiation of reform and opening up in 1978 and the three after have witnessed a clear transition in gender discourse in Chinese society, from state‐dominated pan‐politicization to a pan‐marketization orientation. Marketization has changed the content and form of state discourse and led to an alliance of market discourse with traditional discourse. The changed gender discourse is essentially a discourse of quality, one that is no longer presented as an ideological myth of equality constructed by the state and discounted in practice but as a set of deliberate response strategies which are adopted to make independent choices balancing the three forces of the state, the market and traditional culture in the midst of appeals for modernity and individual freedom.  相似文献

在社会公正问题的大讨论中﹐ 罗尔斯、诺齐克、哈耶克、麦金泰尔等当代西方思 想家的论述被反复引用和申说﹐ 而将马克思恩格斯等经典作家的观点置于一种被忽视 甚至被忘却的状态。形成这种状态的原因是多方面的。对历史背景和语境不作具体的 分析﹐就难以把握马克思恩格斯对于社会公正问题的真实态度和精神实质﹐ 甚至会 得出他们不仅没有关于社会公正的理论﹐ 而且反对和拒斥从社会公正角度讨论问题 的结论。马克思主义作为无产阶级认识和改造世界、求得自身解放和人类解放的世 界观和方法论﹐ 是真理与价值相统一的理论﹐ 也只有从科学向度与价值向度辩证统 一的角度﹐ 才可能对作为价值之一种表现的公正问题作出合理的理解。公正既是一 种价值观念﹐ 具有评价标准的功能﹐ 也是实际的价值(包括利益、机会、权利等)分 配的一种状态﹐ 其中会涉及自由与平等的矛盾、形式公正与实质公正的矛盾、一般 与特殊的差别、平等与效率的抵牾、公正与不公正的对立﹐ 等等﹐ 只有运用辩证思 维的方法﹐ 才能对其复杂性获得正确的认识。

In the wide ranging discussion of social equity issues, the theories of contemporary Western thinkers such as Rawls, Nozick, Hayek and MacIntyre are repeatedly cited and expounded. By contrast, for various reasons, classical writers like Marx and Engels have been overlooked or even forgotten. Without a concrete analysis of their historical background and context, it is hard to grasp the true attitude and spiritual essence of the views of Marx and Engels on social equity. We might even conclude not only that they had no theory of social equity but that they opposed and rejected approaching questions from this angle. As a world view and methodology enabling the proletariat to know and transform the world and liberate themselves and mankind, Marxism is a theory that unites truth and value. A rational understanding of the issue of equity as an expression of value is only possible when the dimensions of science and value are dialectically combined. On the one hand, equity is a value concept that functions as a standard for evaluation; on the other, it refers to an actual state of values distribution (including interests, opportunities and rights) that inevitably involves the contradiction between freedom and equality and between formal and substantive equity, the difference between the general and the specific, the conflict between equality and efficiency, the opposition between equity and inequity and so on. Only a dialectical mode of thinking can ensure a correct understanding of the complexity of social equity issues.  相似文献

The logic of proponents of progressive abolition of the death penalty is that although it is illogical and inhumane, it remains rational in today's China because of our national circumstances and level of civilization. This is a contradiction in terms. What is illogical should be abandoned. It is spiritual self‐abuse for intellectuals to run together the repeal of the death penalty and traditional culture, our current state of civilization, and the attitude of the mass of the people. Just as the popular will has never been the reason for the existence of the death penalty, it has likewise never been the force that resisted abolition of the death penalty. Philosophers have no political power over whether the death penalty is retained or abolished. Just as its preservation best serves the interests of the implementation of political power, so the motive force for its termination comes from the political power of the state and its representatives – politicians.  相似文献

孤独是主体与对象(自然、社会、信仰)相疏离的深度心理体验,个体的孤独源 于主体需要与实现可能性、主体超越意识与超越有限性之间的悲剧冲突。孤独的作用 是多层面、多向度和辩证的,对城市秩序而言,孤独是建构性与消解性的统一。在现 代性的作用下,孤独率先在西方成为现代社会特别是现代城市社会的普遍心理现象, 在当今快速现代化的中国,城市社会的孤独不仅具有城市世界的普遍共性,其传统文 化中家宗教、家信仰的抽离必然使中国的城市孤独具有鲜明的本土化特征。因此,从 中国实际出发,探索构建心理秩序、城市秩序的具体路径十分必要。

Loneliness can be best described as a kind of first‐hand, painful experience etched in the inner world of an individual's psyche. It arises from some degree of estrangement between the subject and the object (nature, society and beliefs). The root causes of individual loneliness lie in the unfortunate tension between the needs of the subject and the possibility of realizing these needs, the consciousness of transcendence on the part of the subject and the limited extent of this transcendence. The impacts of loneliness are multi‐layered, multi‐dimensional and dialectical. Relative to urban order, loneliness can be regarded as a unity of construction and dissolution. As a result of modernity, loneliness is, first in the West, becoming a universal psychological phenomenon in modern societies, particularly the modern urban societies. Since China is now undergoing rapid modernization, loneliness in China's urban society parallels that in urban societies around the world. The weakening of the family worship and beliefs traditionally found in Chinese society gives loneliness in urban China a localized coloration.

It is thus very necessary to proceed from China's realities to explore practical measures to construct a sound psychological and urban order in contemporary China.  相似文献

伴随着制度变迁进行的结构性调整与创新,带来了不同利益群体之间的矛盾与冲 突,这种矛盾与冲突引发的许多问题可归结为“结构紧张”产生的张力所致,“失 范”状态就是一种典型的结构性问题。以调查数据为依据,分析、检验结构紧张与失 范之间的关系,发现社会地位结构、组织结构、角色结构、权力地位结构、收入水平 与教育水平结构上的差异与分化确实导致了失范感受的产生。诸如个体的失范、不满 意度、相对剥夺感、地位不一致等负面感受很大程度正是缘于客观的结构分化快于制 度整合而引起的失衡与紧张。

The structural readjustments and innovations accompanying institutional change have brought about contradictions and conflicts among different interest groups. The many problems thus touched off can be attributed to the tensions resulting from “structural strain,” with “anomie” a typical structural problem. We have used survey data as a basis for analyzing and examining the relationship between structural strain and anomie. We find that differences and differentiation in social status, organization, role and power structures and in income and educational level structures have indeed led to the birth of a sense of anomie. To a large extent, such negative feelings as individual anomie, dissatisfaction, a sense of relative deprivation, status inconsistency, etc., are nothing other than the result of the imbalances and tensions brought about by an objective structural differentiation that is proceeding faster than institutional integration.  相似文献

There is no evidence in the etymology of Western European languages to support the distinction between “civilization” and “state” stressed by some scholars, nor any to support the division of “civilization” into a dichotomy of “culture” and “society.” The original meaning of “civilization” is “state.” In discussing the origin of civilization, it is groundless to divide “civilization” into “culture” and “society,” or to interpret “civilization” and “state” as two different concepts. Given such considerations, there can only be one focus in studies of the origin of civilization, namely, changes in society and its management structure, or in other words, the changing social relations among people who live within a given territory.  相似文献

马克思哲学分析和解决的“总问题”,是资本占有劳动与无产阶级的解放。马克思哲学在探索这一问题的过程中,形成了大众形态、学术形态和政治形态三种有机统一的基本形态。然而,马克思主义哲学在马克思以后的发展史中,却呈现出不同的演变和命运。马克思哲学的三种基本形态在当代中国的命运可概括为:大众形态得以倡导,但尚未完全实现;学术形态强劲,但疏离政治和大众的倾向较为明显;政治形态突出,但需进一步得到学理支持和大众认同。当代中国马克思主义哲学研究的健康发展,不仅需要廓清马克思哲学的完整结构,而且要营造马克思主义哲学研究的可持续发展的“生态环境”,以推动其大众形态、学术形态与政治形态的良性互动。

The “general problem” that Marx's philosophy analyzes and aims to solve is capital's ownership of labor‐power and the emancipation of the proletariat. In the course of exploring this problem, Marx's philosophy developed three basic, organically integrated forms: the popular, the scholarly and the political. However, the post‐Marx history of Marxist philosophy has seen these three forms evolve differently and meet with different fates. The situation in contemporary China can be summarized as follows. The popular form is proposed but not fully realized; the scholarly form is robust but estranged from politics and the public; and the political form is prominent but needs further academic support and popular recognition. For the healthy development of Marxist philosophical research in contemporary China, we must not only clarify the integral structure of Marx's philosophy but also create an “ecological environment” favorable to its sustainable development with a view to facilitating the benign interaction of the three basic forms.  相似文献

中国正处于社会转型期, 社会矛盾和利益纠纷呈高发态势, 通过厉行法治, 保证 行政权正确行使, 是预防、减少和妥善应对社会风险的良策。由于行政诉讼在制度架 构方面的缺陷, 其制度功能发挥并不充分。设置行政公诉制度, 应当成为完善行政诉 讼制度的一个重要选择。它具有监督和促进依法行政、引导市民社会生成、化解社会 矛盾等多方面的价值, 也是完善中国特色检察制度的应有之义。建立行政公诉, 应当 从理念和制度建构等不同层面予以设计。

Since China is now in a stage of social transition that displays a high occurrence of social conflict and interest disputes, strict adherence to the rule of law and ensuring the correct exercise of administrative power is the best strategy for preventing, reducing and properly managing social risks. Structural defects have meant that the institutional function of public prosecution has not been given full rein. The establishment of administrative public prosecution should thus become an important option for the improvement of administrative legal proceedings. It would have value in a multitude of ways, including monitoring and promoting the exercise of administrative functions according to law, guiding the creation of civil society, and resolving social conflicts, and it is also a necessity for the improvement of China’s procuratorial system. The establishment of administrative public prosecution should be designed at the conceptual level, the institutional level, and so on.  相似文献

“文化反哺”是理解处在急速变迁时代中国社会代际关系的一个本土性概念, 它 在由全球化和社会转型所共同引发的变迁维度上理解中国社会代际关系的颠覆或倒置 现象, 将急速变迁时代所发生的年长一代向年轻一代进行广泛的文化吸收现象视为新 的文化传承模式。在新兴食品、移动电话和电子计算机三类现代器物的传播与选择过 程中, 突出表现出代际倾斜、去中心化和数字鸿沟趋势, 而在器物文明传承过程中 出现的这种代际颠覆现象, 是30年改革开放或社会变迁带给中国人的心理体验的一部 分, 它在精神层面上赋予中国经验以完整的价值和意义。

“Cultural feedback” (wenhua fanbu, literally “cultural reverse feeding”), an indigenous concept coined to facilitate the understanding of intergenerational relations in China’s drastically changing society, focuses on the subversion or reversal of conventional intergenerational relations in the light of changes triggered jointly by globalization and social transformation and views the extensive absorption of emerging cultural elements by the older generation from the young generation as a new mode of transmission. The process of the dissemination and selection of three kinds of modern artifacts—new foods, cell phones and computers—highlights the intergenerational tilt, the phenomenon of decentralization and the trend towards a digital divide. The subversion of conventional intergenerational relations in the process of the transmission of artifact civilization, as a significant part of Chinese psychological reactions to over three decades of reform and opening up, is indispensable to the psychological integrity of Chinese experience.  相似文献
