Decentralisation offers significant opportunities to improve government accountability by exerting stronger pressures both from below (demand) and above (supply). The literature contains many examples, however, where the potential has not been realised, partly because decentralisation reforms have often been introduced without thinking through their accountability implications. Even when accountability is taken into account, the efforts tend to emphasise either the supply or the demand side of the equation, but not both. Drawing on the sets of literature on fiscal, administrative and political decentralisation, this article presents a methodology for studying this.  相似文献

Summary

Although federal statutes and regulations establish the broad parameters within which state Medicaid programs operate, the federal government grants states substantial discretion over Medicaid and Medicaid-funded long-term care. An appreciation of resulting cross-state variation in Medicaid program characteristics, however, has been lacking in the ongoing debate over whether the federal government should further devolve responsibility for caring for the poor and disabled elderly to the states. To better inform this discussion, therefore, this article documents considerable variation, not only in terms of Medicaid program spending and recipients, but also in terms of strategies chosen to reform long-term care services and financing. Since there is little doubt that states take full advantage of current levels of discretion, advocates of devolution may want to reassess their views to consider whether existing variation has resulted in inequities addressable only through more, not less, federal involvement.  相似文献

ABSTRACT

The focus of our attention is the meeting between street-level bureaucrats and individuals with psychiatric disability exposed to interpersonal violence. Based on 11 interviews, we illustrate how stories are understood, used, and made meaningful to the street-level bureaucrat. The contribution of this article is first of all that of being a framework, from a storytelling point of view, for the work and organizational experiences of street-level bureaucrats. Second, by paying attention to the story part of these relationships, we can better understand the situation of individuals with psychiatric disability exposed to interpersonal violence given their interaction with different street-level bureaucrats.  相似文献

Gonzo Justice     
The role of public discourse, social control, punishment and claims about justice are joined in this essay through the concept of gonzo justice. Gonzo justice refers to the use of extraordinary means to demonstrate social control and moral compliance through rule enforcement and punishment designed to stigmatize publicly, often through the mass media, and to demonstrate the moral resolve of those mandating the punishment. The collapsing of distinctions between the news media as chroniclers of public life and formal agents of control is illustrated with materials from an ongoing study of new forms of social control. The implications of making extraordinary sanctioning practices ordinary and routine are noted.  相似文献

Youth Justice     
This paper illustrates how mindfulness and reflection exercises can be integrated into the teaching and learning of active listening skills, an integral component of relationship skills training. This pedagogy was first trialled on a small cohort of 15 students and the improved version was applied with a second cohort of 53 students. Through the mindfulness and reflection exercises which were built in throughout the module, students identified the three most prominent ‘bad habits’ that hindered active listening as ‘mind wandering’, ‘multi-tasking’ while listening and ‘thinking ahead’. The mindfulness and reflection exercises appeared to bring the usually-unnoticed ‘bad habits’ into awareness so that a conscious effort could be channelled into preventing them from interfering with relationship building. This expanded awareness facilitated the strengthening of ability to observe oneself in interactions. This paper proposes a combination of exercises that expand students' awareness of their own habitual listening styles, together with skills training through conventional methods of role play, video-taping and skills drilling, in order to strengthen motivation to change and bring about deeper learning.  相似文献

The focus of this article is on three restorative initiatives-family group conferencing, victim-offender mediation, and reparations. The nature of the connection between family therapy and issues of social justice is explored, using various metaphors from Salman Rushdie's novel Midnight's Children. The author cautions against the affirmative use of a phrase like “social justice” in the context of family therapy, arguing instead for the potential of its critical, negative employment. Abstract

One of the most popular criminal justice paradigms is restorative justice. Restorative justice is victim-centered and focuses on repairing the damage individuals and communities suffer as a result of a criminal act. Uncoerced apologies and remorse for the offending behavior and the victim are important features of restorative justice. However, the criminal justice system and the public eschew principal features of restorative justice. For example, the law coerces apology and remorse. Moreover, the courtroom has become, for the most part, a place for victims, and sometimes judges to attack, demean, ridicule, and disparage defendantsall antithetical to restorative justice. The omnipresent expectation for an offender to unilaterally accept total responsibility for the crime, apologize to the victim, and express remorse for the crime undermines the core objectives of restorative justice and obscures significant social and legal problems.  相似文献

SUMMARY

We shall begin with the principal, and complicated, conclusion: Regrettably, the social work profession has largely abandoned the criminal justice field. That is not to say that social workers are not employed in criminal justice settings. Certainly they are. Significant numbers of social workers earn their living as probation and parole officers, caseworkers in public defender offices, counselors in correctional institutions and halfway houses, and so on. As a profession, however, social work no longer has a major presence in the criminal justice field (Gibelman and Schervish, 1993). Relatively few social workers embark on their professional education with the aim of employment in the criminal justice field. Virtually no courses in social work education programs focus explicitly or comprehensively on criminal justice (Knox and Roberts, 2002; McNeece and Roberts, 1997). Workshops offered at professional conferences or continuing education seminars rarely focus on criminal justice issues per se. And, relatively little serious scholarship on criminal justice issues is authored by social workers.

Interestingly, this has not always been the state of affairs. Earlier in the profession's history, social workers were much more visible and vocal participants in dialogue, debate, research, and practice related to criminal justice. Ideally-in light of social work's unique perspectives on practice and social problems, and the profession's noble value base-the profession will reclaim its preoccupation with criminal justice. As Sarri (2001) concludes with respect to social workers' involvement in the juvenile justice system in particular:

Thirty years ago, social workers were in leadership positions in juvenile justice in the majority of states. In the 1980s, a gradual decline began in agencies and in social work education for practice in juvenile justice. Some have suggested that the decline was at least partially due to professional resistance to working in coercive settings with involuntary clients. However, given the millions of people now caught up in the criminal justice system who are not receiving the social services they desperately need, it is a priority that social work return to a more central role in criminal justice.
