This review summarizes main trends, issues, debates, actors and initiatives regarding recognition and extension of protection of the human rights of migrants. Its premise is that the rule of law and universal notions of human rights are essential foundations for democratic society and social peace. Evidence demonstrates that violations of migrants' human rights are so widespread and commonplace that they are a defining feature of international migration today. About 150 million persons live outside their countries; in many States, legal application of human rights norms to non‐citizens is inadequate or seriously deficient, especially regarding irregular migrants. Extensive hostility against, abuse of and violence towards migrants and other non‐nationals has become much more visible worldwide in recent years. Research, documentation and analysis of the character and extent of problems and of effective remedies remain minimal. Resistance to recognition of migrants' rights is bound up in exploitation of migrants in marginal, low status, inadequately regulated or illegal sectors of economic activity. Unauthorized migrants are often treated as a reserve of flexible labour, outside the protection of labour safety, health, minimum wage and other standards, and easily deportable. Evidence on globalization points to worsening migration pressures in many parts of the world. Processes integral to globalization have intensified disruptive effects of modernization and capitalist development, contributing to economic insecurity and displacement for many. Extension of principles in the Universal Declaration of Human Rights culminated in the 1990 International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families. With little attention, progress in ratifications was very slow until two years ago. A global campaign revived attention; entry into force is likely in 2001. Comparative analysis notes that ILO migrant worker Conventions have generally achieved objectives but States have resisted adoption of any standards on treatment of non‐nationals. A counter‐offensive against human rights as universal, indivisible and inalienable underlies resistance to extension of human rights protection to migrants. A parallel trend is deliberate association of migration and migrants with criminality. Trafficking has emerged as a global theme contextualizing migration in a framework of combatting organized crime and criminality, subordinating human rights protections to control and anti‐crime measures. Intergovernmental cooperation on migration “management” is expanding rapidly, with functioning regional intergovernmental consultative processes in all regions, generally focused on strengthening inter‐state cooperation in controlling and preventing irregular migration through improved border controls, information sharing, return agreements and other measures. Efforts to defend human rights of migrants and combat xenophobia remain fragmented, limited in impact and starved of resources. Nonetheless, NGOs in all regions provide orientation, services and assistance to migrants, public education and advocating respect for migrants rights and dignity. Several international initiatives now highlight migrant protection concerns, notably the UN Special Rapporteur on Human Rights of Migrants, the Global Campaign promoting the 1990 UN Convention, UN General Assembly proclamation of International Migrants Day, the 2001 World Conference Against Racism and Xenophobia, anti‐discrimination activity by ILO, and training by IOM. Suggestions to governments emphasize the need to define comprehensive, coordinated migration policy and practice based on economic, social and development concerns rather than reactive control measures to ensure beneficial migration, social harmony, and dignified treatment of nationals and non‐nationals. NGOs, businesses, trade unions, and religious groups are urged to advocate respect for international standards, professionalize services and capacities, take leadership in opposing xenophobic behaviour, and join international initiatives. Need for increased attention to migrants rights initiatives and inter‐agency cooperation by international organizations is also noted.  相似文献

Why were the Mexican and United States governments unable to establish formal cooperation for the management of migration flows even after agreeing on the need for a “shared responsibility” approach and establishing an agenda for negotiations on a bilateral agreement in the spring of 2001? Conventional wisdom is that the terrorist attacks of September 11th were the main reason for the shift from a bilateral to a unilateral approach to the management of US‐Mexico migration flows. Although this event changed the US government’s foreign policy priorities, in order to understand the reasons why the proposal for a migration agreement failed, it is necessary to look beyond the security context that permeated the US agenda after September 11th and analyse the underlying structural, domestic and ideological factors that influenced the governments’ positions during and after the negotiations. By examining the context of power asymmetry in the US‐Mexico relationship, the domestic politics that surround the issue and public perceptions of immigration in the United States, this paper identifies the challenges implied in efforts to expand bilateral cooperation over migration issues in the NAFTA framework. The fact that both countries’ migration policies are mostly pursued unilaterally despite the acceptance of a “shared responsibility” raises key questions regarding the limits of regional integration and bilateral or multilateral cooperation for the management of migration.  相似文献

Since the early 1980s, international migration has moved beyond humanitarian, economic development, labour market and societal integration concerns, raising complex interactive security implications for governments of migrant sending, receiving and transit countries, as well as for multilateral bodies. This article examines the effects of international migration on varied understandings and perceptions of international security. It discusses why international migration has come to be perceived as a security issue, both in industrialized and developing countries. Questions are raised on the migration-security nexus and the way in which the concepts 'security' and 'migration' are used. The real and perceived impacts of international migration upon national and regional security, both in industrialized and developing countries, are analysed. The policies developed by governments and multilateral agencies since the mid-1980s to mitigate the destabilizing effects of certain kinds of international population movement and human displacement are examined. The conclusions stress the need for the establishment of a comprehensive framework of international cooperation among origin and receiving countries and international organizations to address the destabilizing implications of international migration.  相似文献

Although every aspect of the migration process is shaped by political factors and migration presents many political challenges on the domestic and international levels, the attention of political scientists in the United States and Europe has been limited to relatively few topics, including control over entry and exit, and issues of incorporation and citizenship. Work that considers the political aspects of migration from a gender perspective constitutes an even smaller body of work. In considering the contribution that political science might make to our understanding of gendered migration, this essay points both to some pioneering studies of gendered patterns of migration and incorporation, and also to the growing concern with gender among international organizations and policy makers. Interestingly, the essay shows that it is scholars in neighboring disciplines who have more often have taken up questions of governance and the development of gender‐fair policy towards migrants. The essay raises questions about the relationship between disciplinary boundaries and topical areas and also about the ways in which regional contexts shape the nature of scholarly inquiry by contrasting work on Asia with that in Europe and the United States.  相似文献

Internal and international migration increasingly continues to be of global importance for development policies and programmes, but the dearth of data on migration for African countries and the limited focus on the structural conditions that motivate migration from specific localities within the region remain glaring. In this study, we examine the patterns and drivers of migration in Cameroon, focusing on the dynamics of rural–urban migration, migrant circulation, regional economic migrants and refugees, international migration, brain drain and returns from emigration. Consequent upon regional conflicts and instability, we highlight the refugee problem in Cameroon and significant challenges in addressing it. Finally, we underscore the policy and research challenges necessary to harness the potentials of internal and international migration for national development.  相似文献

This article evaluates predictions of the level of migration from Central and Eastern European countries which joined the European Union in 2004. It does so by comparing observed levels of migration from the new Member States with predictions based on a 2002 Eurobarometer survey. This comparison demonstrates that the failures of previous approaches were due mainly to underestimating the complex relationship between regional and international migration. In contrast to the situation in EU 15, the propensity to migrate regionally within the accession states does not imply a greater potential for international migration. This article shows that GDP was a strong predictor of migration from the new Member States during the 2004 to 2006 period. Equally important, the research presented demonstrates that well‐chosen survey variables have the potential to provide accurate measurements of migration intentions.  相似文献

Since 1945, immigration in the core industrial democracies has been increasing. The rise in immigration is a function of market forces (demand‐pull and supply‐push) and kinship networks, which reduce the transaction costs of moving from one society to another. These economic and sociological forces are the necessary conditions for migration to occur, but the sufficient conditions are legal and political. States must be willing to accept immigration and to grant rights to outsiders. How then do states regulate migration in the face of economic forces that push them toward greater openness, while security concerns and powerful political forces push them toward closure? States are trapped in a “liberal” paradox — in order to maintain a competitive advantage, governments must keep their economies and societies open to trade, investment, and migration. But unlike goods, capital, and services, the movement of people involves greater political risks. In both Europe and North America, rights are the key to regulating migration as states strive to fulfill three key functions: maintaining security; building trade and investment regimes; and regulating migration. The garrison state was linked with the trading state in the eighteenth and nineteenth centuries. The twentieth and twenty‐first centuries have seen the emergence of the migration state, where regulation of international migration is as important as providing for the security of the state and the economic well being of the citizenry.  相似文献

The issue of cross‐border migration in South‐East and East Asia is linked to the integration of regional, if not global, labour markets. The types of labour that are currently in demand have changed substantially since the 1990s in terms of (1) overall magnitude, (2) gender composition, and (3) increased diversification. This paper, however, focuses upon those workers classified as unskilled as they constitute numerically the largest and most vulnerable group. The challenges to provide adequate protection from, and prevention of, exploitative and abusive practices that seriously minimize the socio‐economic benefits for these workers are linked to migration policies and the issue of rights in the origin and destination countries. This paper's objective is to provide a broad outline of the emerging trends and issues revolving around contemporary cross‐border labour migration and the politics of migrants' rights in South‐East and East Asia, illustrated by the difficulties experienced with the ratification of the 1990 United Nations Convention on the Rights of All Migrants and their Families (ICMR). The data this paper is based upon were collected for a report commissioned by the United Nations Educational, Scientific and Cultural Organization (UNESCO) with fieldwork carried out in seven countries located in the Asia Pacific region. It is argued that ratification of the ICMR is obstructed by politics and by a lack of political will. A rights‐based approach to the protection of migrant labour is thus related to a number of macro and micro level issues, revolving around development and practices of “good governance” in addition to interstate relations. This means that the promotion of migrants' rights requires a holistic approach addressing national and transnational issues in an era of increasing mobility across borders.  相似文献

We investigated the link between migration, family structure, and the risk of dropping out of upper secondary school in Mexico. Using two waves of the Mexican Family Life Survey, which includes 1,080 upper secondary students, we longitudinally modeled the role of family structure in the subsequent risk of dropping out, focusing on the role of migration in single motherhood. We found that children living without a father because of international migration or divorce or separation are at a greater risk relative to children in 2‐parent households. Economic characteristics of the household provide a partial explanation for children living in single‐mother households because of divorce or separation but do not explain the greater risk of dropping out for children with fathers in the United States.  相似文献

The Sustainable Development Goals (SDGs) herald a new phase for international development. This article presents the results of a consultative exercise to collaboratively identify 100 research questions of critical importance for the post‐2015 international development agenda. The final shortlist is grouped into nine thematic areas and was selected by 21 representatives of international and non‐governmental organisations and consultancies, and 14 academics with diverse disciplinary expertise from an initial pool of 704 questions submitted by 110 organisations based in 34 countries. The shortlist includes questions addressing long‐standing problems, new challenges and broader issues related to development policies, practices and institutions. Collectively, these questions are relevant for future development‐related research priorities of governmental and non‐governmental organisations worldwide and could act as focal points for transdisciplinary research collaborations.  相似文献

This article analyses international policy discussions on migration and development (M&D) and contrasts these with the actual M&D policies and practices of 11 European countries who were among the main proponents of this international discourse. Desk research of public documents and accompanying information sought from these 11 governments as well as in the European Commission (EC) provide the basis for a comparative analysis of their overall M&D policies and strategies, and institutional settings for formulating and implementing these. The comparison shows that M&D policy and practice remains in a tentative and experimental phase, and that countries experience difficulties reflecting their international positions in their own policies, as well as in learning from their own efforts and those of others. While stressing the developmental potential of migration in international discussions, most of the countries’ policies still reflect an understanding of migration as a problem and a preoccupation with short‐term domestic interests.  相似文献

Abstract

Transnational organized crime in the United States represents the dark side of globalization. This chapter attempts to identify the key problems that face US law enforcement in its efforts to cope with the challenges posed by transnational crime. While the realities of global crime require a broad, comprehensive law enforcement response, unfortunately, even in the United States, law enforcement agencies still tend to turn to local organizations and resort to local remedies to combat international criminal activity. In recent years the size of illegal markets and the resources of transnational crime networks have imposed financial burdens on governments that must devote resources to this struggle. Furthermore, the needs for flexible international trade initiatives and commercial investment frameworks makes the task of US law enforcement agencies engaged in criminal containment and control strategies more difficult to develop and sustain. US law enforcement is multi-layered with jurisdictional authority that is sometimes overlapping and reinforcing which in turn strengthens responses to crime. On the other hand, there are serious issues concerning decentralized enforcement authority that affects federal, regional, and state jurisdictions. Complicating matters still further are the external threats that transnational crime poses that lay beyond the official reach of U. S. criminal justice. Other US issues that complicate and indeed thwart adequate enforcement responses include: the politicization of law enforcement budgets and central government allocations of resources for law enforcement which too often depend upon political partisanship and party loyalties. And media-engendered fears about transnational crime phenomena are often confused with genuine social problems such as immigration and illegal aliens. Too frequently, media distort public attention about crime problems such as urban street gangs operating across national borders.  相似文献

International migration represents just one type of spatial population mobility, along with inter‐regional, rural‐urban, or intra‐urban migration. The possible connections among various forms of migration are, however, only rarely traced in the professional literature on the political and social determinants as well as consequences of international migration. This article examines the formation and role of international networks formed by Chinese students living in the West in the late 1980s and early 1990s as part of their efforts to obtain the right to remain in Western countries in the immediate aftermath of the Tiananmen Square violence of June 4, 1989. Various forms of migrant social networks have been a research focus in international refugee and migration studies, but international networks formed by asylum seekers themselves, and their role in asylum‐seeking processes, have been largely ignored. This article is based on a multi‐method comparative study of Chinese students living in Australia and the United States at the time. Their experience provides data for examining and conceptualizing the role of organized international asylum‐seeker networks in the asylum‐seeking process. The analysis focuses on Chinese student lobbying in 1989, led by an independent Chinese student union, which helped “the Pelosi Bill” to be passed by the U.S. Congress. The main strategies adopted by Chinese students in the United States and Australia, as well as their internationally coordinated actions, are compared. Also examined is the role of two politicized international Chinese student organizations, the Chinese Alliance for Democracy and the Federation for Democratic China, in assisting students with obtaining residence.  相似文献

Abstract Inspired by recent research on the dynamics of ‘small‐world’ networks, in this article I apply its basic arguments and findings to the study of integrative processes in the international system. Employing the logic of network models we can learn, by analogy, from fields as diverse as neural science and forest fire prevention, much about the likely changes caused in the international political environment by increased interaction among its various units. I first explain recent developments in network theory and demonstrate their relevance for the study of international politics and economics. I then develop the most important insights to be transferred from network theory to the study of globalization. Network theory suggests that our world truly ‘shrinks’ only to the extent that relations among international actors cross pre‐existing alliances or cooperative arrangements. Making the world a single place seems to require flexibility in forming attachments with other actors which goes beyond culturally and historically justified efforts at exchange and cooperation.  相似文献

Abstract The aims of this special issue are to both raise the social scientific status of sport and to advance understanding of transnational processes through the role of sport in global change. The Introduction argues that sport, like globalization, can be understood in transdisciplinary terms, and the papers included contributions informed by sociology, anthropology, political sciences and history. As well as placing the issue in the context of recent studies of sport and globalization, the Introduction outlines the seven papers. Placed together they move from analyses of broader globalizing and multi‐sport issues towards consideration of how transnational processes impact upon individual sports – with examples from cricket, baseball and association football – ending with regional and national dimensions.  相似文献

Despite the large number of migrants at both international and internal scales in developing countries, literature on building the links between the two migration processes is still lacking. Using survey data from China's Fujian Province, we elaborate a novel link between international and internal migration processes by examining the response of internal migration to international migration in the migrant origins. Our findings suggest that emigration of one individual initially deterred the internal migration of other family members. Yet, over time individuals from emigrant‐related households had an increasing propensity to migrate internally. During the internal migration process, emigrants’ family members received greater financial returns and had reached farther destinations than other internal migrants. Those emigrant‐related internal migrants with enhanced economic profiles would benefit their domestic destinations in a variety of ways. These benefits support a more optimistic view on the impact of international migration on the development of migrant‐sending countries.  相似文献

Since 1987, international organizations have accorded greaterattention to the problem of maternal mortality, particularlywith the inclusion of its reduction in the Millennium DevelopmentGoals. This article examines maternal health policies in Mexico,focusing on interactions between the international, national,and local scales and considering the case of local projectsin two states, Chiapas and Guerrero. Although the discourseof maternal health expressed at the international level hasfacilitated the creation of networks dedicated to maternal health,the restructuring of health services in Mexico and the rescalingof their provision have often conflicted with the realizationof this goal. The impact of decentralizing health services hasdiffered according to (a) the timing and nature of decentralization;(b) the number and expertise of nongovernmental organizations(NGOs) working on maternal health issues, and the connectionsbetween these NGOs and international networks; and (c) the responsivenessof the state governments to maternal health issues.  相似文献

Towards the end of the 1970s political and economic tensions in South Africa precipitated a crisis of the State. In response to this, the last few years have seen an unprecedented attempt on the part of the government to restructure racial capitalism in South Africa. While reforms have left virtually no aspect of government policy untouched, this paper explores one particular and vital aspect of policy reform: that of urbanisation policy and regional development. It is frequently the case that internationally accepted regional development and settlement strategies, first, are adopted by governments for political rather than for developmental reasons and, secondly, are unable anyway to stimulate processes of regional development. The reasons for this relate not only to the biases which occur in the application of these strategies, but also to a failure to understand or to confront the real and complex developmental problems of the areas in which they are implemented. The case of South Africa clearly demonstrates these issues.  相似文献

The authors describe the critical issues that emerged during the first years of the National Rural Fellows Program at its academic base, the University of Massachusetts at Amherst Department of Landscape Architecture and Regional Planning, and how these issues were subsequently addressed.The Program is designed to provide intensive training leading to a Master's degree for adult minority professionals from rural backgrounds throughout the United States. As a case study, the paper has implications for other departments considering innovations of this sort. It particularly describes the pedagogical and socio-cultural issues regarding the education of adult minority professionals, the potential for new faculty perspectives to be gained from such interaction, and the challenge to traditional regional planning curricula for rural planning across the United States.  相似文献
