Court proceedings are a fundamental and increasingly time‐consuming aspect of social work practice. However, to date, there is a relatively modest body of literature considering the experiences of social workers in instituting child care proceedings and giving evidence in court. This paper draws on data gathered as part of an in‐depth qualitative study of professional experiences of District Court child care proceedings in Ireland and presents findings regarding the experiences of social workers in bringing court applications for child protection orders. It seeks to answer 2 key questions: First, how do child protection and welfare social workers experience the adversarial nature of child care proceedings in the District Court? Second, what are the views of child protection and welfare social workers on the strengths and weaknesses of child care proceedings as a decision‐making model for children and young people? The main findings are that social workers expressed significant reservations about the predominantly adversarial model that currently operates in Irish child care proceedings and about the level of respect that social workers are afforded within the operation of the system.  相似文献

This paper explores how social workers intervene with affluent parents when there are child protection concerns about neglect. Based on data gathered from a small‐scale exploratory qualitative study with 30 practitioners from 12 local authorities across England, this study examined three overarching questions: (a) How do social workers identify risk factors for vulnerable children in affluent circumstances? (b) Which factors inhibit or enable social workers' engagement with resistant affluent parents when there are child protection concerns? (c) What kind of skills, knowledge, and experience is necessary for social workers to effectively assert their professional authority with affluent parents when there are concerns about abuse and neglect? The findings revealed that indicators of neglect can be difficult to identify and challenging to respond to when parents are affluent. Results indicate that social workers have to navigate complex power relationships with parents who are able to use their class privileges to resist their interventions. The paper concludes with a discussion of social workers' skills and capacities for engaging highly‐resistant affluent parents in the child protection system.  相似文献

The article begins by challenging what is considered to be the relative neglect by child and family social work of the importance for children of school and teachers. Key roles of school in children's lives are conceptualized. School is argued to have potential as an ally for children, a guarantor of basic protection, a capacity builder, a secure base from which to explore the self and the world, an integrator into community and culture, a gateway to adult opportunities and a resource for parents and communities. It is suggested that school can have a special supportive value for children experiencing adversity, including those in state care or under supervision, those whose parents have divorced, and those recovering from abuse or neglect. The implications of the central importance of schools and teachers for child and family social work are discussed with reference to the child as client, work with teachers, work with the wider school and community, and policies in social work agencies and in education and training programmes for social workers and teachers.  相似文献

The perceptions and judgments of social workers who interview the child and family are especially significant factors in child abuse assessment process. The current study describes and compares child protection workers’ assessment processes in Korea and the USA through the use of case vignettes and in‐depth interview. The responses from social workers in these two countries were compared and discussed in the areas of: risk assessment; perception of the main problems; tolerance of corporal punishment; and judgments about appropriateness of interventions. Most revealing was that Korean social workers determined abuse based on their child abuse definition and the US Army FAP social workers determined abuse based on their definition, which was affected by legal standards and cultural differences. Korean social workers are more likely to remove a child from the home, even in mild cases, but US FAP social workers would recommend child removal from the home as a last option. The social workers that participated in this survey play a vital role in the safety of children in child protective services. Both countries can benefit from sharing information to improve the child protection services delivered. Social workers' professional judgment leads to objective and consistent outcomes and are less likely to compromise child safety in the decision making process.  相似文献

Very little is known about how Aboriginal parents experiencing vulnerabilities and communities perceive child neglect, despite Aboriginal families being highly overrepresented in the child protection system. This research investigates the perceptions and experiences of child neglect from Aboriginal parents and human services workers in a rural community. Research methods consisted of community forums and interviews with parents and workers. One community forum developed interview guides and vignettes, and the second discussed and interpreted findings. Between the two forums, in‐depth interviews were conducted with 18 Aboriginal parents and nine Aboriginal and non‐Aboriginal workers. Overall Aboriginal parents perceived child neglect in a similar way to Aboriginal and non‐Aboriginal workers. Violence and substance abuse were main risk factors for child neglect, and intergenerational trauma, racism and discrimination, and feeling powerless were prevalent in the community. The paper concludes that there are little differences in the way Aboriginal and non‐Aboriginal people understand child neglect. Instead it is the difficult circumstances experienced by Aboriginal families that keep parents from actualising their parenting expectations. The implications of these findings when working with Aboriginal families and communities are also discussed.  相似文献

This state‐of‐the‐art literature review, based on a literature search of multiple scientific bibliographic databases, aims to shed light on what is known about barriers and factors facilitating child participation within the child protection and child welfare services from both children's and social workers' perspectives. The personal relationship between the child and the social worker is mentioned as one of the most important facilitators for participation, although multiple barriers in creating this relationship are demonstrated by both children and case managers and social workers. In studies, children say they should always participate while social workers and case managers identify many situations where, according to them, participation is inappropriate. Professionals' objections to participation mainly stem from the socio‐cultural image of children as vulnerable and in need of adult protection, and a lack of understanding of what participation actually entails. Interventions to strengthen participation should be directed at making social workers and case managers aware that children are knowledgeable social actors.  相似文献

Social workers' constructions of children and childhood are central to how professionals interact with children and support their needs. The aim of this integrative review was to provide a comprehensive portrayal of child protection social workers' constructions of children and childhood. We analysed and synthesized 35 empirical studies with samples of social workers in the child protection domain where issues regarding the child or the child's situation were the study focus. The findings show that children and youth are constructed as a generalized group viewed in light of their parents. We see a fragmented and context‐free child produced by causal shortcuts strongly informed by specific and, at times, simplified and biased psychological knowledge. Moreover, we identify constructions of the child in need of protection and thereby position children as objects for intervention, separating that from children as subjects in their own rights. Although the participatory child is visible in the data material, the actual practice of involving children seems arbitrary.  相似文献

Founded on an evaluative review of core group practice in a northern metropolitan borough of England, this paper highlights the tensions and difficulties that might inhibit the quality of post‐registration services to children and their families. Insights from the empirical data as well as theoretical literature have been explored in the light of current and developing policies. This exploration is focused on inter‐agency coordination; inter‐professional relationships; and partnership with parents and children. The recruitment and retention of social workers, the potential contribution of Children's Trusts, as well as unconscious processes relating to child abuse and child protection, are all given consideration.  相似文献

Shame is an underexplored and misunderstood emotion. It can be described as an acute awareness of one's flawed and unworthy self. It is the primary social emotion and one of our most intimate feelings developed within the context of our family of origin, which can have a devastating effect on an individual and their relationships. Social workers are routinely faced with issues of shame as an intrinsic consequence of the matters with which social work deals and also as a result of how both families and workers experience the child protection process. This paper outlines the research on shame and guilt to argue for a re‐evaluation of the key challenges faced by child protection social workers. It is argued that shame experienced by parents and carers potentially plays a significant role in these challenges, while it may be argued that ‘guilt’ has had a bad press and may potentially play an important role in the successes. An argument is made for a shame‐reducing child protection social work practice with some key themes for practitioners to consider in their attempt to improve the accuracy of assessments and intervention.  相似文献

In recent years, scholarly writing that calls for the development of a new child protection framework that contextualizes risk and links it to poverty and social marginalization has increased. Nonetheless, there is a lack of research on the challenges of implementing such a framework in frontline practice. Based on the ongoing, rigorous documentation of the author's experience, as a social work practitioner in a community child protection centre, this article presents two single‐case studies that describe and conceptualize the potential contribution of the poverty‐aware paradigm to the creation of a social framework for child protection practice. Utilizing critical reflection as a method of analysis, the findings reveal two major tensions entwined in poverty‐aware child protection practice: the tension between focusing child protection interventions on parenting and focusing them on poverty and the tension between framing risk within a social context and framing it within the concept of the best interest of the child. Based on the case studies, seven poverty‐aware practices to cope with these tensions are identified.  相似文献

This paper presents the findings of a study that looked at social workers' perspectives on parental engagement in making the difficult choice of either taking the child into care or keeping the family together. The paper first explores the specific context of children at risk in Romanian society and explains that in this middle‐income nation there is an absence of evidence‐based risk assessment tools, which prompts social workers to use their own ‘common sense’ risk assessment indicators. The findings of this small‐scale, non‐representative study on several public non‐voluntary child protection services in Romania suggest that social workers' perceptions of specific dimensions of parental engagement in non‐voluntary child protection may influence service delivery decisions and outcomes.  相似文献

According to the UN Convention on the Rights of the Child and Swedish legislation, children have the right to participate in child protection proceedings. The aim of this paper is to describe and analyse the notion of age and maturity in child protection proceedings in order to elucidate how these aspects could influence children's rights to participate. We focus on the view of three groups of actors involved in child protection proceedings in Sweden—social workers, lawyers, and laypersons in social welfare boards and administrative courts—and on how children's age and maturity should be taken into consideration in decisions on their participation in court. The analysis is based on survey data. The study found that social workers, laypersons, and lawyers have different views on when children are old enough to have the right to litigate in court. Additionally, there is no consensus on how the maturity of the child can be assessed to inform the decision about participation. More discussion is needed about what competences a child needs to participate in court and to what extent this right should be limited by their age. Importantly, courts and decision‐making proceedings can be made more child friendly.  相似文献

That said, in child protection practice there is a readiness to see the parent as the problem with parent reform or child removal as the preferred remedy. Social workers within child protection services report that families marked by high levels of conflict between separated parents are among the most challenging cases to handle. Few studies however have focussed on how social workers themselves experience and meet with parents involved in hostile martial interactions. This article reports on a qualitative study involving 31 social workers and provides an analysis of their experiences and dilemmas in working with such families. Findings demonstrate that social workers struggle to find ways to help high‐conflict families and often find themselves at an impasse. Parents involved in such conflict are highly resistant to change, and social workers struggle to engage with them over concerns about their children. Furthermore, findings suggest that social workers lack organizationally allotted time to assist the parents. I conclude by discussing ways in which emotional support, empowering interventions, and strength‐based approaches enable social workers to manage relationships with high‐conflict families. More research on this topic is needed to support and promote better practices for social workers to be more effective in assisting high‐conflict families.  相似文献

Social work has moved from a child protection discourse towards a child welfare discourse that views the relationship between social workers and families as a partnership. Partnership with families in the field of child protection and child welfare, however, mirrors diverse ideological motives of social policy, civil society and practice. We engage in a theoretical discussion of different interpretations of partnership. We draw a primary distinction between reductionist and democratic forms of partnership with families. In a reductionist approach, social workers activate parents in order to realize the goals set by social work. A democratic approach to partnership refers to a shared responsibility between social workers, parents and children. In this approach, effective partnership is not something to be realized as an outcome, but a point of departure that implies a joint search for meaning and an experiment with which social workers engage. This engagement presents ‘non‐participation’ not as problematic but as an essential element of participation. The focus then shifts from a methodical approach to partnership – how to activate people to participate in the care process – to the question of how the engagement of social workers can be constructed together with families.  相似文献

Concerns have been expressed for some time about a decline in emphasis on therapeutic work in social work, notably articulated in the Munro Review. Further concerns have been expressed in child care that social workers have increasingly had to focus on child protection work rather than earlier stages of prevention. However, there remain opportunities for social workers through the development of new programmes. One development has been that of Behaviour and Education Support Teams: multi‐professional teams, containing as a key element social workers, and encouraging novel practices designed to help emotional stability and improved behaviour and education performance. This study reports on an evaluation of a social worker delivered school‐based social skills programme, which can contribute to the important area of resilience. This showed significant and sustained improvements in pro‐social behaviour and friendships. The implications of this for the therapeutic potential and professional role of social work are discussed.  相似文献

The New Zealand family group conference (FGC) approach to decision making in child welfare and protection has attracted strong interest among policy makers and professionals all over the world. While New Zealand’s legislation makes use of FGCs more or less mandatory in child protection, other countries permit social workers to refer families to an FGC at their own discretion. Knowledge about social workers’ attitudes towards the model is thus paramount if we want to understand implementation and evaluations of FGCs outside New Zealand. This study looks at attitudes towards and actual referrals to FGCs amongst 219 social workers from 18 local authorities in Sweden and the UK. Results reveal an overwhelmingly positive attitude towards FGCs in both countries. Given these attitudes it was striking that only 42% of the social workers had initiated at least one FGC over an 18‐month period. The number of implemented FGCs was almost exactly the same in Sweden and the UK, after adjusting for time and number of social workers. Possible explanations for this paradox are discussed, using data from the survey and child welfare literature.  相似文献

This article offers a general review of the development of national policies on child protection in China. It offers an in‐depth analysis of related legislation enacted between 2010 and 2015 that have had an impact on child protection and related historical, cultural and legal issues. Furthermore, in the study we examined the emerging role of social work in preventing and responding to child abuse and neglect in China. Major findings of the research include: (i) policies concerning child protection have been highly influenced by Confucianism and its perspective of the child as family property; (ii) child protection regulations on accident reporting, custody transfer, and surrogate care are gradually being refined and improved, although the legal system for child protection is still incomplete and needs further substantiation; and (iii) the involvement of non‐governmental organisations (NGOs) and social workers has enhanced the child protection system. Key Practitioner Message: ? Policies concerning child protection have been subject to an immense impact by Confucianism, placing strong responsibility on family members in providing childcare although the child is viewed as part of the family's property; ? After 1949, the newly founded socialist political structure began to exert a significant influence on welfare and child welfare policies. Because the Confucian perspective emphasised family and parental responsibility, government in China has traditionally not been heavily involved in policies that interfere in the internal workings of families; ? Since the shift toward an open‐door policy in 1979, child protection policies in China have begun to develop, with a child welfare network gradually spreading to cover the majority of children. Moreover, child protection is generally supported by the legal system, within which regulations on accident reporting, custody transfer and surrogate care are gradually being refined and improved. However, despite the huge progress achieved in recent years, there are significant deficits in its implementation and monitoring; ? The involvement of non‐governmental organisations (NGOs) and professional social work services has promoted a child protection system.  相似文献

This paper reports the findings of an exploratory study of the response of social workers within a community care setting, in a large Dublin suburb, to cases involving men's abuse of women. This research aims to focus on what child protection workers do regarding this abuse, and what they say about what they do, thereby giving readers a sense of the action taking place in this social work team. The data, generated from both qualitative and quantitative methodological research, reflects this aim, as it taps into the working model of responses to men's abuse of women held by social workers, and identifies what influences that, thereby reflecting the realities and constraints of everyday work. At the time the research was carried out (2000), the results confirm that the prevalence of cases involving men's abuse of women on this team was in line with international findings. This research revealed an absence of a team policy, an agreed definition of intimate violence in this context and agency practice guidelines, and illuminated how these gaps act as a deterrent to effective intervention. This paper explores some of the ethical and practical dilemmas that may arise for child protection social workers intervening in cases where the abuse of women by men is present. Recommendations arising from this research identify a need for a clear policy and best practice guidelines for social work staff in relation to this abuse.  相似文献
