Researchers who undertake parental perception studies agree that the views of the parents can offer valuable insights in relation to child protection work. Respondents to such studies and others who have shared their experiences of child protection investigations are usually mothers. Taken together, this body of work sheds light on some very private, emotive and often painful experiences of child protection intervention and its impact. This article lends my voice to this literature and gives further insight into the ways a mother can experience a child protection investigation. Drawing upon one incident – a swelling on a baby's head – this article draws attention to my feelings and emotions as the baby's mother. Despite a co‐operative social worker–client relationship and case closure, my analysis draws attention to issues concerning power imbalances and the concept of ‘secondary victimization’ to explain the awfulness of my experience and my convoluted emotional disquiet. The article proposes that more attention is directed to the negative feelings and emotions experienced during the investigative process through further research.  相似文献

Professionals, including social workers, in the child protection context are frequently required to make decisions on whether to share sensitive personal information about children, their families, and others with colleagues and across institutional and jurisdictional boundaries. Sharing information across agencies and organisations is essential to allow joined‐up service provision and to effectively protect and support children and their families. A legal framework that supports this decision making is a necessary, although not sufficient, condition for effective information sharing. This article examines the complex legal framework that governs information sharing across the Australian states and territories. It identifies a number of structural and regulatory elements that unnecessarily limit information sharing or have a tendency to create a culture that is risk averse, rather than proactive, in sharing information. The article suggests structural and regulatory reforms that would improve the legal framework for sharing information, while at the same time giving due recognition to the human rights that come into tension in this policy context: the right to privacy and the rights of the child.  相似文献

The paper presents findings from a qualitative study of four child death reviews published in Australia. The study was informed by the theoretical concept of childism. A critical social research methodology facilitated the exposure of childist dynamics in statutory child protection. The transformation of child protection practices and systems has traditionally relied on the imposition of never‐ending structural changes, policies, and procedures. This paper proposes that transformation and the erosion of childist dynamics is contingent on humane and ethical statutory child protection agencies.  相似文献

Cumulative harm is a major child protection concern, with significant consequences for child well‐being and development often into adult life. This systematic literature review examines how the construct of cumulative harm is understood and operationalized within current Australian child protection legislation, policy, and practice and situates this within an international context. Scholarly articles and grey literature were qualitatively analysed to explore two main research questions: How is cumulative harm to children identified, assessed, and ultimately incorporated into child protection and legal structures? And what are the most effective responses to cumulative harm identified for child protection practice? What was found was that although the construct of cumulative harm is increasingly incorporated into child protection practice and legislation, in practice, this remains crisis‐driven. Although the literature emphasized prevention and early intervention as responses to reducing the cumulative impact of adverse childhood experiences, there is negligible research on what constitutes an effective response to cases involving cumulative harm. They are cases which are less visible within the child protection paradigm; attention to the impact of risk of maltreatment and its influence on long‐term developmental outcomes is less well addressed creating uncertainty and ambiguity about effective responses for child protection.  相似文献

This paper uses findings from empirical research to demonstrate the strengths and weaknesses of the child protection procedures in the UK. Discontinuities in which child protection plans were not implemented arose because of limitations in the plans made, obstacles to implementation and weaknesses in the conduct of review meetings which rarely questioned the management of cases even when it was clearly deficient. The construction of risk made during the investigation carried over into the initial conference, fed into decisions about registration and had an enduring influence on the way in which later risks to children were interpreted. However, this meant that new information which challenged this view of risk was often ignored. Continuities were also evident between adequate plans for children's safety made at initial conferences and their subsequent protection. However, when children remained at home with an abusing parent, this remained true only when a new key worker had been allocated at the time of the conference. These initial plans also had an impact on the interventions provided, especially those for treatment. These findings emphasize the importance of adequate planning for children and families at initial child protection conferences and the need for an overhaul of the conduct of reviews if they are to be used more effectively.  相似文献

Adoption in Malaysia is of two kinds; firstly, taking the child of another as a person's own child, where as a result, the adopted child will stand in equal footing with the natural children of the adoptive parents; and secondly, taking a child of another into a person's custody without affecting the biological status of the adopted child. This article wishes to discuss the law and practice of adoption in Malaysia as one of the means of child protection. The article will also examine as to whether the law is adequate to protect children who are the subjects of adoption.  相似文献

This paper responds to the critical appraisal of the Department of Health Research Studies in Child Protection by Partem. It commends the general presentation of the context of the research but does not wholly accept the conceptual and methodological problems identified. While not disagreeing that a shift in the balance between narrowly defined child protection and family support will be difficult, the research is seen as providing helpful insights for managers and practitioners who wish to make this shift. The paper attempts to provide a different perspective of the current situation as a contribution to continuing debate.  相似文献

This paper provides a critical appraisal of the Department of Health Research Studies in Child Protection and their recommendations for policy and practice. It argues that there are a number of conceptual and methodological problems and a failure to thoroughly articulate and represent the tensions and complexities of child protection work, particularly at the point of allegation and initial referral. In the process it fails to fully appreciate the significance of risk in the current social and political climate, the way front-line professionals, particularly social workers, are held to account and the nature of the responsibilities they carry. As a consequence, the paper suggests that attempts to shift the balance of policy and practice from narrowly defined child protection to family support for children in need may be far more difficult than the research suggests.  相似文献

The body of ‘service user’ literature confirms the value of parental perceptions of child and family social work and the insight parents and others can offer. This paper lends my voice to the literature regarding parental perceptions, inspired by the work of Pamela Davies, who provided a personal account of the impact of a child protection investigation. This paper draws upon my experiences of being a father of two ‘disabled children’ and undergoing an assessment of need. This paper seeks to draw attention to issues of choice, power imbalances and the role of expertise. My personal experience of undergoing an assessment was that it was an emotionally fraught process, for the duration of the assessment, our family stress increased and we had a sense of having to ‘battle’ for the support we needed. As such, my personal experience fits well with the wider body of literature, which highlights the increased stress of caring for children with additional needs, the challenges of ‘fitting’ disabled children into the frameworks used to assess all children and the difficulty for parents and professionals in distinguishing between ‘normal’ parenting responsibilities and the additional responsibilities of caring for a disabled child.  相似文献

Social work and child protection literature, policy and practice discussions largely ignore the core experience of doing the work. Little attention is given to where it is performed, and in particular, the practice of home visiting and the emotions and challenges of accessing children it gives rise to. Although it is the methodology through which most child protection goes on, the home visit is virtually ignored, as the emphasis in policy and practice texts is increasingly on what happens in the office, at the computer and in inter-agency collaboration. Examining scenes from home visiting practices and child death inquiry reports – Baby Peter, Victoria Climbié and Jasmine Beckford – the paper identifies the core problem of contemporary child protection as being social workers (and other professionals) not moving in rooms or around houses to meaningfully engage with, touch or examine children. Analysing practice through the sociology of 'mobilities' and psychodynamic social work theory, the paper provides new ways of understanding social work experience as forms of embodied movement. It uses the concept of 'containment' to suggest ways in which practitioners can be supported to use their bodies to move more and better in performing child protection to the benefit of children, other service users and themselves.  相似文献

Child protection social work in Ireland has been expanding at a significant pace over the past decade, particularly since the implementation of the 1991 Child Care Act and the emergence of a number of child abuse 'scandals' since the early 1990s. One health board area in Ireland, itself subject to one of the most controversial child abuse inquiries, commissioned a research study into the nature of child protection practices in the area. The aim of the research was to evaluate the overall child protection system and to consider what impact, if any, new practice guidelines and procedures, implemented in the aftermath of the inquiry, had made on the service. This paper considers some of the key findings from the research and considers these in the context of the overall Irish child protection system. Three particular aspects of the research are focused on: the use of procedures and guidelines, the nature of interagency cooperation and the position of social workers within this, and the overall nature and direction of the child care system.  相似文献

There is now considerable evidence from numerous countries that statutory child welfare agencies are being overwhelmed by a massive increase in child protection referrals which require investigation, while there has been a growing failure to develop preventive family support services. This paper describes the changes introduced in Western Australia to address this situation in what has come to be called New Directions in Child Protection and Family Support . The results demonstrate that the changes have led to a significant restructuring of the way the Department of Family and Children's Services there responds to concerns expressed about children. It is argued that this has had an impact on the proportion of child maltreatment cases which are substantiated and the way responses are prioritized and allocated, and has provided the Department with a more explicit and clearer focus for its work in a period of increasing demand and rapid change.  相似文献

This article explores the issue of severity in relation to domestic violence and provides a number of reasons for the necessary engagement by workers with such a contentious issue. The specific role that the assessment of the risks posed by the perpetrator which has now developed in some police forces in the United Kingdom is examined, and its relevance to child welfare intervention discussed. A range of factors are identified that heighten the risks of increased violence. These include prior sexual assault; stalking and controlling behaviour; substance misuse and mental‐health problems; separation and child contact disputes; pregnancy; escalation including the use of weapons and psychological abuse; attempts and threats to kill; child abuse; isolation and barriers to help‐seeking. The ways in which perpetrator risk assessment can be used to inform the filtering of referrals to the statutory child care agency, enhance multi‐agency working, provide a structure for the assessment of the perpetrator, enhance partnership‐working with survivors (usually women) and inform the protection strategies for workers are explored.  相似文献

Theories on collective efficacy and social support suggest that indigenous values that support collective practices and sanction community obligations to childcare would be protective against child neglect. Likewise, new qualitative findings show that collective values are stronger in rural areas than in urban. This study tested the claims that the value of Ubuntu, which is a symbolic cultural value of ‘being for others’, will be protective against the likelihood of neglect; this relationship will be stronger in rural compared with urban communities in Ghana. Using data obtained from a nationally representative sample of 1100 mothers (from 22 communities) in Ghana, we tested the claims using fixed effects logistic regression. The Ubuntu norms were significantly endorsed in rural communities compared with the urban. The overall model showed that higher levels of Ubuntu are associated with lower odds of child neglect (OR .47, [.29, .76] p < 0.05), and the relationship remained significant only in the rural sample (OR .13, [.06, .31] p < 0.001). Similar evidence was recorded for the Ubuntu norms of community care and compassion. The results suggest that child protection in rural Ghana can be fruitful when interventions are developed to boost the value of Ubuntu and the norms of collective childcare.  相似文献

This paper examines the complexity of collaboration between child protection and mental health services, where a parent has a mental illness and there are protection concerns for children. The paper reports on data from focused in‐depth interviews with 36 child protection workers, adult mental health workers and child and youth mental health workers. Data were analysed thematically, using NVivo to facilitate data management and analysis. Two dimensions were identified. The first, the process of collaboration, relates to four factors that assisted the collaborative process: communication, knowledge, role clarity and resources. The second dimension considers the challenges presented to collaborative work when a parent has a mental illness and a child is in need of protection, and identifies issues that are inherent in cases of this kind. Two types of challenge were identified. The first related to characteristics of mental illness, and included the episodic and/or unpredictable nature of mental illness, incorporating information from psychiatric and parenting capacity assessments, and the provision of ongoing support. The second type of challenge concerned the tension between the conflicting needs of parents and their children, and how this was viewed from both the adult mental health and the child protection perspective. Implications for policy and practice are identified in relation to the need for service models that provide ongoing, flexible support that can be intensified or held back as needed.  相似文献

Domestic violence continues to be one of the most significant aspects of child abuse and neglect in Australia. However, the children are not well served by either child protection or domestic violence service sectors, which continue to operate as segregated, tertiary response systems. This paper reports on research that examined bridges and barriers to effective collaboration between child protection and domestic violence services in responding to children affected by domestic violence. The differing conceptions and responses of the workers from each service sector, in relation to children and families affected by domestic violence, is discussed in the light of gaps in service provision in both sectors. In doing so, areas of common ground for more effective collaboration between these service sectors are identified, including the prioritizing of emotional and psychological abuse, supporting and empowering abused mothers, strengthening the mother–child relationship, and supporting children and families across a continuum of service provision, particularly in the medium‐ to long‐term. Understanding each other and finding common ground across the two service sectors is paramount to improving how each responds to children and families affected by domestic violence.  相似文献

This paper examines the nature of late-modern child protection by placing it in the context of the paradigm of `risk society'. It traces out a structural transformation in the relationship between expertise and lay people that has occurred since the 1970s which resulted in the emergence of child abuse inquiries and new public disclosures of professional 'failures'. The dynamic and empowering features of social developments are identified in how institutions, professionals and lay people re-appropriate power, knowledge and reskill themselves. Traditionally repressed problems like child sexual abuse have gained recognition in a context where abused women and children – like all late-modern citizens – are reflexively engaged in constructing their own biographies and using expertise in the planning of their life projects. A radically new professional risk consciousness in child protection is traced to late-modern existential crises associated with death and sexuality and the emergence of manufactured risk, which is known and experienced by social workers as risk in the context of radically uncertain futures for children. Drawing on the work of sociologists of 'reflexive modernity', the paper aims to advance our understandings of social work and child protection beyond the one-dimensional focus of post-modernist critics on power, control and bureaucracy to recognize the new opportunities, as well as the dangers, involved in child protection in risk society.  相似文献

The argument is made for having a positive error culture in child protection to improve decision‐making and risk management. This requires organizations to accept that mistakes are likely and to treat them as opportunities for learning and improving. In contrast, in many organizations, a punitive reaction to errors leads to workers hiding them and developing a defensive approach to their practice with children and families. The safety management literature has shown how human error is generally not simply due to a “bad apple” but made more or less likely by the work context that helps or hinders good performance. Improving safety requires learning about the weaknesses in the organization that contribute to poor performance. To create a learning culture, people need to feel that when they talk about mistakes or weak practice, there will be a constructive response from their organization. One aspect of reducing the blame culture is to develop a shared understanding of how practice will be judged and how those appraising practice will avoid the hindsight bias. To facilitate a positive error culture, a set of risk principles are presented that offer a set of criteria by which practice should be appraised.  相似文献

Engagement in the context of child protection is of significant international interest, as the participation of family is a central notion in child and family social work. Drawing on in‐depth, semistructured interviews with a sample of 26 child protection workers in 1 region in Estonia, this article reports the findings of the participants' perspectives on family engagement in the context of child protection assessment. Child protection workers perceive the engagement related to 3 aspects: first, it is associated to the acts of the worker; second, it is associated to parental part of actions—depending on parents themselves; and third, engagement was seen as “doing together” with the family, referring to partnership. The aim of the engagement was mainly considered in the terms of empowerment—empowering family to cope on their own and to take charge of their lives. The negative image of child protection was recognised as one of the main barriers to the family engagement. Understanding the family and their situation was seen as the basis for a trusting relationship, being the most crucial factor to promoting family engagement.  相似文献

This paper reports on a study of service users' views on Irish child protection services. Qualitative interviews were conducted with 67 service users, including young people between 13 and 23. The findings showed that despite refocusing and public service management reforms, service users still experience involvement with the services as intimidating and stressful and while they acknowledged opportunities to participate in the child protection process, they found the experience to be very difficult. Their definition of ‘needs’ was somewhat at odds with that suggested in official documentation, and they viewed the execution of a child protection plan more as a coercive requirement to comply with ‘tasks’ set by workers than a conjoint effort to enhance their children's welfare. As in previous studies, the data showed how the development of good relationships between workers and service users could compensate for the harsher aspects of involvement with child protection. In addition, this study demonstrated a high level of discernment on the part of service users, highlighting their expectation of quality standards in respect of courtesy, respect, accountability, transparency and practitioner expertise.  相似文献
