With the development of China's economy since 1979, a new type of Chinese migration has emerged, which is more diversified and quite distinct from previous migration patterns. Trafficking in human beings and other forms of irregular migration are one of the most pressing and complex human rights issues today, reaching across borders and affecting most of the countries in the world, with new and serious security implications. As part of the international irregular migration flows toward and into the European Union (EU), the Chinese, particularly from Fujian and Zhejiang provinces, have played a major role since the 1980s. To some extent, it could be said that China provides the largest number of East Asian irregular immigrants to Europe. Based on fieldwork conducted in southern China over the past seven years, this paper proposes to examine current Chinese irregular migration trends. It will further present the Government's response regarding the migratory modus operandi and policy implications with the aim of offering policy makers an empirical insight into the most active region of emigration in China. Because of the difficulty and sensitivity involved in collecting data on the topic, materials in this paper are mainly based on a content analysis of local Chinese newspapers and my interviews with various people involved in irregular migration activities, such as “snakeheads”, illegal migrants and their family members, and police, local, and government officials at different levels. 相似文献

The debate on the immigration policies in OECD countries has turned its attention towards illegal migrants. Given that migration flows are determined by immigration laws, the probability of potential detection, penalties for unauthorized migrants and their employers, and income differences between sending and receiving countries, this paper presents a new approach to the problem of illegal migration, grounded on the economic theory of illegal behaviour. The framework considers the interaction of potential migrants, citizens, employers, and the government. After introducing the supply function of illegal migration and its determinants, the trade-off between social costs and benefits of preventing and combating illegal migration is demonstrated. This trade-off results in an optimal level of migration larger than zero. A complete "market model" of illegal migration is offered by presentation of a demand curve of illegal migration, based on the tolerance of the society towards clandestine foreigners. Equilibrium forces predict a non-zero level of illegal migration. The rule of law of our legal systems, according to which any illegal activity has to be reduced to zero, bears the danger of producing inefficient disequilibria. A reasonable policy of wanted and unwanted migration should address the question of how to allocate scarce resources. Ignoring social optima and equilibrium forces means to abandon public resources that could be used for other public assignments, such as schooling or foreign aid, for instance, i.e., measures that could strike the problem of illegal migration at its root. 相似文献

The Industry of Illegal Migration: Social Network Analysis of the Brazil‐US Migration System 下载免费PDF全文
In this article, we analyse the process of migration by applying a social network methodology. Using the personal network approach, we focus on a case study of the Brazil‐US migration system to analyse the formation of the so‐called “industry of illegal migration”. We suggest that in migration systems, brokerage evolves not only because of historical and cultural changes, but also because the changes emerge within a structured environment in which brokerage can thrive, and this, in turn, causes the social networks to support and produce specialized actors (individuals and organizations) embedded in the “right positions” of the social structure in the migration process. In this particular case study, we suggest that brokerage seems to take place through gender‐oriented networks and the personal experience and structural power of returned migrants. These returned migrants usually have more varied social contacts and types of relationships from which they can obtain richer information about the migration system. 相似文献

This study examines local governments' growing presence in irregular migration management, and discusses how autonomous local responses challenge centralist approaches to the management of this migration. By building on the relevant legal framework, secondary literature and interview notes, the study focuses its attention on irregular migration in Turkey, and uncovers the potential of two local government units – district municipalities and muhtarl?ks – in the response to irregular migration. The study discusses the enablers and the main constraints on these local government units in responding to, and therefore involving themselves in, the management of the phenomenon. As discussed in the study, the main impediment appears to be the country's highly centralized state structure, while there also exist several enablers, such as Turkish Townsmen Law (Hem?ehri Hukuku), the trust relationship with their inhabitants, and their experience of liminality in handling irregular matters and providing social aid to vulnerable, fragile and low‐income residents. 相似文献

Against the backdrop of push‐pull and social network theories on migration and criminological theory on human smuggling, this article tries to answer the questions of why and how Angolan asylum‐seekers migrated to the Netherlands since the end of the 1990s. The study shows that the migrants can be described as opportunity seeking migrants, rather than survival migrants. Most migrants made no use of typical human smugglers during their travel. They rather used assistance from their social network and made use of the services of middlemen, called esquemas, on an ad‐hoc basis. In this article it is argued that “archetypal” large smuggling organisations in Angola have not evolved because of the existence of these highly informal networks. Support is found that both push‐pull and social network theories can contribute to explaining irregular, asylum migration. 相似文献

This article examines the consequences of the latest round of EU‐Enlargement in May 2004 on irregular migration across Central and Eastern Europe. Drawing on a unique collection of both quantitative and qualitative data related to irregular migration and human smuggling, the article first presents some long‐term trends in irregular migration across the region before taking up more recent developments in 2003 and 2004. While border apprehensions have broadly declined since about 2000 there is ample evidence for an increasing role of human smugglers in facilitating irregular migration. In addition, there are noticeable changes in the modus operandi of human smugglers. 相似文献

Le seul problème avec de telles idées reçues est qu'elles ne concordent absolument pas avec les faits dont on dispose et n'ont pas grand chose à voir avec la réalité concrète des systèmes de migration illégale. Cette étude passe en revue un certain nombre de dossiers de tribunaux italiens concernant diverses organisations qui opèrent aussi bien au travers des frontières terrestres que maritimes. Abstract This paper looks at aspects of the detention of irregular migrants in Australia, Malaysia, and Thailand. The principle intention of the paper is to study detention of irregular migrants as a means of understanding politics and how notions of political participation and of sovereignty are affected by the detention of certain sorts of individual. What does the identification of certain “forms of life” to be detained say about the political norms of different societies? The conduit for this examination will be the Italian philosopher Giorgio Agamben's concept of homo sacer. Homo sacer is a term Agamben extrapolates from “ancient Roman law”. It denotes a naked or bare life that is depoliticized. Homo sacer is the excess of processes of political constitution that create a governable form of life. Homo sacer is thus exempt or excluded from the normal limits of the state. At the same time, however, homo sacer is not simply cast out but is held in particular relation to the norm: it is through the exclusion of the depoliticized form of life that the politicized norm exists. This essay seeks to contextualize aspects of Agamben's argument by looking at detention as a form of exclusion in three different contexts. 相似文献

This article examines irregular South‐South migration from China to Ghana, and the role it played in transforming livelihoods and broader developmental landscapes. It looks at the entry of approximately 50,000 Chinese migrants into the informal small‐scale gold mining sector from 2008‐2013. These migrants mainly hailed from Shanglin County in Guangxi Province. In Ghana, they formed mutually beneficial relationships with local miners, both legal and illegal, introducing machinery that substantially increased gold production. However, the legal status of Chinese miners was particularly problematic as, by law, small‐scale mining is restricted to Ghanaian citizens. In mid‐2013, President Mahama established a military task force against illegal mining, resulting in the deportation of many Chinese miners. The article examines the experiences of both Chinese migrants and Ghanaian miners. Findings are that irregular migration into an informal sector had long‐lasting impacts and played a significant role in the transformation of economic, political, and physical landscapes in Ghana. 相似文献

The rights of migrant workers and their experiences in host countries have been high on the political agendas of Europe and beyond. This article uses data from 138 semi‐structured interviews conducted with migrant workers in the UK, Russia and Ukraine to study their relationships with the police in host countries. We aim to contribute to the literature on policing and migration by analysing three different host countries, and the experience of temporary migrant workers regarding policing within each country. We suggest that the interplay between the experiences of policing in home and host countries can provide important insights into the practicalities of policing, but should not be considered apart from the context of the ethnic origin of migrant workers. 相似文献

This paper addresses the invisibility of the post‐1990s irregular migration flows from Bulgaria to Turkey in the literature despite the increasingly significant number of such migrants. I suggest that this invisibility stems partially from a problem of classification that has to do with implicit suppositions about ethnicity and migration. The post‐1990s Turkish immigrants from Bulgaria are not specified in accounts of irregular migrant flows directed towards Turkey since they are assumed to belong to the category of ethnic “return” migrants: Because of their ethnic identity as Turkish, all Turkish migrants from Bulgaria tend to get considered as part of the intermittent “return” migration waves from Bulgaria, the most notable and well‐known of these being the fight of more than 300,000 Turks in 1989. However, while the ethnic affiliation of the post‐1990s migrants from Bulgaria renders them invisible as irregular migrants within scholarly migrant typologies, the same ethnic affiliation does not necessarily work to their advantage when it comes to their legal and social reception in Turkey. Based on ethnographic fieldwork that prioritizes micro‐level analysis from below, the paper demonstrates that the self designated ethnic affiliation of these migrants, counterpoised against their social marginalization as “the Bulgarian” domestics, heightens the paradoxes of belonging and affects migration strategies. The paper thus underscores the significance of ethnic affiliation as a factor that needs to be adequately taken into account in describing the present and in assessing the future of this particular migratory pattern. 相似文献

Methodological problems in the study of illegal migration as defined in this article relate to questions of indicators for illegal migration, with special reference to Germany. It is argued and demonstrated that illegal immigrants are traceable, to some degree, in official statistics and that these can be analyzed for trends. In present‐day migration processes, illegal immigration frequently is undertaken with the support of human smugglers. The analysis of the social organization of different forms of smuggling is the other main focus of the article. From a methodological point of view, the literature and public discourse lack adequate concepts for describing and explaining the social organization of human smuggling. The theory of organized crime as a main actor in human smuggling is criticized. The study borrows concepts from market and networks theory and applies these to different forms of human smuggling and illegal migration. The social and technological organization of smuggling is under constant pressure to adapt to new conditions. The dynamism for this change results mainly from an “arms race” between smugglers and law enforcement. Since control over territory and population are central elements of state sovereignty, the state cannot simply withdraw from this race. 相似文献

Illegal immigration through human smuggling originating from the Fujian Province, China, has become a global issue, affecting at least 30 countries. The empirical research on the financial element of illegal immigration suggests the important role of an underground banking system. This study examines the role of ethnic networks in sustaining the operation of Chinese-operated informal fund transfer systems in the United States. The primary source of data is from in-depth interviews with illegal immigrants in New York City and Philadelphia. The findings show that as opposed to lineage-based networks, the networks based on regional dialect allowed illegal Fujianese immigrants, as well as underground bank proprietors, to take advantage of social capital inherent in the expatriate ethnic community. The high levels of trust between underground bank proprietors and their clientele can be understood as resulting from ethnic solidarity and enforceable trust. These features are found to be troublesome at the community level because the research findings illustrate that a community of high ethnic interactions espouses a deviant culture or norms that encourage widely accepted but illegal practices. 相似文献

Does a history of migration in the family influence one’s decision to move abroad? This paper argues that intergenerational transmission of ‘migration capital’ accumulated in the family is a significant determinant of current decisions to migrate. Using an ordered probit methodology to analyse data from a survey of 2161 respondents conducted in Latvia in 2007, we find support for our hypothesis: children of former migrants are more likely to migrate themselves, compared to people without family migration experience. The country of Latvia serves as an unusually instructive laboratory for our analysis due to the planned nature of its 1945–1991 immigration flows. 相似文献
