This study examined the adequacy of child support income for children of divorce. A random sample of 186 final divorce decrees finalized in Hennepin County, Minnesota in 1986 and involving minor children were used in the analyses. Income adequacy was defined as the extent to which income provides a level of living which meets reasonable needs. Income adequacy was measured by ratios of income to income needs uding three indicators of income and three standards of needs. Income-to-needs ratios were constructed to evaluate the adequacy of child support income. Results of the study supported the assumption that the child support award did not provide a satisfactory level of income for children. This result was consistent using the actual court-ordered child support award, the amount of income which would have been given if the Minnesota guidelines had been strictly applied, or income which might have been given to the child if Wisconsin guidelines had been applied. Actual court-ordered child support awards deviated downward from the established guidelines by about $18.14 monthly. The downward deviations from guidelines were greater at higher income levels. The income-to-needs ratios of the actual court-ordered awards did not exceed 50% of the direct costs of raising children until the net annual income of the obligor exceeded $12,000-$18,000 and did not provide income over the poverty level until the obliger's income reached $24,000.  相似文献

Canada has a currently estimated population of 25,358,500, approximately that of the state of California. Saskatchewan is a Canadian province with a population of approximately 1,017,800. The majority of the individuals in the study had been single at the time of marriage and married for an average of 11 years. Only three grounds for divorce were utilized; that of separation not less than three years, adultery or cruelty. Custody of eight out of 10 dependent children was awarded to the mother, one out of 10 to the father, and for one out of 10 no award was made. In this study custodial fathers were never granted maintenance, and when the grounds for divorce were separation, women did not receive maintenance as often. Child maintenance was awarded in approximately seven out of 10 cases, with the awards ranging from $l/year/child to $350/month/child. Awards did not appear to follow any pattern based on husband's salary, with maintenance ranging from 0%-40% of the husband's stated monthly gross income.  相似文献

Reducing non-marital childbearing and making nonresidential fathers take greater responsibility for their children were identified as goals of numerous policy changes since the 1980s. Child-support award rates for children born to unmarried parents have been quite low historically, leading lawmakers to focus on increasing both award and payment rates for this group. Nonmarital fathers are also much less likely to have contact with their children. Although evidence suggests that policy efforts increase child support awards and receipt, the link between child support policies, child support outcomes, and father-child contact has received less attention. This paper uses data from the Survey of Income and Program Participation on children born between 1985–1997 to investigate the relationship between child-support award and receipt and the amount of contact that fathers have with their non-residential children. Since it is likely that both of these behaviors are, in part, determined by unobservable characteristics of the father, we estimate an instrumental variables Tobit model. The model is identified by our assumption that child support policy variables can impact child support awards and payments, but father-child contact cannot be directly legislated. Our results suggest that there are unintended, but desirable effects of child support establishment and collection. Policies to collect child support not only increase financial resources to families, but through their impact on payments increase visitation and contact between these children and their fathers. This paper reviews the economic consequences of the current laws of marital dissolution. Findings from seven states reporting primary data are compared on three judicial trends: the basis for property awards in equal and equitable distribution states; the frequency, amount, and duration of alimony awards; and current rulings on child custody and amounts of child support awards. The major consequence of these legal rules is a deterioration in the economic well-being of women and children following divorce.  相似文献

This article provides information on the effectiveness of state child support enforcement systems. We use individual level data from the Child Support Supplements of the Current Population Surveys (1978-1992) to create an index of state effectiveness that captures success at securing child support awards, setting award levels, and collecting obligations. We identify states that were performing above or below the national average in the late 1980s to early 1990s and states that showed substantial improvement or decline in child support effectiveness during the 1980s. Identifying successful states will help researchers to determine what policies and practices are associated with successful enforcement. These variations in state effectiveness also suggest that low levels of child support are not due to deadbeat dads alone but also to inept states.  相似文献

Noncustodial fathers are men whose parental rights and obligations have been altered through judicial action, usually accompanying marital separation and divorce. In the majority of divorces, physical and legal custody of children is taken from fathers and reassigned to mothers only. Despite the curtailment of their decision-making authority and despite the limitations imposed on their day-to-day presence in their children’s lives, in the majority of divorces fathers retain the duty to provide economic support for their minor children. The bulk of quantitative research on the post-divorce involvement of men as noncustodial fathers is structured by explora- tion of the interrelationships among these parameters: child custody awards, visitation privileges and performance, child support awards and compliance, and child well-being. The documentation of important linkages between child support compliance and child outcome have focused both social science and legislative attention on means to foster greater paternal acceptance of responsibility for children. Research using open-ended interviews and smaller surveys of limited samples have been of great importance in providing a richer understanding of the noncustodial father-child relationship. To retain(or for some, to build for the first time) a meaningful paternal relationship, men are challenged to find new ways to confront issues of autonomy, connectedness and power. However, societal supports for moving beyond the traditional polarization of genders and roles through which families have been organized are sorely lacking. The ways in which men respond to the changes precipitated by divorce are influenced by a number of factors related to their own self-definition as well as to the broader social context in which they operate. In order to design psychoeducational or therapeutic interventions that allow noncustodial fathers to adapt in ways that are beneficial to themselves and ultimately to their children, an awareness of these factors is imperative.  相似文献

An investigation was conducted by the author into concessions of rightful property, child support and maintenance awards from ex-spouses under pressures from emotional blackmail of coercion. Information was obtained from legal and sociological literature, divorce records in Hennepin County, Minnesota, along with informal interviews with one attorney and eight divorced women. Spousal attempts at coercion during divorce negotiations may influence some women to make stipulations, agreements honored by this court, to less child support, property and/or maintenance than suggesteed guidelines or if they were to litigate those matters through the court system. This has economic, theoretical, therapeutic and research implications.  相似文献

The purpose of this research is to examine the economic impact of child support transfers for middle-income custodial and noncustodial parent over a 15-year period. We have a substantial amount of research on low-income families, but little research about middle-income families. This research is based on computer simulations using income and expenditure data from the Consumer Expenditure Survey (CES) tables prepared by the Bureau of Labor Statistics. The results of the simulations challenge the majority of research that proposes that women suffer far more than men after family dissolution. Instead, we conclude that it is the noncustodial parent, usually the father, who suffers the most. In every case and for every income, according to our analyses, the payer of child support is never able to cover household expenditures if paying child support at guideline levels. By reducing the standard of living to the next lowest income category, in some cases to a level below the custodial parent’s, the parent owing child support is able to make child support payments and cover consumer expenditures. We use exchange and choice theories to analyze the economic alternatives in making a decision to divorce and consequently propose that public support for strict child support enforcement may encourage middle-income women to seek divorce. Micro-level decisions, we argue, have macro-level economic and social consequences for the middle-income parents.  相似文献

We investigate whether journal articles winning a prestigious award of the Thyssen foundation have a higher impact in the scientific literature than a control group of non-awarded articles. In average, awarded articles harvest significantly more citations than articles in the control group. Most remarkably, the average citation rank exactly matches the rank order of awards. The top award earns most citations while the second award, the third award and the non-awarded articles exhibit citation counts in declining order. The correlation of award rank and impact does not vanish if we restrict citation counts to the year of publication and the year thereafter. In this time span the distinction of excellence is very unlikely having a genuine effect on the impact measure. Thus, we do not find support for the social constructivist hypothesis that the correlation of the jury decision and the article impact is explainable by a label of distinctiveness. On the contrary, the empirical data confirm that the jury is successful in the selection of articles which in average have a larger impact in the scientific community than non-awarded publications.  相似文献

Using the 1994–1998 waves of the Current Population Survey—Child Support Supplement (N =5,387), the aims of this study are to document child support obligation rates of nonresident fathers, to examine the effect of the obligation rate on child support compliance, and to calculate the trade‐off between fathers’ financial responsibility and children's well‐being, paying particular attention to low‐income fathers. The results indicate that low‐income fathers have high child support obligation rates, which significantly reduce their child support compliance. Although lowering the obligation rate for these fathers may improve their compliance, it does not fully offset the lowered obligation amounts and leads to a 30% net payment loss for welfare mothers and a 43% loss for nonwelfare mothers. The purposes of this research were: (1) to determine whether background characteristics of attorneys and judges affect the awarding of child support orders and (2) to determine whether institution of 1987 Ohio child support guidelines provides predictable and fair child support awards. It was concluded that the two sets of background characteristics had separate effects on the awarding of child support oders. Attorney's background characteristics affected receipt of child support awards. Judges' background characteristics affected amount of child support awards. Institution of the 1987 Ohio child support guidelines did not provide predictable and fair child support awards. Attorneys were found to be reluctant to win child support awards for their clients. Judges with low integrity scores were found to be deviating from the 1987 Ohio child support guidelines.  相似文献

Most public policy attention given to the child support issue has focused on the impact of involuntaly measures rather than the factors that may encourage fathers to comply willingly with their child support agreements. In this study of 255 divorced fathers, the researcher examines several possible predictor variables of child support compliance, including the divorce proceedings, type of child support agreement, custody arrangements, and frequency of the father's contact with his children. Fathers with shared physical and shared legal custody, and fathers having more frequent contact with their children, were more likely to be in compliance. The results strongly suggest that more attention should be given in divorce agreements to provisions that will enhance the father's involvement in the physical and decision-making aspects of his children's lives so as to increase the likelihood of his involvement in the financial aspects.  相似文献

One in three Australian marriages end in divorce, and over half of such divorces involve children. Research indicates that men tend to repartner within 1 to 2 years of a divorce and women within 3 to 5 years. A significant issue for repartnered men is the provision of financial support for children from both their first and second families. Although only 6% of all Australian first family children spend near/equal time (shared care) after divorce with both parents, fathers in Australia are mandated under child support legislation to provide financial support for their first family children, whether they reside with them or not. However, it is argued by this study's nonresidential fathers that the Child Support Agency, when considering the level of financial support for first family children, tends to overlook the needs of second family children, thus creating an advantaged and disadvantaged set of siblings. This finding is reviewed through a distributive justice theory lens. Finally, some future directions for research aimed at exploring the impact of Child Support Legislation on second families are suggested.  相似文献

The broad goals of child support policy are to keep children in single-parent families out of poverty and to make sure that their material needs are met. One potentially important, but relatively understudied, set of measures of child well-being are health outcomes. A fixed-effects analysis of data from the Child and Young Adult file of the 1979 National Longitudinal Survey of Youth shows that, conditional upon receipt of some amount of child support, higher payment levels are associated with significantly greater odds of having private health insurance coverage and significantly lower odds of poor or declining health status. These effects persist even after controlling for other factors that are likely to be correlated with child support payments, including total family income and paternal visitation patterns.  相似文献

This paper examines whether states’ elimination of child support disregards for welfare payments after welfare reform caused non-custodial parents to increase in-kind support. I use longitudinal data from the Survey of Program Dynamics and take advantage of state and year variation in child support disregard policies before and after the 1996 welfare reform to identify effects of the disregard on in-kind support. I find that a $100 decrease in the disregard corresponds to a 3.2 percentage point increase in the probability a child will receive in-kind child support.  相似文献

Federal legislation has mandated that all states develop numeric guidelines for child support awards in divorce and paternity suits. The purpose of this article is to review the theoretical models currently used in guidelines development and to present an analysis of issues pertinent to the development and use of guidelines. A familiarity with the principles underlying child support guidelines will assist family scientists who may be called upon to provide expertise on this public policy issue.Barbara R. This paper examines whether perceptions of fairness motivate fathers to pay child support and whether perceptions of fairness interact with routine income withholding in collecting payments. Using a study of 392 nonresident fathers who filed for divorce between 1986 and 1988 in the state of Wisconsin, I found that both perceived fairness and income withholding increase fathers' compliance with child support obligations. The effects of these two strategies on compliance are not additive, however. If fathers think their child support orders are fair, the use of routine income withholding does not add to compliance.  相似文献

The perceived fairness of financial arrangements following divorce and repartnering have significant ramifications for social policy and family well-being, yet relatively little is known about public opinion regarding the extent of stepparents’ financial responsibility towards stepchildren’s living costs. This study investigated perceptions of stepfathers’ obligation to financially support stepchildren using quantitative and qualitative methods, and built on previous research by including contextual variables to explore the processes underpinning judgements of kinship responsibilities using a distributive justice framework. Data from a community sample in Western Australia (N = 200) showed a large amount of variability in responses, however most participants believed stepfathers should contribute financially to some extent. Significant reductions in perceived obligations were associated with both cohabiting relationship status and maternal employment, but not with the presence of prior child support commitments by the stepfather. This study highlights the heterogeneity and complexity of attitudes around this issue and associated social policies.  相似文献

This article delineates and assesses the evidence for four perspectives that have guided previous research on the relationship between wives’ economic resources and marital stability. Hypotheses from these perspectives were tested using event history methods and 1980–1997 panel data for 1,704 individuals from the Marital Instability Over the Life Course study. Both wives’ dollar income and wives’ percentage of total family income served as measures of wives’ economic resources. The association between wives’ percentage of income and divorce formed an inverted U‐shaped curve, with the odds of divorce being highest when wives contributed between approximately 40% and 50% of the total family income. When wives’ resources were measured in dollars, wives’ income showed a positive, linear association with the odds of divorce. These findings provide the strongest support for an equal dependence perspective, which argues that economic dependence and obligation influence marital stability.  相似文献
