文化体制改革情境下的文化产业立法构想

The academic community now increasingly appeals for and researches on optimizing Culture Industry Legislation in China,but scholars are debating on some important issues. The paper w ill be focused on the necessity,purpose of adjustment,feasibility,design and some other aw areness issues and propose some relevant view points. On the Development of Tibet from the Perspective of Scientific Outlook on Development： Based on an Understanding of the Spirit of the 5th Forum on Work in Tibet Xiao Fangren （College of Politics and Law, Yan＇an ＆ Sun Xiayun University, Yan＇an, Shaanxi 716000） Abstract： Development and stability are the two major issues in Tibetan society. Development is the key to solve all the problems in Tibet and the Great-leap-forward development is the most urgent task. Therefore, implementing the spirit of the Fifth Forum on Work in Tibet is the most important practice of the Sci- entific Outlook on Development in the new era. Based on the understanding of the spirit of the 5th Forum on Work in Tibet, the author maintains that development in Tibet must rely on the people-centered development, sustainable economic and social development and the overall planning to mobilize all the favorable factors for the development. On the Sustainable Development of the Design of Semiotics and Ecological Aesthetics

Semiotics is the meta-science of researching the general theories of symbols.Design is the result of the production practice of the human society,and what are designed is to meet the first demand of the human society and is the most important cultural creation;i.e.,the material cultural creation.All the cultural phenom ena are symbol phenomena,so the design phenomenon is also a kind of symbol phenomenon.The ecological aesthetics is a new aesthetic form,studying ecology itself,and it develops from the ecological aesthetic standard.This paper attempts to illustrate the relation of the two fields and find out how to realize sustainable development with the lead of the social values and the mainstream culture.

In the discourse of modern moral philosophy, ＂morality＂ does not mean not to ＂gain＂, butinstructs people how to ＂gain＂. But there is a dilemma comes with the finiteness of subject in modem mo-rality. Different from the concept of ＂pre - established harmony＇in Western culture, traditional Chinese culture is an ecological culture composed of various value concepts and this ecological culture has an important significance as the resources for resolving the dilemma of modernity morality.

Prospect Analysis of the Application of the Jury System in Our Country

Can the jury system replace the system of people’s assessors and find a way out of the jury system dilemma in our country? The author gives an affirmative answer that the jury system should be established as soon as possible in our country in order to give full play to the efficacy and value of judicial democracy and supervision. This paper tries to analyze from the following three aspects. Firstly, it analyzes the differences and advantages and disadvantages of two jury patterns including the jury system and the mixed court system; then,based on the statement of development and existing problems of the mixed court system in our country,it analyzes the feasibility of application of the jury system in our country combining with national conditions; finally, social effect of the introduction of the jury system is evaluated,which affects the situation as a whole domino.     

State-Society Relations Beyond the Weberian State

From its political relations Regardle origins in the Weberian tradition of sociology, work on state-society has inherited several propensities. ss of its specific focus, it shares a predilection for large-scale generalizations about the state and its relation to society. Conceptions of the state itself, bearing the imprint of traditional European state forms, continue to portray it as a hierarchical, Weberian bureaucratic apparatus. Consistent with this view of the state, analysts in the field have characteristically presumed that a sharp analytical distinction, if not always an actual separation, between the state and society. This essay demonstrates how these traditional approaches have proven increasingly inadequate to capture the realities of state-society relations. Not only in developed countries but increasingly beyond them, a variety of trends have progressively altered the Weberian state and the overall patterns of state-society relations that accompanied it. Societal influences on the state have also grown, diversified and assumed new forms. Thesocial imaginaries that have linked states with national societies may gradually be changing as well. Work in numerous fields, from public policy and public administration to local governance, political culture and economic sociology, reveals important dimensions of state-society relations that can rarely be fully grasped by means of the traditional state-society dichotomy.

In 1983 Gardner put forward the theory of "multiple intelligences" . In the theory he argued that people vary in terms of eight types of intelligence. The higher education administration system in China has been a central theme in the reform and development of our country’s higher education.
