This article seeks to explain Australia's refugee policy and to identify the various objectives and factors that influence the development of that policy.
Australia's refugee programme seeks to: provide a humanitarian response and protection to individual refugees; participate responsibly in the international community; honour its Convention obligations; further the interests of the people of Australia; meet high standards of administration and; acknowledge as much as possible changes in refugee populations.
In fulfilling these objectives, Australian governments must weigh and balance various competing factors. These include: humanitarian responsibility, international obligations, social, political, economic and foreign policy factors, as well as efficient administration.
In balancing the relative importance of these factors, the Federal government hopes to fulfil all its refugee and humanitarian objectives. However, the pluralistic nature of Australian society and the often conflicting ideals associated with protection of Australia's interests and the preservation of the rights of refugees, means that fulfilment of these objectives is difficult.
This article examines the Australian government's response to the Kosovar conflict, to assess the relative success Australia had in fulfilling its refugee policy objectives and identifying the various factors that produced the final result.  相似文献

This article examines the impact of the growing number of temporary employment contracts in the public sector on equal opportunity theory, policy and practice. Quantitative and qualitative data from two case study local authorities are utilized to examine the mechanisms by which temporary work becomes an equal opportunities issue. A strong association between part‐time work and temporary employment status is demonstrated as an important aspect of the gendered nature of temporary work. Links between ethnicity and temporary work are less clear but are based upon the insecurity of targeted funding for teachers and the under‐valuation of the skills of the workers concerned. The data indicate that temporary workers are largely excluded from equal opportunity policy and practice, bringing into question a concept of equality that can permit less favourable treatment for certain groups of workers. It is argued that public sector restructuring, particularly concerning decentralization and the quest for flexibility, has facilitated the differential treatment of employees, thereby fundamentally eroding the basis of equal opportunity policy and practice.  相似文献

In November, 1989 the United Nations General Assembly adopted the Convention on the Rights of the Child. This international resolution seeks to safeguard the physical, social, cultural, and religious rights of children, and to establish a new legal regime for the protection of children's rights. This paper examines the legal foundations of the Convention relative to international law, the legal effect of a United Nations Convention upon nations, describes the main provisions of the Convention, and discusses the ratification and enforcement of the Convention.  相似文献

This paper brings historical perspectives to bear on the ambivalent and contradictory position of adoption in Australian public policy. It examines the divergent histories of Australian domestic and intercountry adoption (ICA) since the mid‐1970s and the impact of these histories on adoption policy in Australia. It identifies tendencies in contemporary ICA to repeat elements of pre‐reform era domestic adoption. In particular, it is argued that the resistance of ICA to the move to openness in local adoption has been an unacknowledged driver of ICA for many Australian families. We offer corrective readings of the rise of ICA in relation to domestic adoption and conclude by offering alternatives for adoption policy which better align the two kinds of adoption, focusing on the needs of children, as distinct from the desires of adults.  相似文献

This article examines the overseas behaviour of Chinese non‐governmental organisations (NGOs) in two African nations, Ethiopia and Malawi, with varying political regime types. Our findings suggest that, irrespective of regime type, Chinese NGOs have yet to make a substantial impact in either nation. We argue that, despite the strength of the Chinese state and high levels of international development assistance given, domestic politics and regulatory frameworks in host nations still matter a great deal. Our study suggests that the Chinese model of international development will continue to be one in which temporary one‐off projects are favoured; and, insofar as social organisations will play a role, they will be in the domain of government‐organised NGOs rather than grassroots NGOs.  相似文献

This article investigates policy in the Philippines relating to the protection of children, which, despite policy efforts in this space, and growing evidence of child maltreatment and its impact, remains unexamined by the literature. It examines constructions of childhoods utilising a critical policy analysis of national policy documents concerning children's welfare and protection. Analysis finds conflicting representations of children's agency, defining children as ‘becomings’, but also as rights holders and social actors, viewing children as both embedded in, and reliant on, family, consequently detailing important insights into Filipino policy‐making and society.  相似文献

The recruitment of skilled foreign workers is becoming increasingly important to many industrialized countries. This paper examines the factors motivating the sponsorship and temporary migration of skilled workers to Australia under the temporary business entry program, a new development in Australia's migration policy. The importance of labor demand in the destination country in stimulating skilled temporary migration is clearly demonstrated by the reasons given by employers in the study while the reasons indicated by skilled temporary migrants for coming to work in Australia show the importance of both economic and non‐economic factors in motivating skilled labor migration.  相似文献

This article examines the limits to harmonization at the level of the European Union through a case study of policy towards people who fled the war inBosnia and Herzegovina in the early 1990s.
Specific attention is paid to the development of the policy of granting"temporary protection" instead of full refugee status to Bosnian asylum-seekers, which stretched across all fifteen member states.
It is argued that "temporary protection" emerged as a set of specific responses to the outbreak of war in the former Yugoslavia, involvingcompromises between states' desires to restrict asylum on the one hand, but meet demand from public opinion and international organizations to offerprotection to refugees on the other.
Subsequent analyses have suggested that these compromises might providean effective way forward for harmonization of policy at a European level,and even a reformulated international system of refugee protection.
However, the authors question this view: they analyse the extent to which"temporary protection" for Bosnians was coordinated, and whether it actually provided the states and individuals with the benefits that have been suggested.  相似文献

From 1980 to 1996, Australian researchers identified consistently inferior labor market outcomes for professionals from non‐English‐speaking background source countries. In 1997, the incominy conservative government initiated a major review of Australia's skilled migration program, based on a determination to ‘select for success’among applicants. Subsequent initiatives included mandatory English language testing, rigorous qualifications screening, incentives for international students to migrate, and abolition of income support in the first two years postarrival. This article provides a detailed analysis of factors leading to this policy transformation. Labor market outcomes for 2001 are defined, including a halving of unemployment among recently arrived migrants.  相似文献

The ongoing economic crisis has shifted much of the policy debate to problems of financial sector regulation, productive capacity collapse, among others. However, this leaves unattended the real situation with labour migration, which directly impacts social and economic inner components of being of millions of individual families across the world. The somewhat ad hoc nature of the process poses several policy issues for the home and host economies alike. Immediate concerns relate to streamlining migrants and remittances flows. This involves sensitive aspects of inequality in migrant workers’ labour efforts vis‐à‐vis domestic workers; migrants’ social and legal status; and less obvious, but still profound, unproductive misallocation of labour resources. Derived from this premise and recognizing the need for an institutional approach, this paper offers alternative policy solutions to temporary labour migration regulation. This research’s original propositions include a Diaspora Regulatory Mechanism and a Migration Development Bank, both operating within a state‐managed temporary labour migration regime. Fiscal action, including multilateral agreements, is crucial. The functionality of these mechanisms will directly impact infrastructure, human capital and entrepreneurial projects development in both home and host economies. Discussion is inspired by the analysis of actual circumstances in the economies of the Commonwealth of Independent States, where migration is a social, economic, and increasingly political issue. In the interlinked world, diasporas become dominant actors across all society strata. The development plateau of the post‐socialist states offers a rich economic and social soil to conduct responsible policy with future outlook. Moreover, conditions of ongoing economic crisis offer a unique opportunity for daring research to propose and for a motivated decisionmaker to implement original, proactive, and beneficial policy solutions aimed at streamlining the (temporary) labour migration process. This paper contributes to the emerging literature on topics of diaspora, labour migration, and remittance flows.  相似文献

Organizations place context‐specific appearance demands on women — demands that often echo wider inequalities, require adaptation of self‐presentation and impact on women's careers. Despite this, the effect of life and career stage transition on women's self‐presentation and embodied identities remains largely unexplored. Drawing on a qualitative study of young British women's body modification, this article examines what impact transitioning from education into the world of work has on women's self‐presentation and body modification regimes and their embodied identities. Body modification here refers to all methods women use to alter their physical body and appearance (e.g., invasive or non‐invasive; self‐administered or other‐administered; permanent or temporary), provided the intention of their use is primarily to alter the user's physical appearance. Expectations of transition, the impact of entering the workplace and of career establishment are considered as well as the significance of career stage and vulnerability for resistance and negotiation of organizational expectations. Transition of life stage is found to be a catalyst for self‐presentation change. The transition from education to work is identified as having a significant impact on body modification practices across workplaces.  相似文献

This essay stresses the importance of the humoural medical tradition and its lay reiterations in popular eighteenth-century British works on slavery, abolition and illness. In particular, it examines the popular medical concept of ‘seasoning’ and how contemporaries applied it to enslaved African bodies. Seasoning became a common talking point during the British abolition debate as both sides stressed different aspects of humoural theory to make their arguments. While numerous historians have used seasoning as an analytical term to explore the impact of movement on the enslaved, this essay rehabilitates its historical medical meaning and traces how abolition politics affected that meaning.  相似文献

This paper presents an innovative approach to the teaching of policy skills across the two years of an Australian Social Work degree programme. It argues that placing policy back into practice and teaching the skills involved provides social work practitioners with a better capacity to effect change. Australian Catholic University, School of Social Work is located in Australia's capital city. The policy units have a clear framework within which to understand policy development and provide students with real hands‐on policy experience combining an experiential based learning approach with traditional teaching methods. The second year subject is structured around a number of policy workshops. Each workshop deals with a current policy problem and examines a different stage of policy development. It has as a consultant to the process a social worker who works as a policy practitioner providing a role model of practice in a policy area. Feedback from students has been extremely positive reporting increased confidence in policy skills and a recognition of the importance of these skills in social work. This teaching experience reinforces the need to focus on the educational considerations in teaching a subject where conceptual, theoretical and skill components are equally important if policy practice is to effect change.  相似文献

This paper situates Canada’s Seasonal Agricultural Worker Program (SAWP) within the policy and scholarly debates on “best practices” for the management of temporary migration, and examines what makes this programme successful from the perspective of states and employers. Drawing on extensive qualitative and quantitative study of temporary migration in Canada, this article critically examines this seminal temporary migration programme as a “best practice model” from internationally recognized rights‐based approaches to labour migration, and provides some additional best practices for the management of temporary labour migration programmes. This paper examines how the reality of the Canadian SAWP measures up, when the model is evaluated according to internationally recognized best practices and migrant rights regimes. Despite all of the attention to building “best practices” for the management of temporary or managed migration, it appears that Canada has taken steps further away from these and other international frameworks. The analysis reveals that while the Canadian programme involves a number of successful practices, such as the cooperation between origin and destination countries, transparency in the admissions criteria for selection, and access to health care for temporary migrants; the programme does not adhere to the majority of best practices emerging in international forums, such as the recognition of migrants’ qualifications, providing opportunities for skills transfer, avoiding imposing forced savings schemes, and providing paths to permanent residency. This paper argues that as Canada takes significant steps toward the expansion of temporary migration, Canada’s model programme still falls considerably short of being an inspirational model, and instead provides us with little more than an idealized myth.  相似文献

In the last thirty years, a process of global norm creation in the field of gender equality has taken place. The Convention on the Elimination of All Forms of Discrimination Against Women marks a milestone in this process: it emerged as the first legally binding international instrument for the protection of women's rights. The 180 states that have ratified the Convention have interpreted their treaty obligations in diverse ways, ranging from reluctance to active incorporation. Beyond its original mandate, CEDAW has increased attention on gender issues within the UN human rights framework. Further, it has motivated transnational NGO activism that uses the Convention to connect local understandings of women's rights with global standards to influence national policy developments. Taking these global, national and transnational dynamics together, the article argues that CEDAW has been transformed from a ‘classical’ intergovernmental regime to a transnational network enforcing women's rights. Based on these findings, a theoretical view on global norm creation and enforcement is developed that stresses the reciprocal interrelation between global, national and local spheres. Instead of assuming a ‘trickle-down’ dynamic as a consequence of global agreements, it is argued that the legitimacy and authority of global norms depends on their active interpretation and appropriation within national and local contexts all over the world.  相似文献

In 2013–2014, Ukraine experienced an extraordinary episode of contentious politics, later called Maidan, Euromaidan, or the Revolution of Dignity. It was triggered by the government's refusal to sign the Association Agreement with the European Union, and grew into a nation‐wide social movement that demanded respect for human rights, a change of the political regime, and an end to endemic corruption. Protesters both in the capital and in the regions demanded deeper democracy and justice over the perceived harmful actions of the government. Following the unprecedented use of violence, leaving nearly a hundred dead, Euromaidan resulted in a change in the political regime, a return to pro‐European foreign policy, and an Antimaidan counter‐movement. Reacting to Kyiv events, Russia annexed Ukrainian Crimea and fueled a military conflict in eastern Ukraine. This article presents a short history of Euromaidan and a survey of the growing literature that has examined its conditions, dynamics, and outcomes.  相似文献

This article examines the extent to which measures to mitigate the current financial crisis and prevent future crises are permissible under a variety of bilateral, regional and multilateral trade and investment agreements. US trade and investment agreements, and, to a lesser extent, the World Trade Organization, leave little room to manoeuvre with capital controls, despite increasing evidence that certain controls can prevent or mitigate crises. Investment rules under the treaties of most capital‐exporting nations allow for at least the use of temporary controls as a safeguard measure. The article offers a range of policies that could be deployed to improve US investment rules.  相似文献

The development of consensual science has greatly influenced the international environmental negotiation processes. This is not least the case for the Convention on Long‐range Transboundary Air Pollution (CLRTAP). Negotiators as well as regime analysts regard CLRTAP as a successful example of how scientists have succeeded in influencing international policy making through consensus‐building strategies. Drawing on Ulrich Beck's work on reflexive scientization and the concept of ‘stage management’ from the field of the Sociology of Scientific Knowledge (SSK), this paper critically analyzes the role of science in the regulation of transboundary air pollution. It discusses the consensus‐building strategies developed by scientists as well as contemporary strategies for making science matter in regulative work. It is argued that scientific credibility is crucial for attracting political and public attention, but that credibility does not necessarily have to be based on scientific consensus. The challenge for science is not so much to create consensus but to strengthen its credibility by elaborating new relations with its stakeholders.  相似文献

Abstract

Racial discrimination continues to haunt our societies, calling for sustained and new solutions. In 1994, the US government signed the International Convention on the Elimination of All Forms of Racial Discrimination. Three years later, it ratified this international agreement. This article reviews the effectiveness of this United Nations Convention and discusses its main provisions: national reporting and the individual communications procedure. It finds that the treaty contains comprehensive and legally effective provisions to combat racial discrimination and argues that social workers, along with other professionals, should engage with the international legal regime to assist their clientele to combat racial discrimination. Social workers have a number of roles: advocate, educator, service provider and broker. Their involvement in such an international legal regime would have an added significance; it has the potential to expand the domain of international social work as well as overcome the limits of domestic action against racial discrimination.  相似文献
