Objective. Capitalizing on attention directed to judicial agreement and the associated consequences of judicial elections, this article conducts an examination of the effects of seniority and state methods of judicial retention on decisions by state supreme court justices to dissent. Methods. Using data drawn from the State Supreme Court Data Archive, this research analyzes decisions by individual justices to dissent in 33,582 tort cases from 1995 to 1998. GEE logistic analysis with cases as the clustering unit is the estimation procedure. Results. While the seniority of justices is positively connected to dissent, the findings illustrate that seniority's effect is nuanced and conditioned by a state's method of judicial retention. The impact of a justice's seniority relative to his or her colleagues is most powerful in appointive courts where justices serve without fear of electoral retaliation. Alternatively, within elective courts, justices respond to elections by pursuing a consensual approach regardless of their seniority. Conclusion. The dissent characteristics of justices in state supreme courts are intricately tied to the length of careers and the methods by which states keep justices in office.  相似文献

I examine the trajectory of marital quality as a function of relationship equity with data from a six-wave panel study of 704 married respondents between 1980 and 2000. Reporting that one "gives more" to the marriage (subjective underbenefit) is more likely for women than men at any given marital duration. Respondent's relative contribution to income, paid labor, housework, and health (objective underbenefit) raises this probability for women of average religiosity. For the more religious, objective underbenefit has no effect on women's sense of underbenefit, but reduces men's sense of underbenefit. Objective underbenefit lowers women's, but raises men's, marital quality, at any marital duration. The relevance of equity was not diluted by the passage of time in marriage.  相似文献

From the point of view of economic development, the world is far from being homogeneous. Among the possible causes of such uneven evolution, culture is starting to attract the attention of a growing number of scholars. The present paper surveys some of the most important contributions on culture and economics, with a particular focus on the definition and measurement of culture and on the impact of different cultural traits on economic variables. According to this review of the literature, cultures emphasising individual effort while providing equal opportunities for everyone are more likely to encourage sustained economic growth.  相似文献

School choice may increase student engagement by enabling students to attend schools that more closely match their needs and preferences. But this effect on engagement may depend on the characteristics of the choices available. Therefore, we consider how the amount of educational choice of different types in a local educational marketplace affects student engagement using a large, national population of 8th grade students. We find that more choice of regular public schools in the elementary and middle school years is associated with a lower likelihood that students will be severely disengaged in eighth grade, and more choices of public schools of choice has a similar effect but only in urban areas. In contrast, more private sector choice does not have such a general beneficial effect.  相似文献

Despite the existence of a burgeoning literature on bank profitability, yet, none of them gave due consideration to geographical proximity. I fulfill such a gap by analyzing the effects of COVID-19 on the profitability of top-rated banks. Findings confirm the prevalence of spatial dependence at both the global and sub-global with feedback effects being systematically higher than spillover effects. My study uncovers evidence of a COVID-19 induced decline in asset utilization. Findings advocate sharing economy as a potential tool to banks in combating any future pandemic risk with regionalized approach to supervision being deemed better than its globalized counterpart.  相似文献

After the negative effect of the recent financial crisis on public finances in many countries, it is of a great interest to study attitudes towards taxation to identify effective policies to enhance public support for taxation and welfare programs. In this paper, we analyze empirically people’s attitudes towards taxation in European countries. In particular, we test whether the perception about benefit fraud may produce different effects on preferences over the size of the welfare state along the income distribution. Moreover, we test if contextual variables are relatively more relevant than individual characteristics in determining attitudes towards taxation. Using different data sources for many EU countries in 2008, we contrast those hypotheses taking advantage of multilevel techniques. Our results suggest that policies targeting the deterrence of benefit fraud such as higher penalties and more frequent benefit investigations, increase the high earners’ willingness to pay taxes and then the size of the welfare state. We also find that contextual characteristics explain a larger variance of attitudes toward taxation than individual characteristics, suggesting that the same policy for all UE countries might be not a good strategy.  相似文献

We discuss the privatization schemes of Chile and Argentina following a review of three alternatives to privatization. Our major conclusions are as follows: (1) the Chilean scheme has performed very well during much of the past 15 years, but it is not yet clear what will happen during an extended period of economic stagnation and declining financial markets; (2) for many countries it would make more sense to reform existing public pension schemes than to replace them with privatized schemes, at least until one has a better idea how privatized schemes perform in adverse financial environments; (3) privatized schemes have important distributional effects that deserve more attention.  相似文献

Corporal punishment is believed to exert its influence partially on children's externalizing behavior by undermining the quality of parent‐child relationships, but empirical evidence for this belief is lacking. Thus, the goal of this study was to explore longitudinally whether the use of corporal punishment by mothers was associated with declining quality in parent‐child interactions and whether these declines mediated the links between corporal punishment and later externalizing behavior. Based on data from the NIHCD SECCYD, the findings from this study indicated that the links between the quality of parent‐child interaction and corporal punishment were bidirectional: high quality parent‐child interaction was associated with less use of subsequent corporal punishment by mothers, and maternal use of corporal punishment at 36 months was associated with declines in the quality of parent‐child interaction at 54 months. There were not significant indirect effects of corporal punishment at 36 months on grade 3 aggression through 54 month parent‐child interaction quality, however, which suggests other mechanisms might account for the links between early corporal punishment and later externalizing problems.  相似文献

The aim of the study reported in this paper is to test the hypothesis that individual utility of wealth functions may violate the assumption of smoothness that underpins the standard analysis of the Value of Statistical Life (VSL) and safety. In order to do so we examine the way in which the Willingness to Accept/Willingness to Pay (WTA/WTP) ratio varies as the severity of a health complaint is reduced. We find that as the severity of the health effect is reduced, the WTA/WTP ratio converges across the sample and tends to a level that does not significantly exceed unity. While we acknowledge that this does not constitute conclusive evidence of smoothness, it does suggest that the case in favour of the assumption that individual utility of wealth functions tend to display a kink at the current level of wealth is less than wholly persuasive.  相似文献

Sociologists have long acknowledged that being in a precarious labour market position, whether employed or unemployed, can harm peoples' health. However, scholars have yet to fully investigate the possible contextual, institutional determinants of this relationship. Two institutions that were overlooked in previous empirical studies are the regulations that set minimum compensation for dismissal, severance payments, and entitlements to a period of notice before dismissal, notice periods. These institutions may be important for workers' health as they influence the degree of insecurity that workers are exposed to. Here, we test this hypothesis by examining whether longer notice periods and greater severance payments protect the health of labour market participants, both employed and unemployed. We constructed two cohorts of panel data before and during the European recession using data from 22 countries in the European Union Statistics on Income and Living Conditions (person years = 338,000). We find more generous severance payments significantly reduce the probability that labour market participants, especially the unemployed, will experience declines in self‐reported health, with a slightly weaker relationship for longer notice periods.  相似文献
