ObjectivesThe purpose of the current study was to examine what case characteristics increased the likelihood of a child maltreatment case being prosecuted, and upon prosecution, of being convicted.MethodsData came from 406 criminal court case files from nine judicial districts in North Carolina. Using logistic regression, we examined how county-level and individual characteristics of arrests predicted the probability of prosecution, and for arrests that result in prosecution, the probability of conviction.ResultsNearly two-fifths (39%) of individuals arrested for child maltreatment were also charged with a concurrent offense. Of those with a concurrent offense, 11% had a felony charge. Of those arrested, 40% were prosecuted on at least one charge. Two case characteristics, the presence of any concurrent non-child maltreatment charge or a concurrent felony non-child maltreatment charge, were positively associated being prosecuted on at least one charge. Prosecution for child maltreatment was less likely when there was a concurrent felony charge, when the defendant was the father or a non-parent (relative to the mother), and if the youngest child named was between ages 2–5, or 6–12 (relative to children < 2). Only 18% of cases had physical evidence available. Conviction on at least one charge was more likely when there was a concurrent felony non-child maltreatment charge. Conviction for a child maltreatment was less likely when: there was a concurrent non-child maltreatment felony charge, the defendant was not the parent or caregiver, and there was a CPS investigation or assessment for neglect within a 30 day window of the arrest relative to no investigation.ConclusionsProsecutors in child maltreatment cases weigh not only the admissibility of evidence in deciding whether to pursue prosecution, but also other case characteristics such as the age of the child victim, whether there is available evidence outside of victim testimony, and other concurrent crimes. The prosecutor may have a stronger case for concurrent non-child maltreatment crimes, and these will thus be more likely to result in conviction. This may also play a role in prosecutor decisions.  相似文献

In response, interdisciplinary and multiagency child death review teams have emerged as an important component of child protection. Paradoxically, child death review teams are among the least visible and understood elements in efforts to protect children. This study investigated hope as a protective factor buffering the relationships between parenting stress and well-being among a sample of parents identified at moderate to high risk for child maltreatment. Two hundred parents were recruited from a nonprofit organization providing secondary and tertiary child maltreatment prevention programs. Results of the analyses showed that parental stress was negatively associated with subjective and emotional well-being. Hope was positively correlated with well-being and negatively associated with parenting stress. Hierarchical regression analyses showed that hope had a significant incremental relationship to well-being and that the negative effects of parenting stress fell below statistical significance. These findings provide preliminary support for hope as a coping resource social workers can target when working with parents in the prevention of child maltreatment.  相似文献

Interagency training in child protection is an important part of engaging professionals in a common approach to their collective responsibility for safeguarding children. Training is a key method for empowering professionals to carry out their complex role in child protection with appropriate knowledge, skills and confidence. In Buckinghamshire, experiential learning involving actors has met with some success as part of the interagency child protection training programme. The following paper proposes the argument for using actors, describes how this is done and evaluates its effectiveness for participants, trainers and actors. It is suggested that this method has ample rewards if properly planned, particularly for practitioners in lessons for practice. A close working relationship must be developed between actors and trainers. Scenarios that seem real can be portrayed and skills can then be practised in the knowledge that no one is really being harmed but valuable lessons for real‐life situations can be learned. This paper draws on the results of a commissioned systematic map of UK child protection empirical research published between 2010 and 2014. It analyses current patterns in child protection research in relation to three variables – disciplinary background of authors, types of maltreatment examined, and focus of the research – and considers the relationship between these. It finds first authors' disciplines to be reliable indicators of both the focus and topic of the research, with the dominant fields of psychology, medicine, and social work addressing respectively the long term outcomes of sexual abuse, the short term outcomes of physical abuse, and the care system's response to child maltreatment. The proportion of research dedicated to specific types of maltreatment appears to depend on factors other than their real-world prevalence. Instead, definitional issues and ease of access to research participants appearing to be more influential in determining the topic of the research. UK child protection research appears to show narrow multidisciplinary interaction and little focus on preventative or ameliorative interventions. The development of a coordinated national strategy adopting an interdisciplinary approach in the design and commissioning of child protection research could help maximise research efforts by reducing duplication and potentially facilitating the emergence of more innovative directions.  相似文献

First Nations (Native American) children are greatly overrepresented in the Canadian child welfare system, and disproportionality in the substantiation of maltreatment contributes to this overrepresentation. This study explores the factors driving disproportionality in the substantiation of maltreatment and, more specifically, neglect. Data from the Canadian Incidence Study of Reported Child Abuse and Neglect (2008) are used in multivariate analyses which examine the relationship between the substantiation of maltreatment/neglect and worker assessments of case, child, household, and caregiver characteristics. These case factors fully explain disproportionality in maltreatment substantiation for First Nations and non-Aboriginal children; the disproportionality reflects underlying differences in the case, child, household and caregiver characteristics identified in First Nations and non-Aboriginal investigations. However, case factors do not fully explain disproportionality in substantiation of neglect-only investigations. Further analysis indicates that the weight that workers assigned to caregiver substance abuse, housing problems, and presence of a lone caregiver when substantiating neglect also differed for First Nations and non-Aboriginal children. Discussion of these findings explores possible explanations for these differences, and links to broader discussions around definitions of neglect and the role of substantiation in child welfare decision making processes.  相似文献

State social service agency case files are a common mechanism for obtaining information about a child's maltreatment history, yet these documents are often challenging for researchers to access, and then to process in a manner consistent with the requirements of social science research designs. Specifically, accessing and navigating case files is an extensive undertaking, and a task that many researchers have had to maneuver with little guidance. Even after the files are in hand and the research questions and relevant variables have been clarified, case file information about a child's maltreatment exposure can be idiosyncratic, vague, inconsistent, and incomplete, making coding such information into useful variables for statistical analyses difficult. The Modified Maltreatment Classification System (MMCS) is a popular tool used to guide the process, and though comprehensive, this coding system cannot cover all idiosyncrasies found in case files. It is not clear from the literature how researchers implement this system while accounting for issues outside of the purview of the MMCS or that arise during MMCS use. Finally, a large yet reliable file coding team is essential to the process, however, the literature lacks training guidelines and methods for establishing reliability between coders. In an effort to move the field toward a common approach, the purpose of the present discussion is to detail the process used by one large-scale study of child maltreatment, the Studying Pathways to Adjustment and Resilience in Kids (SPARK) project, a longitudinal study of resilience in youth in foster care. The article addresses each phase of case file coding, from accessing case files, to identifying how to measure constructs of interest, to dealing with exceptions to the coding system, to coding variables reliably, to training large teams of coders and monitoring for fidelity. Implications for a comprehensive and efficient approach to case file coding are discussed.  相似文献

While prior literature generally supports the connection between child maltreatment and violent offending in adolescence and early adulthood for general population samples, less is known about the relationship between child maltreatment and the frequency of violent offending among serious juvenile offenders. As a result, few studies have examined whether the effects of child maltreatment on the frequency of violent offending are mediated by other social processes, as developmental models of aggression and violence would suggest. To examine this issue, self-report data on child maltreatment, general delinquency risk factors, and violent offending were collected from 3,694 juveniles confined to 48 correctional institutions. Results from a series of negative binomial regression models indicated that the relationship between child maltreatment and the frequency of violent offending was mediated by social risk factors. The implications of these findings for theory and practice are discussed.  相似文献

This paper offers a historical and psychosocial account of ‘moral panics’ about child maltreatment in England over the last four decades, and proposes this perspective as additional to Munro's more systemic account of the same history. The formal child protection system is theorised in terms of an explicit and a covert dual primary task. The overt task is to actually protect vulnerable children and prevent abuse; the covert task is to protect the remainder of society from exposure to anxiety provoking ‘dangerous knowledge’ about the prevalence of child maltreatment. Episodes of public and political moral panic occur when the boundaries of containment provided by the official system and its processes are breached, propelling debate and contestation about child maltreatment into the public sphere, where public enquiries and other social mechanisms are called upon to ‘settle’ the contested issues. Sometimes these social settlements appear to be successful in resolving conflicts about the reality or otherwise of specific forms of abuse; in other cases, especially child deaths, the controversial and anxiety-laden nature of the problem is recurrently projected back into the public domain. The paper suggests that this may be associated with a difficulty about establishing a secure symbolic framework or discourse in society for the emotionally indigestible facts of child torture and murder. In turn, this may be associated with problems about the decline of public mourning rituals and the failure of the public enquiry format to facilitate this. In line with Munro, the paper argues for the importance of a tragic perspective on child maltreatment, to counter idealisations of the capacity of the formal system to protect children.  相似文献

As a nation, our approach to managing this societal crisis has been one of indifference to cultural variations among families and children, under the prevailing belief that cultural diversity does not play a part when serving a single society. Experience, however, shows that consideration of ethnocultural factors is warranted if we are to effectively treat and prevent child maltreatment. In this paper, a sociocultural perspective on child maltreatment in the United States Hispanic population is presented. Social stresses experienced by Hispanics along a continuum from emigration and migration, to arrival and adjustment to a new culture, and to the sociocultural and economic conditions they face in the United States are linked to factors of individual psychology. Traditional childrearing values and practices and factors of assessment and intervention are discussed with an emphasis on the changing characteristics of Hispanics.  相似文献

Two hundred fifty-three adults working in a New York child welfare agency agreed to complete anonymous research packets containing, among other measures, 6 existing scales of psychological maltreatment and a single item about exposure to parental alienation as a child. Results revealed that one fourth of the full sample reported some exposure to parental alienation, which itself was associated with greater likelihood of reporting psychological maltreatment. These data document just how widespread parental alienation may be, as well as the likelihood that those exposed to it will experience themselves as having been psychologically maltreated. Implications of these findings are presented in terms of public awareness, education for divorcing families and their children, and professional training for the mental health and legal professionals working with them.  相似文献

Research suggests that early care and education (ECE) services, particularly center-based ECE, may help prevent child maltreatment and also mitigate some of the negative developmental outcomes associated with child maltreatment. There is also preliminary evidence to suggest that ECE could reduce the likelihood that maltreatment allegations will be substantiated by child welfare authorities and/or result in children being placed in out-of-home care. However, little is known about rates of ECE participation among children receiving child welfare services, nor the factors that determine ECE participation for this population. Data from the first wave of the National Survey of Child and Adolescent Wellbeing II, a nationally representative sample of children referred to the United States (U.S.) child welfare system (CWS) for suspected maltreatment, were used to measure the frequency with which 0–5 year olds participate in center-based ECE. Additionally, logistic regression analyses explored the effects of maltreatment type, substantiation, and children's living arrangements (i.e., with parents, relatives, or foster parents) on this outcome, controlling for a range of child and family covariates associated with ECE participation in the general population. Results indicate that less than a third of 0–5 year olds receiving child welfare services in the U.S. are participating in center-based ECE. Among the various categories of maltreatment type measured, being reported to the CWS for suspected physical abuse was associated with decreased odds of center-based ECE participation; however, other types of maltreatment, substantiation, and living arrangement were unrelated to center-based ECE participation. These findings suggest that, despite recent efforts by the U.S. federal government to promote ECE participation for CWS-supervised children, the vast majority of young children in the U.S. CWS are not receiving center-based ECE, and physically abused children are particularly disadvantaged when it comes to accessing these services.  相似文献

In times past, parents were usually blamed when an infant died suddenly and unexpectedly. A more caring attitude evolved with the adoption of the term ‘cot death’ or ‘sudden infant death syndrome’ (SIDS). Recent research looking at the factors responsible for SIDS has focused on aspects of child care and parental behaviour. Epidemiological studies confirm that several risk factors associated with child maltreatment are also to be found in many families who experience a sudden infant death. Social deprivation and other well-known associated features linked to maltreatment are correlated with sudden death in infancy. It is suggested that both physical abuse (suffocation is the most usual mechanism proposed) and neglect (failure to thrive, failure to recognize and treat illness) are important mechanisms. Infanticide (filicide) has existed widely over past centuries and its continuation in modern times is reflected in the highest murder rates of all age groups in infancy. However, much fatal abuse and neglect remains hidden, as demonstrated from the results of detailed fatality reviews. The evidence linking child abuse and neglect with sudden unexpected death in infancy is reviewed.  相似文献

The rate of fatal child maltreatment is increasing, and differentiating between risk factors for fatal as opposed to nonfatal maltreatment is essential to developing prevention programs. This exploratory retrospective study utilizes case record analysis to examine four categories of correlates for child maltreatment: 1) parent/caregiver factors, 2) child factors, 3) environmental/situational factors, and 4) maltreatment incident factors. Thirty-eight fatality cases are compared to a matched group of nonfatality cases to determine which factors are related to fatality in a large Southwestern metropolitan area. The results provide a profile of characteristics that may place a child at higher risk of fatal maltreatment.  相似文献

Providing parents with low incomes accused of child maltreatment access to quality legal representation is both a social justice issue and potential resource for improving their children's well-being. This mixed methods research evaluates a law school clinic which provides indigent parents with legal representation by law students supervised by experienced attorneys. Thirty-nine individuals knowledgeable about the clinic (12 court professionals, 5 law school faculty, 2 parent mentors, 11 students, and 9 parent clients) participated in in-depth, semi-structured, audiotaped interviews focusing on the quality of parent representation. Interviews were contextualized by extensive participant observation and document reviews. Quantitative analyses of administrative data focused on case outcomes identified by participants as desired during qualitative interviews: family reunification, timely case closure and children's placement with relatives. Outcomes for 19 children whose parents were represented by student attorneys did not differ significantly from those of a propensity score matched comparison group of 19 children whose parents were represented by fully licensed attorneys. Participants described clinic staff as providing strong legal counsel to parents, building positive attorney–client relationships, possessing positive personal characteristics, and providing a needed service to the broader community. Participants also identified areas for improvement including: educating parents around court procedures, and better cross system collaboration between child welfare and legal professionals. The Child Protection Clinic is a promising model for providing quality legal representation to parents involved with child protection in order to support child well-being.  相似文献

Australia and the United Kingdom have mandatory systems of case reviews, which are conducted whenever a child known to welfare or health services has died or been seriously harmed due to maltreatment. In the United Kingdom those conducting case reviews are required to involve family members in their deliberations. This study employed discourse analysis to examine the representation of family voices in 41 Overview Reports of Serious Case Reviews undertaken in England and published during 2014. The findings revealed that the contributions of family members were generally relegated or their legitimacy undercut by the positivist framing of most overview reports. However, the research also identified how the framing of family contributions within an interpretivist paradigm could engender highly complex understanding of deficiencies in child protection systems and lead to crucial new learning for professionals.  相似文献

The objective of this study is to investigate the effects of the recent economic recession on child maltreatment rates. Specifically, we examine whether unemployment rates, labor force participation, and food stamp usage are associated with aggregate rates of child abuse and neglect (CAN) rates using state-level data. Theory and prior empirical evidence supports the relationship between family and neighborhood poverty and incidence of child maltreatment; however, the relationship between general economic environment and CAN remains unclear.The study uses a multiple case study design at the state level, analyzing administrative child maltreatment and economic data for seven U.S. states. Aggregate numbers for child maltreatment reports and food stamp usage were obtained from state respective agencies and economic data for unemployment and labor force from the Current Population Survey from the Bureau of Labor Statistics. Empirical growth plots and OLS regression were used to examine changes in maltreatment and utilization of economic variables as predictors over time. Bivariate correlations and OLS regression results show a weak and inconsistent relationship between the economic indicators in this study and maltreatment rates. Several possible reasons accounting for these results are explored.  相似文献
