This article analyses the role of rights in human rights jurisprudence dealing with recognition of identities and cultural diversity in Europe. Using examples of selected case law of the European Court of Human Rights, it discusses the understanding of rights and their impact on the notions of community and recognition. It critically evaluates the recourse to the notions of a closed, established community and the defence of the established status quo in culturally contested conflicts. It analyses claims articulated by those framed as standing outside the narrow confines of such a cultural community. By reference to critical perspectives, the article illustrates how rights operate with categories of paradigm and foreign subjects and regulate respective entitlements of these subjects to enjoy rights. It demonstrates how these categories impact upon the notion of a community and how the narrowing of its boundaries limits the possibilities of belonging of foreign subjects. The article argues that these categories embedded in rights regimes lead to a mutation of rights from tools of inclusion to tools of correction. In their corrective function rights rather than serving as tools of ensuring belonging are used for maintenance of established identities and cultural regimes of power. In the final section by reference to the latest judgments of the same Court expanding rather than narrowing the understanding of a community, the article examines whether rights can reach beyond these subjectivities and offer possibilities of renegotiating the established regimes of cultural power.  相似文献

Despite a strong cognitive association in the minds of native citizens between ethnic minority presence and crime, compelling evidence demonstrating a real-world relationship between crime and ethnic diversity is limited. This study adopts a media-based approach to contribute to the debate on the origin of the perception of criminal threats. By means of a content analysis of 11 years of crime news (2003–2013) in Flanders (the northern, Dutch-speaking part of Belgium), portrayals of ethnic minority and majority perpetrators are systematically compared to assess whether ethnic minorities are portrayed in a significantly more threatening way. Moreover, building on ethnic hierarchy theories, comparisons are made between various outgroups. Findings demonstrate that ethnic minority perpetrators are depicted in a more threatening manner: they are more likely to be associated with violent, property, and gang-related crime. Additionally, they are more likely to be anonymised and to be associated with explicit manifestations of threat. Group differences exist, however, as the most distant outgroup (i.e. North Africans) is covered in a more threatening way than the other outgroups. Collective identities are largely conceived as the essence of human subjectivity, the basis of moral collectivities and the code by which people tend to relate to histories and current affairs. Michel Foucault, notwithstanding, argued that identities are the product of power relations. Through various techniques, such as the classification of populations to certain categories, the hierarchical ordering of these categories, the allocation of differential treatment to those who occupy the various categories and the association between belonging to particular categories and certain jobs and means of living, regimes establish group identities. This process of sorting out, we argue, is the beginning of a laborious endeavor whose final goal is to institutionalize the new identities in the consciousness of the wider public as natural. Education is thought to constitute an essential tool by which regimes inculcate the young generations with constructed identities. Despite that, hegemonic discourses are not stable; rather, they are constantly challenged by all sorts of groups who speak in the name of silenced histories or moral claims. In line with these insights, we aim in this article to trace the Israeli methods employed to constitute the Druze as a distinct ethnic category, which is different not only from the Muslims, a faith community to which they affiliated until 1961, but also from the Palestinian-Arab minority. Particularly, we aim to look at the role that the educational system has played in the constitution of Druze separate identity.  相似文献

Abstract

The withdrawal of the Ottoman Empire from the Balkans in the late nineteenth and early twentieth centuries left a significant impact on the population of the region, especially on the Muslims. Muslim intellectual life was strongly influenced by the arrival of a new political and social order and cultural and religious value system. During this period, Balkan Muslims painfully and irreversibly became an administrative part of Europe. The aim of this paper is to examine the main themes which characterized the writings of Bosnian Muslim intellectuals in the post-Ottoman period, particularly on the eve of and during the Second World War. This work examines the writings of Mehmed Hand?i?, a prominent Bosnian scholar that were published in the El-Hidaje Periodical from 1939 to 1945. The paper brings the scholar's views and commentaries on a variety of topics such as the impoverished Muslim state, the history of Islam and Muslims, and patriotism and nationalism from the Muslim point of view. In most ofHand?i?’swritings the focus is on Muslim intellectual responses to the new political and social changes as well as challenges of the ongoing Second World War. However, hiswritings and reflections continue to have far-reaching effects on Bosnian Muslims and remain relevant to the Bosnian Muslim situation at the beginning of the twenty-first century as the world observes the 20th anniversary of the Srebrenica massacre in 2015.  相似文献

The Muslim presence in Europe has caused the Christian churches to focus their attention on a number of issues arising out of this presence and the following article is a review of three papers put out by church organizations. Starting chronologically from the earliest paper to the most recent, I have first summarized the contents of each paper before analysing and commenting on them collectively. This article explores the types of family–school relationships that promote academic, socio-economic, and social and emotional well-being of black African immigrant children in the United States. The data are ethnographic, drawing on one year of participant observation and interviews at two elementary schools. The findings are also set within the context of an analysis of data from the New Immigrant Survey. The article identifies mechanisms by which relationships between black African immigrants and schools are created and argues that intersections between demographics and school culture are central, particularly as related to the possibilities for relational power, which can allow parents and school staff to transcend persistent inequalities of race and discrimination.  相似文献

Several high-profile negative events involving Muslim perpetrators have recently been covered by the media. We investigated whether the same negative actions are more likely to be labeled “terrorism” when they are committed by Muslims than when they are committed by White non-Muslims. In Experiment I (n?=?60), using a real article about a Muslim perpetrator and a modified version about a non-Muslim perpetrator, we found that participants were more likely to identify a crime as terrorism when it was perpetrated by a Muslim. The label “terrorism” also mediated the effect of Muslim identity on negative judgments of the behavior. In Experiment II (n?=?60), we replicated the results of Experiment I and clarified that the effects persisted when we used a real article about a non-Muslim perpetrator and a modified version about a Muslim perpetrator. We discuss implications for cross-group communication and representations of Muslims in the media.  相似文献

The role of the family in the international migration of highly skilled migrants has often been disregarded. Highly skilled labour migrants follow a concrete job offer abroad and are structurally integrated into the new environment through the work place. On the contrary, the migration of family members is subject to different conditions since most accompanying partners initially do not work. However, accompanying partners are described as managers of the settling-in process of the whole family [Yeoh, Brenda, and Katie Willis. 2004. “Constructing Masculinities in Transnational Space: Singapore Men on the ‘Regional Beat’.” In Transnational Spaces, edited by Peter Jackson, Philip Crang, and Claire Dwyer, 147–163. London: Routledge] and their experiences can be crucial for the duration of their stay. Our paper explores the experiences of mobility of highly skilled migrants’ accompanying partners in Germany and in the UK with regard to their strategies and practices during the settling-in process. The main focus is on the role of language, the establishment of new social networks and labour market participation. The paper draws on the concept of capital accumulation and conversion [Bourdieu, Pierre. 1986. “The Forms of Capital.” In Education: Culture, Economy, and Society, edited by Albert Henry Halsey, 46–58. New York: Oxford University Press] and asks how partners make use of their cultural capital language after migration. Our paper is based on empirical studies in Germany and in the UK, which focus on the migration and settling-in processes of highly skilled professionals and their families.  相似文献

Over the past couple of decades, researchers have documented a phenomenon called ‘migrantisation of care’, which is patterned by the national regimes of care and migration. By applying the ideas of social reproduction and care–migration intersections to the South Korean case, this paper investigates the interplay of care and migration policies through which migrants get involved for various care roles in different care settings. In the matrix of migration (regime) and care (regime) emerge two intersecting fields in South Korea: co-ethnic labour migrants in paid care work and marriage migrants in unpaid care work. The paper has found a growing demand for migrant care labour to address the care crisis in Korea, but the degree to which care work is migrantised varies significantly between childcare and eldercare as well as between home-based care and institution-based care. The paper not only geographically extends the care–migration intersection frame to an East Asian welfare state but widens its theoretical application to an under-explored pattern of care migrantisation, notably unpaid care provision by family migrants.  相似文献

In Western Europe, the children of Moroccan and Turkish migrants were found to be significantly disadvantaged in the labour market. This ethnic gap was found to persist after considering differences in schooling, which was argued to reflect ‘ethnic penalties’ driven by cultural, religious, or racial factors. This study uses data from the 1st Wave of the ‘Netherlands Longitudinal Life-Course Study’ (2009–2010) to revisit the analysis of ‘ethnic penalties’ for second-generation Moroccans and Turks. Unlike in previous research, empirical analyses not only consider differences in schooling, but also skills and social origins. Results show substantial ethnic inequalities in the labour market, with the exception of women from Moroccan origins. For men, these ethnic inequalities do not disappear when human capital factors are considered, but they do when accounting for the unprivileged social origins of ethnic minorities. For women, the disadvantage of second-generation Turks in achieving privileged occupations clearly disappears when human capital and social origins are considered. Yet, the chances of being unemployed among women of Turkish origins persist after controlling for education, skills, and social origins. Overall, this study has global academic and public policy implications to understand the socioeconomic integration of the Moroccan and Turkish second generation in Western Europe.  相似文献

ABSTRACT

Relying on a quantitative survey (n = 1497) and semi-structured interviews (n = 30) conducted in the U.K., we explore British nationals’, Romanian and Turkish migrants’ attitudes of tolerance and the factors influencing them in the current socio-political context in the U.K. The quantitative data reveal the role of younger age, diverse networks, higher education, attachment to city/region and supranational identifications in more open attitudes towards diversity. The qualitative findings illustrate how diverse these three groups’ attitudes of tolerance can be and how they are affected by their position and status in the U.K. The British’ attitudes show their tolerance can reflect diverse forms of acceptance of ethnic and cultural differences but can also draw lines in terms of civic values opposing ‘those who contribute to society’ versus those who ‘live as parasites’. The Turks are in favour of diversity with the expectation of receiving more civic rights and facing less prejudice. The Romanians tend to have a more ambiguous relation to diversity given their position of stigmatised migrants in the U.K. Our analysis reveal how inclusive or exclusive people’s (sub- and supra-)national identities can be and how these frame their attitudes of tolerance.  相似文献

This article investigated negatively valenced contact and the relationship between parental and teenagers’ outgroup negativity in a context of interethnic conflict based on the latent trajectory analysis of a four-wave study of teenager–parent pairs (N?=?234). The analyses revealed that negative outgroup information prevailed both intra- and inter-generationally. On one hand, ascending trends of negative contact correlated positively and significantly with ascending trends of outgroup negativity and this relationship was stronger than the opposite association between change in positive contact and change in outgroup negativity. On the other hand, parental increases in outgroup negativity were associated with similar increases among teenagers, but there were no significant relationships between parental change in positive contact and teenagers’ positive contact and prejudice. The discussion focuses on the implications of the results for the positive–negative contact asymmetry and on the importance of social communication in conflicting contexts.  相似文献

New data collected for the Boston Metropolitan Statistical Area provide detailed information on financial assets that allow analysis to extend beyond the traditional black–white divide. Targeting US-born blacks, Caribbean blacks, Puerto Ricans, Dominicans, and other Hispanics, findings from the National Asset Scorecard for Communities of Color survey underscore the large racial and ethnic disparities in financial wealth, even after controlling for demographic and socioeconomic status. Further, some notable differences between Boston’s communities of color highlight the importance of detailed analyses for research on the racial wealth gap. In particular, among non-white communities Dominicans report comparatively low asset and high debt amounts, while Caribbean blacks report relatively higher levels of wealth. Altogether, these findings point to the need for wealth building opportunities in communities of color and further investigation of the causes and consequences of financial disparities between groups of color disaggregated by specific ancestral origin.  相似文献

To what extent can immigrant parents transmit their home-country language to their children? Drawing on a recent national sample of children of immigrants in France, this paper examines the effects of parental language socialisation and exposure to the parental home country on language ability and language practices of their adult children. The data show that parental efforts at transmitting the language are necessary, but ultimately insufficient especially when it comes to language practices. Almost none of those who grew up without or with only minimal exposure to the parental home-country language use it. But even among those who had extensive exposure only a minority end up using it in their daily lives. The only domain where the second-generation uses the parental home-country language to a non-trivial degree is in the family context. In addition parental resources can have contradictory effects. While successful transmission of home-country language in the immigrant context requires significant resources, those parents who have these resources are less likely to try to pass on their language.  相似文献

The author analyses the discourse on the Ottomans in Croatian history textbooks during the last decade of Socialist rule in the 1980s, the decade of nationalist revival in the 1990s and the decade of the normalization in 2000s and establishes the connections between dominant Croatian ideologies at that time, the historiography and the textbooks. The history textbooks in Croatia during the socialist period (1945–1990) in Yugoslavia continued the anti-Ottoman narrative defined as late as the end of nineteenth century by Croatian nationalist historiography. The discourse was mainly focused on the allegedly unfavourable economic position of Christians during the Ottoman rule and the common plight of Croats and other Southern Slavs. During the nationalistic period of the Franjo Tu?man regime in the 1990s the discourse in the history textbooks remained negative, concentrating on the damage that was inflicted by Ottoman expansion solely to Croatian nation, the state and Catholic faith. After the nationalist regime of Franjo Tu?man left power in 1999 and liberal democracy was finally introduced, Croatian textbooks started to present the Ottoman conquests in a more neutral language and Ottoman Muslim civilization received more nuanced treatment.  相似文献

Although scholars consistently show that class-specific parenting, influenced by the resources parents have due to their socio-economic position, is one of the most important factors for children’s different life chances and outcomes as adults, migrants’ parenting is usually analysed with a focus on their ethnicity or country of origin. Building on cultural perspectives on class, this study demonstrates that migrant parents are differently endowed with institutionalised and embodied cultural capital, which shapes their parenting and therewith their children’s educational opportunities. Specifically, parents differ in their trust in school authorities, the way they define their own role in shaping their children’s education, and their self-esteem and confidence in assessing their children’s abilities and performance. This study is based on the accounts of parents who migrated from Poland to Germany and shows that due to their class position, middle-class parents possess robust forms of cultural capital that they can transfer to their children in the context of migration. This finding makes a case for the relevance of class in the context of migration and thereby adds an important perspective to the study of migrants’ inequalities in education, which tends to focus on ‘ethnic’ differences between migrants and ‘natives’.  相似文献

This paper is based on a larger qualitative study of exclusion and belonging as experienced by members of marginalized groups in the professions. The current analysis draws on a subsample of 13 racialized and Indigenous academics at Canadian universities to examine their experiences of both everyday racism – subtle, almost intangible micro-level interactions that convey messages of not fully belonging – and overt racism and colonialism. Overt experiences were less common, though intensely painful. Though in some ways they are more straightforward to address, as they are more obvious, they also consume considerable time and energy. Instances of everyday racism and colonialism were more common, often intricately interwoven with the very fabric of the institutional culture. Their cumulative nature is exhausting. Diversity initiatives, while popular in contemporary universities, are failing to approach equity, in that they deny the need for change in institutional cultures.  相似文献
