Analyses of disparity in sentencing most frequently use general felony court samples. Because of this, little is known about the specific patterns of sentencing disparity among defendants convicted of criminal homicide. Using a sample of defendants adjudicated guilty of homicide in Philadelphia, Pennsylvania, over the period 1995–2000, this research seeks to describe and explain patterns of sentencing with reference to legal and extralegal defendant and case characteristics. The findings indicate that it is primarily legally relevant variables that influence sentencing outcomes in homicide cases; however, some evidence is found for case processing effects as well as for the operation of criminal stereotypes in the generation of sentence disparities. Implications of these findings for research designs and theory development are discussed.  相似文献

The possible race differences in judicial sentencing have been of long-standing interest to social scientists. We argue, however, that prior research on the issue either uses crude measures of offense severity and prior record, or, if more precise measures are employed, is limited to one or a few offenses. The Pennsylvania guidelines sentencing data used in this report allow a more rigorous test of the racial hypothesis since they include detailed information on these two most important legal variables, on other variables for statistical controls, and on a fairly comprehensive list of common law offenses, with an adequate sample size. The data—analyzed with both additive and interaction models—reveal that race (net of other factors) has a small effect on judicial decision-making as it pertains to the likelihood of incarceration but has negligible effect on the length of imprisonment decision. The small race effect at the in/out decision is accounted for by dispositional departures in sentencing that favor white defendants. Offense severity is overwhelmingly the major factor influencing judicial sentencing, followed at some distance by prior record. At the end of the report, we discuss the implications of our findings for research on sentencing and for policies aimed at reducing the high incarceration rate of black males.  相似文献

Research on criminal punishment and judicial decision making consistently reveals that female offenders receive more lenient treatment than similarly situated male counterparts. A major shortcoming in this body of research, however, is the lack of studies on whether the effects of gender on sentencing differ across geographic localities, such as in rural versus urban courts. Using a rich database on recent sentencing practices in Pennsylvania from 2003 to 2010 (N = 186,634), this study addresses this gap by investigating and comparing the effects of gender on sentence outcomes across six types of locality categorized by their level of rurality. Consistent with the focal concerns theory of punishment decision making, the results indicate robust gender effects on sentencing outcomes across places. When other factors are held constant, female defendants consistently receive more lenient treatment; they are less likely to be incarcerated and receive short sentences if incarcerated. The magnitudes of gender disparities are consistent across levels of the rural‐urban continuum, with one exception: female leniency in shorter jail or prison sentences is greater in the smallest and most rural localities than in other areas. The article discusses implications of the study findings for research on sentencing and rurality.  相似文献

Legislative changes during the 1980s and 1990s made it easier to treat juveniles as adults in the U.S. justice system. Research on the sentencing outcomes of juveniles in the criminal court has been somewhat mixed, with some studies showing that they receive severe or long sentences and others showing that many young people receive probation or relatively short jail or prison sentences. Less attention has been placed on the process through which these cases move through the criminal court and the ways in which the labels of “juvenile” and “adult” are negotiated and contested by legal actors. Using both qualitative and quantitative data, this article examines the negotiation of these labels. While it finds that legal rules are important in establishing the potential outcomes in a case, the power of specific actors and the context of specific courtrooms are also important in shaping the negotiations and contestations over these labels. The article provides a framework to understand outcomes and presents ways that advocates can become involved in helping to shape the outcomes of these cases.  相似文献

The relationship among earnings, savings, and retirement is well known; however, the linkage between labor market outcomes and financial market performance is generally unacknowledged. We examine the implications of the link between labor markets and financial markets for workers who save money in individual retirement accounts. Specifically, differences in labor market outcomes across groups may imply differences in the timing of investments, which may reduce savings over time for these groups compared to their counterparts. Using monthly data from the Current Population Survey (1979–2002), we generate hypothetical investment portfolios using stock and bond indices. We exploit differences across demographic groups in unemployment and wage growth and use these differences to examine each group's investment outcomes. We then disaggregate the total effects into short-term and long-term components. We find some evidence of short-term market timing effects on investment, but we find much larger long-term effects for some groups. Our findings suggest that, for many people, the retirement savings losses associated with the timing of markets are similar to the costs of annuitizing savings upon retirement. The differences are especially pronounced by education and gender.  相似文献

This study examines the impact of model selection on substantive conclusions about racial differences in presentence and sentencing practices. Using a statewide sample of convicted felons, an additive model is estimated to assess the direct and indirect effects of race on various dispositional decisions. Then, separate models for blacks and whites are estimated to evaluate within- and between-race differences. A comparison of the results from each specification illustrates how the standard additive approach used in past studies can mask and suppress racial differences in criminal processing. The findings of race-specific models are then discussed in terms of their implications for further research on racial disparity in the application of criminal sanctions.  相似文献

This study examines the relationship between gender and sentencing severity in the criminal justice system. Analysis focuses (1) on the extent to which gender influences sentencing and (2) on the part played by probation officers' presentence investigations in accounting for these differences. We find males are more likely than females to receive harsh sentences. The gender effect is diminished, but not ellmnished, in multivariate analyses, when controls are introduced for other sociodemographic and legal variables. The length of pretrial detention and the amount of charge reduction also have little impact on the magnitude of this relationship. Presentence recommendations by probation officers, however, have a major effect. Independent of other potential influences, being female greatly increases the likelihood of receiving a non-incarceration sentence recommendation which, in turn, is the primary predictor of final criminal court dispositions. A large portion of the gender effect in sentencing enters during the presentence stage, apparently because probation officers (the court officials who prepare the presentence reports) are influenced by traditional ideas about gender roles. Qualitative data suggest that they believe the sources of crime are different for women and men and that imprisonment is more appropriate as a treatment for men.  相似文献

Previous studies have suggested that Asian parents’ high academic expectations can lead to negative mental health outcomes among Asian American youth. We explore this hypothesis by analyzing data collected in an affluent, suburban high school with a large Asian American population. We examine the relationships between parent expectations, students’ relationships with their parents, and mental health outcomes among Asian American (predominantly Indian American and Chinese American) and white youth. We find that the quality of parent-child relationships is associated with mental health outcomes and that the association between parent expectations and mental health outcomes is insignificant after controlling for these relationships. We discuss significant differences by race and gender. The findings presented expand our understanding of the influence of Asian parents. They suggest that focusing on improving parent-child relationships, as opposed to altering parents’ expectations, might lead to improved mental health outcomes for Asian American youth, particularly for those in affluent communities.  相似文献

We report data concerning cross-cultural judgments of emotion in spontaneously produced facial expressions. Americans, Japanese, British, and International Students in the US reliably attributed emotions to the expressions of Olympic judo athletes at the end of a match for a medal, and at two times during the subsequent medal ceremonies. There were some observer culture differences in absolute attribution agreement rates, but high cross-cultural agreement in differences in attribution rates across expressions (relative agreement rates). Moreover, we operationalized signal clarity and demonstrated that it was associated with agreement rates similarly in all cultures. Finally, we obtained judgments of won-lost match outcomes and medal finish, and demonstrated that the emotion judgments were associated with accuracy in judgments of outcomes. These findings demonstrated that members of different cultures reliably judge spontaneously expressed emotions, and that across observer cultures, lower absolute agreement rates are related to noise produced by non-emotional facial behaviors. Also, the findings suggested that observers of different cultures utilize the same facial cues when judging emotions, and that the signal value of facial expressions is similar across cultures.  相似文献

Abstract

Although the punishment of juvenile offenders has increasingly become an issue of major concern to the public, few studies test the government's coercive response to offending by this particular group. This article addresses the issue by examining the variation in the willingness of courts in the United States to adjudicate juvenile offenders in the adult criminal courts and sentence them to adult correctional facilities. I use pooled time-series negative binomial regression to analyze raw counts of juveniles admitted to adult prisons from 1983 to 2001. Results consistently show that states with larger minority populations admit more juvenile offenders to prisons but that states with very large African American populations send fewer of these offenders to prison. The findings also show that differences in the ideological climate of each state are a strong predictor of the variation in adult sanctions for minors. Additional evidence shows that states where judges must run in an election to gain their seats and states where judges have shorter terms proscribe more severe sanctions for juvenile offenders by sentencing more of them to adult prisons. Overall, the results suggest that race and politics play a very strong role in the sentencing of juvenile offenders to adult prisons.  相似文献

Relationship satisfaction and stability are two commonly studied outcomes in marriage and family research. Majority of studies address socio demographic variability and differences across union type in these outcomes. We extend this literature by addressing how the amount of effort one puts into their relationship is associated with stability and satisfaction. Specifically, we focus on how effort impacts these measures of quality in four union types: premarital cohabitation, first marriage, post‐divorce cohabitation, and second marriage following divorce. Furthermore, we make union type comparisons in the strength of effort's association with satisfaction and stability. Using data from 8,006 respondents in the Relationship Evaluation Survey, our results show that effort was strongly and positively associated with satisfaction and stability in all four unions. Although effort is more strongly associated with satisfaction in first marriage than cohabiting relationships, no union type differences in the role of effort on stability were observed. Clinical and research implications of these findings are discussed.  相似文献

Motivated by existing work that explores the impact of urbanization and spatial segregation on occupational outcomes, we utilize General Social Survey data from 1990 to 2006 to investigate the interrelationships among race, urbanization, and occupation. Our results indicate that white professionals are associated with several levels of urbanization, while black professionals are weakly associated with any level of urbanization. We also explore other dimensions of stratification by including education and gender into our analyses. Our findings suggest that the relationship between occupation and urbanization is highly complex with some distinctive patterns, and that education—the great equalizer—only partially ameliorates racial and gender differences.  相似文献

Most of the research literature has given little or no attention to the social backgrounds and traits of black scientists and female scientists. The present study, based on survey findings on a national sample of American scientists, helps to fill this gap. Female scientists are compared with their male colleagues, and black scientists with their white colleagues. Race is a better predictor than gender of certain demographic characteristics. However, a clearer picture of variations in social background and current family patterns is derived from an analysis which controls for both race and gender. This analysis includes data on social status of parents, marital status of scientist, number of siblings and number of offspring, religious identity, and region of origin. The implications of these survey findings for the future development of scientific talent are explored, including some implications for researchers, sociologists of science, and social planners.  相似文献

Although substantial work has examined the influence of adolescent pregnancy on mothers’ developmental outcomes, few studies have investigated the influence of adolescent mothers’ educational attainment on their children's achievement. This article examined the reading and math achievement trajectories of children born to adolescent and nonadolescent mothers with various levels of educational attainment. Results demonstrate that higher levels of maternal education predicted children's higher initial achievement at kindergarten and growth in achievement through eighth grade. The achievement of children with adolescent mothers, however, never reaches parity with the achievement of their peers with nonadolescent mothers. Race also predicted achievement differences. Black and Latino children of adolescent mothers were at greater risk for underachievement.  相似文献

Religion and social control have been a sociological concern since Durkheim and Weber, and the relationship between religion and punishment has long been the subject of speculation. However, surprisingly little empirical research exists on the role of religion or religious context in criminal justice, and almost no research on the role of religious context on actual sentencing practices. We conceptualize the potential relationships between religious context and sentencing severity by drawing from the focal concerns and court community perspectives in the sentencing literature and from the moral communities theory developed by Rodney Stark. We suspect that Christian moral communities might shape notions of perceived blameworthiness for court community actors. Such moral communities might also affect notions of community protection—affecting perceptions of dangerousness, or perhaps rehabilitation, and might influence practical constraints/consequences (e.g., local political ramifications of harsh or lenient sentences). We examine these questions with a set of hierarchical models using sentencing data from Pennsylvania county courts and data on the religious composition of Pennsylvania counties from the Associated Religion Data Archives. We find that county Christian religious homogeneity increases the likelihood of incarceration. In addition, Christian homogeneity, as well as the prevalence of civically engaged denominations in a county condition the effects of important legally relevant determinants of incarceration. Furthermore, we find evidence that Christian homogeneity activates the effect of local Republican electoral dominance on incarceration. We argue that Christian homogeneity affects sentencing practices primarily through local political processes that shape the election of judges and prosecutors.  相似文献

This paper reports the results of a study designed to examine the possibility that Mexican-Americans charged with felonies receive biased treatment in California courts. Using data from superior courts in Fresno, California, it is shown that, when charged with similar crimes, Chicanos and Anglos in this district are given quite similar treatment–there is no observable judicial bias. In addition, this study shows a much stronger relationship between seriousness of charge and length of sentence (if guilty) than other earlier studies have. This is attributed to California's determinate sentencing law, which, it appears, forces the courts to give heavy and relatively uniform weight to legally relevant variables in sentencing.  相似文献

People living in some arrangements show better health than persons in other living arrangements. Recent prospective studies document higher mortality among persons living in particular types of households. We extend this research by examining the influence of household structure on health using longitudinal data. We theorize that individuals experience role-based household relations as sets of resources and demands. In certain household structures, individuals are more likely to perceive that the demands made on them outweigh the resources available to them. This perceived imbalance poses a risk to individual health. We test our expectations by analyzing the relationship between living arrangements and health using data from waves 1 and 2 of the Health and Retirement Study. We focus on persons ages 51-61 and explore gender differences. We find prospective links between household structure and self-rated health, mobility limitation, and depressive symptoms. Married couples living alone or with children only are the most advantaged; single women living with children appear disadvantaged on all health outcomes. Men and women in other household types are disadvantaged on some health outcomes. Our results suggest that the social context formed by the household may be important to the social etiology of health. In addition, they qualify the well-known link between marital status and health: The effect of marital status on health depends on household context.  相似文献

This article offers a test of labeling theory by exploring whether contact with school and justice system authorities has long-term, negative, and independent effects on an individual's labor market success. We use the National Longitudinal Survey of Youth (NLSY79), a large and nationally representative sample, to examine whether experiences ranging from school suspension to incarceration during ages 15–23 can predict occupational status, income, and employment during ages 29–37. Unlike previous studies, we control for an exhaustive list of variables: social background, human capital, prior deviant behavior, family status, and local context. Our findings generally support labelling theory. Severe forms of labeling like sentencing and incaraceration have the strongest negative effects, though among females suspension or expulsion from school also has consistently negative effects. We conclude with a discussion of how labeling might reduce employment chances, with a focus on gender differences.  相似文献

This systematic review evaluated the effects of foreign tact training on emergent learning outcomes in ten published studies. We also conducted a meta-analysis of aggregate data from seven studies comparing outcomes of foreign tact training with other verbal operant procedures. The preliminary findings indicated foreign tact training produced criterion-level responses in 84 of 106 (79.2%) post-test probes across 37 learners and 55 evaluations of foreign tact training. The meta-analysis results revealed significantly higher within-subjects mean levels of emergent responding following foreign tact training than foreign-to-native intraverbal, native-to-foreign intraverbal, and foreign listener training. Emergent outcomes for adults were not significantly greater than for children. Finally, foreign tact training was slightly more efficient than the other verbal operant procedures, although most of the differences were not statistically significant.Supplementary InformationThe online version contains supplementary material available at 10.1007/s40616-022-00170-z.  相似文献

This article reexamines gender differences in electoral outcomes. We consider whether electoral competition has a differential impact on the electoral fortunes of male and female quality candidates. This study uses an original data set containing detailed candidate information for US House open seat primary and general elections between 1994 and 2004. The results indicate that when multiple quality candidates enter the race, female quality candidates are at a greater disadvantage than their male counterparts. The results suggest that null findings from previous work are a product of the way the relationship between gender and electoral outcomes is typically modeled.  相似文献
