Is Disney Disabling?

Abstract

This article discusses ongoing lawsuits against Disney Parks and Resorts U.S., brought by people with autism and their families. These lawsuits illuminate an ethical dilemma about the appropriate scope of disability equality. This article suggests that Disney and the courts have adopted a standard of simple equality where all theme park patrons are treated the same way, regardless of ability. I argue, however, that the standard of equality that should be used moving forward is equal access to advantage – specifically, equal access to opportunities that enable people with disabilities to have an enjoyable theme park experience.

Many employers have excluded women whose infertility is not medically documented from allegedly hazardous work claiming they feared if the women became pregnant, their fetuses would be harmed. In United Auto Workers v. Johnson Controls, the Supreme Court held in 1991 that so-called "fetal protection policies" are unlawful sex discrimination. After examining four cases challenging exclusionary policies in Britain and the United States, this article unmasks and argues against the assumptions underlying such policies. By returning to well-established sex discrimination doctrine, moving away from a male norm, and reaffirming women's right to both work and have children, the Supreme Court's decision in UAW V. Johnson Controls is an important victory. The decision should help to break down job segregation, prompt the EEOC to act, and clear the way for addressing questions of health and safety rather than equality and difference.

Is Bigger Really Better?

This study investigates the effect of a capital facilities project on nonprofit financial vulnerability metrics. The author employs a difference‐in‐differences technique to model the relationship between facilities investments and financial vulnerability indicators using data for a matched‐pair sample of nonprofit organizations that invested and did not invest in a facilities project. Overall the findings suggest that investments in facilities are associated with temporary increases in an organization's net assets ratio and decreases in its surplus ratio after a project is completed, and that the costs associated with facilities projects (for example, debt) place strain on nonprofit finances. The study's findings have implications for the financial management of nonprofit organizations, particularly in regard to the associated costs of capital expansion.

In the face of global competition, many countries are adopting a flexicurity approach to labour regulation, providing employers with greater flexibility to hire and retrench workers while helping workers transition to new jobs. This review of six Asian countries finds that China and the Republic of Korea have enacted such reforms; Singapore and Malaysia provide some ingredients of flexicurity, though no unemployment insurance; India and Sri Lanka have introduced few reforms and continue to rely on an older model of employer-based security. To support informal workers, the Governments of China, India and Sri Lanka use public works, self-employment programmes and skills training.

In the context of providing health and human services for older individuals, modern American culture often depends on formally asserting and battling over a clashing array of rights among respective combatants as a first resort at problem-solving. A substantial impediment exists in our cultural environment that discourages families and professionals, and the agencies that employ them, from recognizing and respecting the rights of older persons in a less adversarial and more subtle, sensitive, and flexible manner. This article discusses this barrier, illustrating it in several aging-related settings, and suggests a paradigm for addressing the situation. Then, several current challenges to the rethinking of rights and responsibilities in geriatric and gerontological practice are acknowledged.
