Sweet-Talking the Fourth Branch: The Influence of Interest Group Comments on Federal Agency Rulemaking

Students of politics have identified a variety of actors whoappear to influence the federal bureaucracy's implementationof public policy, including Congress, the president, and interestgroups. These lines of research, however, have often portrayedinterest groups as actors with indirect influence (who, forexample, work through or with Congress), rather than assessingthe direct influence of interest groups on bureaucratic policyoutputs. I conduct a test of direct interest group influenceby analyzing an original data set composed of 1,444 interestgroup comments in reaction to forty federal agency rules. Ifind, contrary to the expectations of the extant literature,that the formal participation of interest groups during rulemakingcan, and often does, alter the content of policy within the"fourth branch" of government. I conclude that those who voicetheir preferences during the notice and comment period rulemakingare often able to change government policy outputs to bettermatch their preferences.     

Un-Silencing the Past: The Writings of Toussaint Louverture

Contrary to most slave revolts, the Haitian Revolution (1791–1804) has left a rich archival record that includes documents written by the dominant classes as well as by the people of African descent. Of these, the most notable author was Toussaint Louverture, who during the 1790s wrote hundreds of letters, pamphlets, and proclamations (a few of them in his own hand) in an effort to shape official and public opinion in France and Saint-Domingue (Haiti). Particularly worthy of note is a 21-page memoir that Louverture wrote shortly before his death and that defended his public record as governor of Saint-Domingue.     

Inequalities in English child protection practice under austerity: A universal challenge?

The role that area deprivation, family poverty, and austerity policies play in the demand for and supply of children's services has been a contested issue in England in recent years. These relationships have begun to be explored through the concept of inequalities in child welfare, in parallel to the established fields of inequalities in education and health. This article focuses on the relationship between economic inequality and out‐of‐home care and child protection interventions. The work scales up a pilot study in the West Midlands to an all‐England sample, representative of English regions and different levels of deprivation at a local authority (LA) level. The analysis evidences a strong relationship between deprivation and intervention rates and large inequalities between ethnic categories. There is further evidence of the inverse intervention law (Bywaters et al., 2015): For any given level of neighbourhood deprivation, higher rates of child welfare interventions are found in LAs that are less deprived overall. These patterns are taking place in the context of cuts in spending on English children's services between 2010–2011 and 2014–2015 that have been greatest in more deprived LAs. Implications for policy and practice to reduce such inequalities are suggested.     

Coping with Low Pay: Cognitive Dissonance and Persistent Disparate Earnings Profiles

The paper focuses on an employee’s perception of his or her own labour market outcome. It proposes that the basic earnings function, by adopting an approach that ignores perception effects, is likely to result in biased results that will fail to understand the complexities of the wage distribution. The paper uses an orthodox job search framework to illustrate the nature of this problem and then adapts the model to take onboard the theory of cognitive dissonance. The search model indicates how workers may adopt a coping strategy in order to reduce the disutility associated with the wage underpayment that develops. Then, by modelling cognitive dissonance, the paper highlights the weaknesses of using purely human capital proxies to understand labour market outcome. The analysis goes some way to explaining why individuals with equivalent human capital investment can have disparate earnings profiles.     

Child welfare reform in the United States: findings from a local agency survey

Efforts to improve the public welfare and child welfare system sparked an unprecedented amount of federal legislation in the 1990s, including the Adoption and Safe Families Act of 1997 (ASFA), the Multiethnic Placement Act of 1994 and Interethnic Adoption Provisions of 1996 (MEPA-IEP), and welfare reform. Such reforms allow an unprecedented degree of flexibility, but little is known about their implementation. Researchers administered the Local Agency Survey to the first national probability sample of public child welfare agencies from 1999 to 2000. Findings indicate that ASFA has had the most effect on child welfare service delivery. Welfare reform has had less effect, and MEPA-IEP seems to have had little effect at all.     

A crisis intervention perspective on the termination process

Recognition of termination as a crisis of separation/individuation supports a crisis intervention approach to work during this phase, with guidelines derived from Mahler's theory of separation/individuation, Bowlby's theory of attachment and loss, and James Mann's notion of the subjective meaning of time. The social work literature on the topic is reviewed, and case examples illustrate varying responses to termination depending on the perception of the experience as a threat, loss, or challenge.An earlier version of this paper was presented at the NASW Professional Symposium Washington, D.C., November 1983.     

Social work, modernity and post modernity

In this article we argue that current reform proposals coming from Robert Pinker and others are challenging the universalist premises of generic social work. Pinker et al. argue that social work should, for the sake of efficiency and performance, be a connected set of specialist activities. This ‘determinate dispersal’ which we recognise as falling within the remit of postmodern strategies, we contrast with the far more libertarian ideas of the noted post-modern theorist J.F. Lyotard. Thus we site the political and cultural meanings of Pinker's ideas between generic social work which upholds ideas of universal ethical values and universal provision, and those of Lyotard whose anti-foundationalism proposes a radically heterogeneous society with no central value-structure. We express our concern that the ‘new specialist’ remit may allow too much power to the social worker. Thus we have considerable sympathy for Lyotard's call for a radical anonistics – a field wherein the inequalities of power between say, a worker and her client, to some extent can be redressed.
