从“一个馒头引发的血案”看我国的“侵犯著作权罪”

2006年,网络短片“一个馒头引发的血案”挑起了自由职业者胡戈与导演陈凯歌之间的著作权侵权纠纷,也提出了我国著作权刑法保护方面存在的问题。本文试从著作权法的角度对“馒头案”进行分析,并对比《TRIPS协议》及其他发达国家关于“侵犯著作权罪”的规定,指出我国刑法关于“侵犯著作权罪”规定的不足之处及如何进一步完善。     

亲水性膜的研制和亲水性研究

为了消除小片距、复杂片型高效表冷器在湿工况下运行时产生的“水塞”问题和进一步提高这类表冷器的热工性能,本文从凝结方式的理论分析出发,介绍了在表冷器上制作亲水性膜的方法,从理论上分析了这种亲水性膜的结构与亲水性的关系,从实践上给出了这种亲水性膜对表冷器的热工性能的新贡献,为研制高效紧凑式表冷器提供了可喜的前景。     

Asymptotically optimal policy for stochastic job shop scheduling problem to minimize makespan

This paper studies the large-scale stochastic job shop scheduling problem with general number of similar jobs, where the processing times of the same step are independently drawn from a known probability distribution, and the objective is to minimize the makespan. For the stochastic problem, we introduce the fluid relaxation of its deterministic counterpart, and define a fluid schedule for the fluid relaxation. By tracking the fluid schedule, a policy is proposed for the stochastic job shop scheduling problem. The expected value of the gap between the solution produced by the policy and the optimal solution is proved to be O(1), which indicates the policy is asymptotically optimal in expectation.

青岛市是山东省经济发展的龙头。伴随经济的快速增长。近年来金融业也取得了长足的发展。在审视和考察国内主要区域金融中心发展和建设经验的基础上可知。为使青岛市的经济发展迈上更高的台阶,金融支撑必不可少。而其核心在于金融服务种类和水平的提升。利用区位优势,青岛市的金融服务业水平提升之后,能为整个山东省及周边区域的经济发展提供强有力的金融支持。因此,加快推进青岛市区域金融中心建设具有重要的现实意义。实际上有关青岛市建设区域金融中心早有规划和实施,根据山东省政府“十一五”规划。要基本形成济南和青岛两个在全国具有较大影响的区域金融中心。目前“十一五”规划期已近结束．回顾青岛市区域金融中心建设的发展历程。总结成绩、寻找不足．进而为今后推进青岛市区域金融中心建设积累经验、寻找突破点。     

Study on Time Expectancy of Care for Daily Living of Chinese Elderly

According to the data of the Chinese Longitudinal Healthy Longevity Survey(CLHLS)and applyin g methods of Sullivan and multistate life table,this paper examines the time expectancy of care for daily living of Chinese elderly and its proportion in their elderly life.The results find that there exists a signifi cant gender gap of the expectancy,which the male at 65averagely are expected to have four to five care years while the female at 65averagely are expected to have seven to eight care years.The time expectancy for slight care of daily living is longer than that for sever care.Additionally,there is no significant difference between urban elderly and rural elderly.However,as age increases,the time expectancy for slight care goes down while that for sever care stabilities at a constant at different ages.The time expectancy for different types of care and its proportion in the rest of life are significantly various.The study points out that the establishment and improvement of care insurance system and the elderly care service are very necessary.     

Interwoven migration narratives: identity and social representations in the Lusophone world

This article provides an exploratory analysis of the life narratives of migrants in the Portuguese-speaking world. By interweaving the life experiences of eight participants in three thematic clusters – ‘shared past’, language and sense of community – we propose a critique of the deep-seated idea of the Lusophone space as a community constructed by the harmonious conviviality of different countries and people. Drawing on contributions from cultural studies, social psychology, anthropology and sociology, we first aim to give voice to the human subjects who embark on migrations and then to understand how the engendered process of identity construction is framed by their social world, simultaneously reframing it. Thus, we aim at shedding light on the ways in which aspects of the political discourses on Lusophony are used (and are instrumental) to the migrants’ identity narrative (re)construction.     

Complete moment convergence of widely orthant dependent random variables

It is known that the dependence structure of widely orthant dependent (WOD) random variables is weaker than those of negatively associated (NA) random variables, negatively superadditive dependent (NSD) random variables, negatively orthant dependent (NOD) random variables, and extended negatively dependent (END) random variables. In this article, the results of complete moment convergence and complete convergence are presented for WOD sequence under the same moment conditions as independent sequence in classical result (Chow 1988 Chow, Y.
