巴渝理学家度正诗文的思想内容与艺术特色

度正以理学名世,乃朱熹门徒,是南宋时期巴渝的儒家正统文人。其诗文留存不少,但多应制酬答之类。诗文里常渗透着理学思想和忧国忧民之感,偶有乐观旷达的情怀。＂以文为诗＂、＂好用故实＂的南宋主流诗风对其诗歌影响颇深。     

乾隆十四年《澳门约束章程》碑新探

《澳门约束章程》碑是清代澳门政制发展史的一个最重要的里程碑。虽然当今澳门史论著和工具书述及本碑甚多,但是所代拟之碑名众说不一,对本碑的撰定批准者以及时间介绍也有不少异说误解,对本碑的产生过程及内容之论述仍然较为粗疏而有错漏,本文就此提出了自己的见解。     

Impact of extreme temperatures on the performance evaluation of China's work-related injury insurance system

With the influence of climate change resulting in more extreme days, a rise in the number of work-related injuries could be expected. The literature has addressed the performance evaluation of a work-related injury insurance (WII) system via a two-stage structure with input/output correlation as well as the impact of extreme temperatures under different scenarios. This article thus evaluates the performance of a system comprised of operational and service sub-systems under three scenarios of extreme temperatures and proposes a hybrid two-stage dynamic data envelopment analysis (DEA) model with nondiscretionary variables for measuring integrated WII efficiency under the three scenarios. The results are as follows: (1) the poor performance of the operational and service sub-systems leads to the integrated WII system's low efficiency for 30 provinces in China during 2010–2019, except for Zhejiang, Hainan, and Qinghai. (2) Extreme temperatures must be considered when measuring WII efficiency and its stage efficiencies, or otherwise WII efficiency and operational efficiency will be underestimated in 19 provinces. (3) The negative impacts of extreme temperatures on the efficiency of the integrated WII system should be taken notice of, especially for Sichuan.     

人工智能发展对农业生产率的影响:基于跨国面板数据的实证分析

人工智能是促进２１世纪新一轮产业变革的核心技术,全面影响经济社会发 展.结合人工智能在农业领域应用的现状,参考 Acemoglu 等的理论框架,以１９９１－２０１８ 年世界银行和国际机器人联合会的国别数据为样本,实证分析其对农业生产率的影响及其 作用机制.实证结果表明:(１)以劳均农业产值为农业生产率衡量指标,人工智能对农业生 产率具有正向促进作用;(２)在作用机制方面,对农业劳动力具有显著的替代效应,但对产业 结构尚未发挥出显著影响.此外,在异质性分析方面,人工智能对高收入国家农业生产率具 有显著促进作用,对中低收入国家具有抑制作用.因此,发展现代农业,需大力推动人工智 能在农业领域的发展与应用,促进农业劳动力转移,提高农业生产率.     

致命的蜕变:戈尔巴乔夫时期苏共执政能力问题研究

苏共亡党亡国亡制的一个直接原因是戈尔巴乔夫当政时期苏共执政能力出现了致命的蜕变:执政的指导思想背离了科学社会主义方向,苏共的执政迷失了正确的航向;急于求成、不切实际的经济建设纲领,恶化了苏联的经济,大大弱化了苏共驾驭社会发展的能力;党的建设无序又无为,一个原本集中统一的执政党演变为思想混乱、组织分裂、毫无战斗力的乱哄哄的“俱乐部”。执政能力的衰减和衰竭,使苏共最终完全丧失了领导国家和社会的本钱与资格。

Time varying factor models with possibly strongly correlated noises

In factor models, noises are often assumed to be weakly correlated; otherwise, separation of factors from noises becomes difficult, if not impossible. This paper will address this problem. We utilize an econometric idea, the so called common correlated effects (CCE) to estimate time varying factor models. We first cross sectionally average the covariates and then project the responses to the space spanned by the averaged covariates. By doing so, noises are diminished while factors are distinguished. The advantages of our new estimators are two folds. First, the convergence rates of estimated factors and loadings are independent of cross sectional dimension. Second, our new estimators are robust to the correlation of noises. Hence our new estimators can, on one hand, separate market factors for the stock data set used in this paper even if noises exhibit strong correlations within industries due to industry-specific factors and on the other hand, avoid inappropriately absorbing industry-specific factors into market factors.     

论公益信托中最近似原则的适用

本文通过对英美法和大陆法中公益信托最近似原则的比较研究,探讨了英美法在开始不能与嗣后不能两种情况下适用最近似原则的具体规定和要求,指出了大陆法在规定适用最近似原则上的不足,同时提出了完善我国公益信托中最近似原则规定的建议。     

刑事司法“政法”属性的生态学解析

刑事司法作为政治法律制度体系的重要组成部分具有深刻的国家政治属性,但从其深层本质上讲属于法律实践活动,它直接产生于人类社会对于严重冲突解决机制的持续探索,根本目的与最终价值由其内在法律属性而决定。刑事司法的政治属性与法律属性是协调共生的有机体,但不可混淆乃至相互取代,制度安排应当准确界分与妥善处理二者之间的生态关系。     

《论法的精神》的当下意义——也评“中国法学向何处去”

《论法的精神》概括的由地理、经济、宗教等因素决定的良宪论是其核心精神,也是法治标准的核心标准,而中国现阶段的法治标准缺少这样的核心内容。中国古代政体历经君主政体、准君主政体和专制政体三个阶段,缺少宪政的阶级结构和经济基础。《论法的精神》的权力制约思想对我国现阶段仍有重大启迪意义。另外,《论法的精神》的比较研究方法、唯物主义方法、综合系统方法对我国法学有很大的借鉴作用。对＂中国法学何处去＂的回答,要点在于对中国现在国情的研究。
