刑事诉讼中的程序性辩护

程序性辩护是一种＂以攻代守＂地对付政府检控方的辩护方式,也就是通过指控侦查人员的违法行为和侵权行为,将＂政府置于被告的地位让他为自己的非法行为受审＂。侦查阶段应赋予律师调查取证权。起诉阶段可以借鉴英美法系大小陪审团之经验,构建中国听证式检察审查会。审判阶段之程序性辩护以程序瑕疵和程序无效为两大类而展开。     

2010，从盘锦到玉树

从1997年开始。玉树就是盘锦的对口帮扶对象。2010年玉树的灾难,也就尤其令盘锦人动容。当消息传来,从盘锦到玉树的精神和物质的双重援助。就迅疾展开,并源源不断。这期间,曾有一个人自驾车跋涉3000多公里,为玉树人民送去了盘锦人的心意。此人是盘锦的民营企业家卜桂生。在玉树地震两周年到来之际,卜桂生对那次迢迢爱心之旅做了回顾。     

Two-step variable selection in partially linear additive models with time series data

Lots of semi-parametric and nonparametric models are used to fit nonlinear time series data. They include partially linear time series models, nonparametric additive models, and semi-parametric single index models. In this article, we focus on fitting time series data by partially linear additive model. Combining the orthogonal series approximation and the adaptive sparse group LASSO regularization, we select the important variables between and within the groups simultaneously. Specially, we propose a two-step algorithm to obtain the grouped sparse estimators. Numerical studies show that the proposed method outperforms LASSO method in both fitting and forecasting. An empirical analysis is used to illustrate the methodology.     

Student-t censored regression model: properties and inference

In statistical analysis, particularly in econometrics, it is usual to consider regression models where the dependent variable is censored (limited). In particular, a censoring scheme to the left of zero is considered here. In this article, an extension of the classical normal censored model is developed by considering independent disturbances with identical Student-t distribution. In the context of maximum likelihood estimation, an expression for the expected information matrix is provided, and an efficient EM-type algorithm for the estimation of the model parameters is developed. In order to know what type of variables affect the income of housewives, the results and methods are applied to a real data set. A brief review on the normal censored regression model or Tobit model is also presented.     

明代西宁卫所属藏传佛教寺院考补

明代西宁卫所属藏传佛教寺院甚多.蒲文成先生主编的《甘青藏传佛教寺院》一书对此已有详细的记载,其中尤以对清代创建寺院的记载最多,也有相当数量的明代或明代以前创建寺院的记载.但是,该书主要依据的是清代以来的《安多政教史》、《西宁卫新志》、《青海记》以及寺院保存的部分寺志和当地的口述历史,而不是明代史籍,这对于确定上述寺院是否为明代所建带来了一定的困难.本文主要依据《明实录》等史籍中有关西宁卫所属藏传佛教寺院的记载,对明代西宁地区藏传佛教寺院略加考补.

Graphic Gambling Warnings: How they Affect Emotions, Cognitive Responses and Attitude Change

The present study focuses on the effects of graphic warnings related to excessive gambling. It is based upon a theoretical model derived from both the Protection Motivation Theory (PMT) and the Elaboration Likelihood Model (ELM). We focus on video lottery terminal (VLT), one of the most hazardous format in the gaming industry. Our cohort consisted of 103 actual gamblers who reported previous gambling activity on VLT’s on a regular basis. We assess the effectiveness of graphic warnings vs. text-only warnings and the effectiveness of two major arguments (i.e., family vs. financial disruption). A 2 × 2 factorial design was used to test the direct and combined effects of two variables (i.e., warning content and presence vs. absence of a graphic). It was found that the presence of a graphic enhances both cognitive appraisal and fear, and has positive effects on the Depth of Information Processing. In addition, graphic content combined with family disruptions is more effective for changing attitudes and complying with the warning than other combinations of the manipulated variables. It is proposed that ELM and PMT complement each other to explain the effects of warnings. Theoretical and practical implications are discussed.     

“I Learned the Bad Things I'm Doing”: Adolescent Mothers' Perceptions of a Relationship Education Program

The purpose of this study was to explore what pregnant and parenting adolescent mothers felt they learned from a relationship education program. A total of 148 primarily Hispanic adolescent mothers who participated in the Strengthening Relationships Program took part in focus-group interviews. Narratives revealed that adolescent mothers perceived the program as effective in changing how they communicated and dealt with conflict with their partners. Specifically, they reported understanding the importance of communication and effective conflict-resolution strategies. In addition, narratives revealed adolescent mothers grew in self-awareness as a result of their program participation. These findings affirm the importance of providing relationship education to adolescent parents.     

伴随语境和红楼言语研究

阐释了伴随语境的概念,依据《红楼梦》前八十回的言语例证,从情绪、关系、体态因素等方面进行了分析论证,探讨其对红楼言语产生的影响,及其与言语之间不同寻常的关系,揭示了伴随语境等因素对言语交际的重要意义。     

The Role of Temporary Help Agency Employment on Temp-to-Perm Transitions

This paper evaluates the impact of agency work on temporary workers’ posterior likelihood of being hired on a permanent basis. We use administrative data on two groups of temporary workers for whom we have complete work histories since they are first observed in 1998 until the year 2004. One group consists of workers employed through a temporary help agency (THA) at some point during the 7 year period under examination (treated group). The other group is composed of individuals employed as direct-hire temps at some point between 1998 and the year 2004, but never via a THA (control group). Using propensity score matching methods, we find that agency workers endure a lower likelihood of being hired on a permanent basis following their temporary assignment than their direct-hire counterparts. However, there are relevant differences for some groups of workers.
