和谐语境中的司法期待

法律关系是人际关系的特殊表现,当事人之间纠纷的发生导致了人际关系的破坏,法律的正义观应关注未来的人际关系。现实中被设计出来作为化解冲突、实现和谐的司法制度,却往往在实际的案件裁判中更多的成为延续和引发再次冲突的根源。因此,司法必须通过裁判使当事人从内心消除怨恨,实现人际关系的修复,而不是仅仅着眼于一个具体个案的审结。简单的追求效率不是以人为本的司法,也不符合转型社会的实际需要。     

Earnings of Chinese Immigrants in the Enclave and Mainstream Economy*

La documentation sur le sujet n'est pas décisive quant à savoir si léconomie ethnique enclavée enregistre un rendement économique comparable chez les travailleurs et les entrepreneurs immigrants à ceux qui se situent dans le courant économique principal. Les auteurs de cette étude utilisent des données du Recensement du Canada de 2001 sur la langue la plus utilisée au travail din de mesurer la participation des immigrants chinois à léconomie enclavée. Après les avoir comparés au capital humain ainsi qu'aux variations liées au travail et au milieu urbain, les résultats démontrent que le rendement est moins élevé chez les hommes et chez les femmes de l'enclave que celui des gens qui se trouvent dans le courant économique principal. Les caractéristiques de la langue et le type de travail qui s'effectue dans léconomie enclavée expliquent pourquoi le rendement y est inférieur à celui obtenu dans le courant économique principal. The literature in inconclusive as to whether the immigrant enclave economy offers returns to immigrant workers and entrepreneurs comparative to those in the mainstream economy. This study uses data from the 2001 Census of Canada on language most often used at work to measure enclave economy participation for Chinese immigrants. The findings show that returns are lower for men or women in the enclave than those in the mainstream economy, respectively, after controlling for human capital, work‐related and urban variations. Language features of and job type in the enclave economy explain why returns are inferior to that of the mainstream economy.

中国电信业的改革，虽然距离预期的目标还有较大的差距，但已经极大地激发了时我国电信业的需求。小灵通和CDMA见证了我国电信业的发展和竞争。论文从市场性、经济性和发展的可持续性三个方面对小灵通和CDMA的发展进行了比较。分析结果显示：在市场性上，小灵通优于CDMA，但是它们在经济性和持续性上都表现不佳。     

A strategy for third-party logistics systems: A case analysis using the blue ocean strategy

One of today's most frequently discussed topics in the business world is how to escape from the intense Red Ocean and how to create an uncontested Blue Ocean. However, because there are few practical guidelines available on this topic, we will introduce a case study of a third-party logistics (3PL) provider, CJ-Global Logistics Service (CJ-GLS), to show how it aspires to be a leader in the newly introduced 3PL industry in South Korea. CJ-GLS is a latecomer in the logistics industry, and its resources, such as the number of trucks and warehouses, are relatively small in comparison to those of established companies. But, it has achieved a distinct competitive advantage through innovative information technology (i.e., RFID—radio frequency identification), which has enabled it to create an uncontested market space, electronic logistics business. One remarkable fact about CJ-GLS is that its swift growth comes not from attracting competitors’ customers from the existing Red Ocean market but from creating a Blue Ocean market (3PL market), which previously existing incumbents ignored, and also from constructing a new business model founded on a RFID-based, ubiquitous-oriented 3PL system. Analyzed through a Four Actions Framework and characterized as Blue Ocean, this case study provides valuable information on how a company reinforces its competitive advantage from the Red Ocean while it transitions into a Blue Ocean by utilizing advanced information communication technologies.

焦虑的诱发因素及调控方法--以体操教学为例的研究

国内外心理学对学生的焦虑与运动成绩的相关研究已成为一个专门的课题。针对焦虑对学生体操技术掌握的影响，运用运动心理学有关理论对大学生体操教学中的焦虑诱发因素进行问卷调查，归纳了体操教学中诱发学生焦虑过度的原因，并对其主要影响因素进行分析，提出了控制学生的适宜焦虑水平的方法。

跨国公司要在我国市场取得成功，必须更加着重于开发针对我国“大众市场”的战略，而减少对竞争激烈、市场趋于饱和的顶级城市的关注。跨国公司构建以消费者为中心的分销渠道应与消费者保持零距离接触，向终端市场靠拢，实现分销渠道扁平化，有利于与同一个市场上优势明显的本地公司进行有效竞争。从消费者的需求出发，实现本土化经营，以便更好地了解以及服务当地客户，提高客户的满意度。     

代谢综合征基础与临床系列研究——GRGDSP/7E3对动脉粥样硬化内皮细胞MMPs的mRNA表达的影响

目的了解GRGDSP/7E3对基质金属蛋白酶（MMP-2,MMP-9）mRNA表达的影响。方法体外培养人脐静脉内皮细胞,分别用酶谱法和逆转录聚合酶链式反应（RT-PCR）检测MMP-2,MMP-9活性和mRNA表达。待细胞融合成单层后,分别加入无血清培养基、静息期血小板、活化后血小板及interleukin-1β（IL-1β）,共同培养60min后,洗去血小板,内皮细胞继续培养6h。上清液及细胞分别用于酶谱法检测MMP-2和MMP-9活性,以及RT-PCR分析mRNA表达。结果内皮细胞与活化血小板共同培养后,酶谱法显示：与对照组相比,未活化的血小板轻微诱导MMP-2和MMP-9分泌,而活化状态的血小板能显著诱导这二者的分泌,与IL-1β的作用相当;而且还可以见到62kDaMMP-2活化形式。加入阻断剂GRGDSP以及GPⅡb/Ⅲa单克隆抗体（7E3）作用后检测发现,MMP-2和MMP-9分泌减少。与活化血小板共同培养后的内皮细胞表面表达uPAR和MT1-MMP以及上清液中MMP-2的mRNA与对照组相比明显增高,而静息状态的血小板作用不显著。加入GRGDSP或7E3后,mR-NA的表达降低。结论①活化状态的血小板与IL-1β的作用相当,能显著诱导MMP-2和MMP-9分泌;能明显增高内皮细胞（EC）-uPAR和MT1-MMP及上清液中MMP-2mRNA的表达;②GPⅡb/Ⅲa阻断剂可能抑制血小板在不稳定斑块部位聚集、粘附等一系列炎症反应。
