知识产权滥用行为阻碍后续的创新和公平竞争，破坏知识产权人与社会公共利益之间的平衡，损害自由公平意义下的竞争秩序。为保障知识产权制度功能的实现，应对权利保护和禁止权利滥用并重。可从法律保障和政策引导两个层面，运用系统工程的方法，规制知识产权滥用。     

19世纪末20世纪初中国商人阶层的崛起

在漫长的中国封建社会中,商业被"贬之日末务",商人也位于"四民"之末,士农工商的地位归序似乎成了中国封建社会亘古不变的模式.然而到了19世纪末20世纪初,随着民族危机日益加深,"商战"呼之欲出,商人团体相继成立,商会诞生,商人政治意识提高并且对政治广泛参与,使商人的社会地位发生了根本性的变化.商人阶层坚持不懈地努力终于迎来了清政府自上而下的重商措施的出台.清延设立商部以指导商人组织,制定商律以规范商人行动,颁行一系列工商的法规以奖商恤商,一系列新经济政策的实施使社会舆论开始从抑商转为誉商,商人在社会上广受赞扬,官员也开始纷纷投资经商.所有这些,促进了中国新的绅商阶层的形成,并进而带动了整个商人阶层随之崛起.     

关联理论对称谓语的认知解读

关联理论认为在交际中,对交际意图的识别就是对言语意义的理解。交际中称谓语的使用过程就是称谓者(说话人)与被称谓者(受众或读者)通过关联图式的打破或激活方式来相互认知的过程。这就是关联理论框架下称谓语的认知解读机制。     

欧盟航天产品贸易管控法律制度及其借鉴

随着世界航天科技的飞速发展,人类的航天活动已经由政府主导逐渐向商业化全面转移,对于航天产品贸易规则的订立也越来越受到各国的重视。欧盟的航天产品贸易管控制度形成较早,经过长期的发展与完善已基本形成了相对宽松、具有明显区域性特征且法制化程度较高的航天产品贸易管控制度。中国应借鉴欧盟的成功经验,实现军民两用产品的规范化贸易,积极参与多边出口控制国际机制,优化航天产品贸易的操作程序,加快空间贸易管控制度的法制化进程,才能在不断发展的航天事业中立于不败之地。     

Some Matrix Norm Kantorovich Inequalities and Their Applications

In this article, we first present four matrix norm Kantorovich-type inequalities involving non negative definite matrix. Then, based on these inequalities, we propose four new efficiency criteria and present their lower bounds to make efficiency comparisons between the ordinary least squares estimator and the best linear unbiased estimator in a singular linear model.     

An Integrated Model for Organization—Public Relational Outcomes,Organizational Reputation,and Their Antecedents

This study is to test a theoretical model regarding the effect of organization—public relationships on organizational reputation. Grounded in multidisciplinary literature, this study proposed that organization—public relational outcomes are hypothesized to influence organizational reputation, considering the exogenous influences of communication behaviors, experience, and familiarity that the research participants hold of the organizations studied. The proposed model illustrated tenable data-model fits, and most of the hypotheses were statistically supported. The key finding of the research includes that, across all organizations studied, organization—public relational outcomes were associated positively with favorable reputation of the organizations studied. Limitations and suggestions for the future research were discussed.     

A Note on the Lower Bounds on Maximum Number of Clear Two-Factor Interactions for (2 m−p III) and (2 m−p IV) Designs

ABSTRACT

In the reliability analysis of mechanical repairable equipment subjected to reliability deterioration with operating time, two forms of the non-homogeneous Poisson processes, namely the Power-Law (PL) and the Log-Linear (LL) model, have found general acceptance in the literature. Inferential procedures, conditioned on the assumption of the PL or LL model, underestimate the overall uncertainty about a quantity of interest because the PL and LL models can provide different estimates of the quantity of interest, even when both of them adequately fit the observed data. In this paper, a composite estimation procedure, which uses the PL and LL models as competing models, is proposed in the framework of Bayesian statistics, thus allowing the uncertainty involved in model selection to be considered. A model-free approach is then proposed for incorporating technical information on the failure mechanism into the inferential procedure. Such an approach, which is based on two model-free quantities defined irrespectively of the functional form of the failure model, prevents that the prior information on the failure mechanism can improperly introduce prior probabilities on the adequacy of each model to fit the observed data. Finally, numerical applications are provided to illustrate the proposed procedures.     

高校引进人才流失意图影响因素分析——以黑龙江省哈尔滨市H高校为例

文章以哈尔滨市H高校为例,描述和探讨了高校人才流失意图的现状及其影响因素的作用情况。研究发现,高校引进人才的流失意图普遍较低,群体态度倾向于积极;性别、学科、年收入、抚养子女数、来校工作时间对流失意图有显著影响;组织承诺度与流失意图呈显著负相关,且这种影响不受人口特征的影响;工作满意度及工作投入度均通过组织承诺度间接影响流失意图。     

对中国农村药品"两网"建设问题的思考——以陕西省为例

为了推动农村药品"两网"建设的有序发展,对中国农村药品"两网"建设的现状进行了阐述,对农村"两网"建设中存在的问题进行了分析,提出从加强部门间的协调与合作、重新划分监管职能、完善药品监管法律法规、引入市场机制,促进药品供应网络健康运行等方面规范运行.     

工科院校社会工作专业教育存在的困境与办学特色探讨

社会工作专业教育自20世纪80年代末期在我国设立以来,在经历了前十几年缓慢发展以后,最近几年进入了一个快速扩张时期,国内高校尤其工科院校开办社会工作专业的数量成倍增加。社会工作注重应用性、实践性和操作性的特点与很多工科院校或以有工科背景的综合性大学的办学方针不谋而合。社会工作专业教育在取得了一定的成绩和研究成果的同时,也不难发现在其发展过程中存在不少的问题。把社会工作专业办成工科院校的亮点和特色,就要在办学过程中充分体现工科院校的应用型定位。
