浅议法律解释中的利益衡量法

文章从法律解释与利益衡量的关系出发,阐明利益衡量在民事审判中是有其存在的必要的。并在此基础上,探讨了法官在进行利益衡量时应使用哪些方法,排除哪些有碍利益衡量的因素,以及进行利益衡量时应考虑的利益原则和所负担的相当注意义务。

法律是正式制度的重要组成部分,有效率的法律能提供有效的激励机制.法律激励是通过赋予权利(权力)、明确责任、强制约束等法律规范的设置来实现的.其功能的发挥需要建立利益表达、利益博弈、利益综合与利益实现的合理机制.其实现的充分条件是建立立法的公众参与制度,而健全的法律实施机制则是法律激励功能实现的必要条件.

试论社会治理背景下政府与市场关系的经济法规制

政府与市场的关系问题是经济法规制的基于问题,如何正确看待政府与市场在经济生态系统内各自的功能及作用,是经济法规制的核心问题。因为这样的认识直接导致了经济立法的体系构建与内容规则。经济法规制是国家实施经济治理与尊重市场调节的基本依据,也是施行经济法治与社会治理的根本前提。所以,从社会治理的背景下来讨论经济法规制的社会经济发展的制度条件及制度生成条件,有利于真正建立和完善经济法规制的体系和内容,从而使得经济法治生态化地融入社会治理的结构体系内,达到优化社会制度以促进经济发展的目的。     

Leader negative feedback-seeking and leader effectiveness in leader-subordinate relationships: The paradoxical role of subordinate expertise

From a motivational perspective of feedback-seeking behavior, we examined the mediating role of leaders' negative feedback-seeking from subordinates in the relationship between the quality of leader-member exchange (LMX) and subordinates' evaluation of leader effectiveness, along with the moderating role of subordinate expertise in the mediated relationship. Using 151 unique matched sets of leader and subordinate reports obtained from 5 large Korean companies, we found that the positive relationship between LMX and leader effectiveness was mediated by leaders' negative feedback-seeking. Additionally, the positive relationship between LMX and leader negative feedback-seeking was stronger when perceived subordinate expertise was lower. Lastly, the indirect effect of LMX on leader effectiveness through leader negative feedback-seeking was stronger when perceived subordinate expertise was lower. These findings were obtained after controlling for leaders' power distance and goal orientations that might influence their motives to seek or avoid feedback. Theoretical and practical implications are discussed.     

Balanced consistency and balanced cost reduction for sequencing problems

We investigate the implications of balanced consistency and balanced cost reduction in the context of sequencing problems. Balanced consistency requires that the effect on the payoff from the departure of one agent to another agent should be equal between any two agents. On the other hand, balanced cost reduction requires that if one agent leaves a problem, then the total payoffs of the remaining agents should be affected by the amount previously assigned to the leaving agent. We show that the minimal transfer rule is the only rule satisfying efficiency and Pareto indifference together with either one of our two main axioms, balanced consistency and balanced cost reduction.     

政府购买居家养老服务的探索与发展——以济南市历下区为例

基于济南市历下区购买居家养老服务的实践,探讨了社区居家养老服务的时代背景,重点分析了历下区政府购买居家养老服务的运作模式,研究结果表明,在我国养老压力日益严峻的情况下,要完善政府购买居家养老服务模式,必须积极推进社区居家养老服务产业的发展;加大政策扶持力度,加强资金引导;培育社会组织,提高养老服务品质;实现政府购买居家养老服务的标准化运作,只有这样才能缓解养老压力,提高老年人生活质量,推动养老服务事业的发展。     

A usability gap between older adults and younger adults on interface design of an Internet-based telemedicine system

Internet-based telemedicine is becoming an effective tool to deliver home-healthcare services and health information on demand, especially in rural areas, where there is often a large elderly population with greater rates of preventable chronic diseases. However, the designs of current interfaces for these internet-based telemedicine systems do not take elderly user characteristics into consideration. This study conducted usability testing on the interface of an internet-based telemedicine system using two different age groups, young adults and older adults. Differences in overall performance and satisfaction between the two groups were identified. Based on these results, a future direction is suggested for the interfaces of Internet-based telemedicine systems.     

属性关系与诊断测验分类影响的探讨

认知诊断模型-DINA模型假定属性之间是相互独立、非补偿的关系,但在实际应用中,属性之间有可能存在补偿关系.文章探讨了在不同的被试总体下,DINA模型在属性之间独立和存在补偿关系时作答数据上的表现,结果表明,当测验中有部分属性间存在补偿关系时,会给DINA模型诊断分布带来较大的影响,在固定其他条件(被试人数、随机因子)条件下,存在和不存在补偿作用所导致的诊断分类率之间有显著差异,且在不同大小补偿作用下,诊断分类率之间的差异显著;随着随机因子的增加,不同大小的补偿因子所导致的诊断分类率之间的差异会变小,补偿因子和随机因子之间存在着显著的交互作用.
